<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaae6c633-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610"><num value="3610">§ 3610.</num><heading> Administrative enforcement; preliminary matters</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaae6c634-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a"><num value="a" class="bold">(a)</num><heading class="bold"> Complaints and answers</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idaae6c635-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idaae6c636-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/1/A"><num value="A">(A)</num><clause style="-uslm-lc:I11" class="indent0" id="idaae6c637-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/1/A/i"><num value="i">(i)</num><content> An aggrieved person may, not later than one year after an alleged discriminatory housing practice has occurred or terminated, file a complaint with the Secretary alleging such discriminatory housing practice. The Secretary, on the Secretary’s own initiative, may also file such a complaint.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="idaae6c638-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/1/A/ii"><num value="ii">(ii)</num><content> Such complaints shall be in writing and shall contain such information and be in such form as the Secretary requires.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="idaae6c639-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/1/A/iii"><num value="iii">(iii)</num><content> The Secretary may also investigate housing practices to determine whether a complaint should be brought under this section.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idaae6c63a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/1/B"><num value="B">(B)</num><chapeau> Upon the filing of such a complaint—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idaae6c63b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/1/B/i"><num value="i">(i)</num><content> the Secretary shall serve notice upon the aggrieved person acknowledging such filing and advising the aggrieved person of the time limits and choice of forums provided under this subchapter;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaae6ed4c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/1/B/ii"><num value="ii">(ii)</num><content> the Secretary shall, not later than 10 days after such filing or the identification of an additional respondent under paragraph (2), serve on the respondent a notice identifying the alleged discriminatory housing practice and advising such respondent of the procedural rights and obligations of respondents under this subchapter, together with a copy of the original complaint;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaae6ed4d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/1/B/iii"><num value="iii">(iii)</num><content> each respondent may file, not later than 10 days after receipt of notice from the Secretary, an answer to such complaint; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaae6ed4e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/1/B/iv"><num value="iv">(iv)</num><content> the Secretary shall make an investigation of the alleged discriminatory housing practice and complete such investigation within 100 days after the filing of the complaint (or, when the Secretary takes further action under subsection (f)(2) with respect to a complaint, within 100 days after the commencement of such further action), unless it is impracticable to do so.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idaae6ed4f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/1/C"><num value="C">(C)</num><content> If the Secretary is unable to complete the investigation within 100 days after the filing of the complaint (or, when the Secretary takes further action under subsection (f)(2) with respect to a complaint, within 100 days after the commencement of such further action), the Secretary shall notify the complainant and respondent in writing of the reasons for not doing so.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idaae6ed50-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/1/D"><num value="D">(D)</num><content> Complaints and answers shall be under oath or affirmation, and may be reasonably and fairly amended at any time.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae6ed51-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idaae6ed52-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/2/A"><num value="A">(A)</num><content> A person who is not named as a respondent in a complaint, but who is identified as a respondent in the course of investigation, may be joined as an additional or substitute respondent upon written notice, under paragraph (1), to such person, from the Secretary.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idaae6ed53-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/a/2/B"><num value="B">(B)</num><content> Such notice, in addition to meeting the requirements of paragraph (1), shall explain the basis for the Secretary’s belief that the person to whom the notice is addressed is properly joined as a respondent.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaae6ed54-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b"><num value="b" class="bold">(b)</num><heading class="bold"> Investigative report and conciliation</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idaae6ed55-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b/1"><num value="1">(1)</num><content> During the period beginning with the filing of such complaint and ending with the filing of a charge or a dismissal by the Secretary, the Secretary shall, to the extent feasible, engage in conciliation with respect to such complaint.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae6ed56-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b/2"><num value="2">(2)</num><content> A conciliation agreement arising out of such conciliation shall be an agreement between the respondent and the complainant, and shall be subject to approval by the Secretary.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae6ed57-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b/3"><num value="3">(3)</num><content> A conciliation agreement may provide for binding arbitration of the dispute arising from the complaint. Any such arbitration that results from a conciliation agreement may award appropriate relief, including monetary relief.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae6ed58-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b/4"><num value="4">(4)</num><content> Each conciliation agreement shall be made public unless the complainant and respondent otherwise agree and the Secretary determines that disclosure is not required to further the purposes of this subchapter.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae6ed59-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b/5"><num value="5">(5)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idaae6ed5a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b/5/A"><num value="A">(A)</num><chapeau> At the end of each investigation under this section, the Secretary shall prepare a final investigative report containing—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idaae6ed5b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b/5/A/i"><num value="i">(i)</num><content> the names and dates of contacts with witnesses;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaae6ed5c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b/5/A/ii"><num value="ii">(ii)</num><content> a summary and the dates of correspondence and other contacts with the aggrieved person and the respondent;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaae6ed5d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b/5/A/iii"><num value="iii">(iii)</num><content> a summary description of other pertinent records;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaae6ed5e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b/5/A/iv"><num value="iv">(iv)</num><content> a summary of witness statements; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaae6ed5f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b/5/A/v"><num value="v">(v)</num><content> answers to interrogatories.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idaae6ed60-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/b/5/B"><num value="B">(B)</num><content> A final report under this paragraph may be amended if additional evidence is later discovered.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaae6ed61-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/c"><num value="c" class="bold">(c)</num><heading class="bold"> Failure to comply with conciliation agreement</heading><content><p style="-uslm-lc:I11" class="indent0">Whenever the Secretary has reasonable cause to believe that a respondent has breached a conciliation agreement, the Secretary shall refer the matter to the Attorney General with a recommendation that a civil action be filed under <ref href="/us/usc/t42/s3614">section 3614 of this title</ref> for the enforcement of such agreement.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaae6ed62-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/d"><num value="d" class="bold">(d)</num><heading class="bold"> Prohibitions and requirements with respect to disclosure of information</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idaae6ed63-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/d/1"><num value="1">(1)</num><content> Nothing said or done in the course of conciliation under this subchapter may be made public or used as evidence in a subsequent proceeding under this subchapter without the written consent of the persons concerned.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae71474-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/d/2"><num value="2">(2)</num><content> Notwithstanding paragraph (1), the Secretary shall make available to the aggrieved person and the respondent, at any time, upon request following completion of the Secretary’s investigation, information derived from an investigation and any final investigative report relating to that investigation.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaae71475-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/e"><num value="e" class="bold">(e)</num><heading class="bold"> Prompt judicial action</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idaae71476-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/e/1"><num value="1">(1)</num><content> If the Secretary concludes at any time following the filing of a complaint that prompt judicial action is necessary to carry out the purposes of this subchapter, the Secretary may authorize a civil action for appropriate temporary or preliminary relief pending final disposition of the complaint under this section. Upon receipt of such an authorization, the Attorney General shall promptly commence and maintain such an action. Any temporary restraining order or other order granting preliminary or temporary relief shall be issued in accordance with the Federal Rules of Civil Procedure. The commencement of a civil action under this subsection does not affect the initiation or continuation of administrative proceedings under this section and <ref href="/us/usc/t42/s3612">section 3612 of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae71477-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/e/2"><num value="2">(2)</num><content> Whenever the Secretary has reason to believe that a basis may exist for the commencement of proceedings against any respondent under sections 3614(a) and 3614(c) of this title or for proceedings by any governmental licensing or supervisory authorities, the Secretary shall transmit the information upon which such belief is based to the Attorney General, or to such authorities, as the case may be.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaae71478-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f"><num value="f" class="bold">(f)</num><heading class="bold"> Referral for State or local proceedings</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idaae71479-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/1"><num value="1">(1)</num><chapeau> Whenever a complaint alleges a discriminatory housing practice—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idaae7147a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/1/A"><num value="A">(A)</num><content> within the jurisdiction of a State or local public agency; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idaae7147b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/1/B"><num value="B">(B)</num><content> as to which such agency has been certified by the Secretary under this subsection;</content>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">the Secretary shall refer such complaint to that certified agency before taking any action with respect to such complaint.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae7147c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/2"><num value="2">(2)</num><chapeau> Except with the consent of such certified agency, the Secretary, after that referral is made, shall take no further action with respect to such complaint unless—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idaae7147d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/2/A"><num value="A">(A)</num><content> the certified agency has failed to commence proceedings with respect to the complaint before the end of the 30th day after the date of such referral;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idaae7147e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/2/B"><num value="B">(B)</num><content> the certified agency, having so commenced such proceedings, fails to carry forward such proceedings with reasonable promptness; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idaae7147f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/2/C"><num value="C">(C)</num><content> the Secretary determines that the certified agency no longer qualifies for certification under this subsection with respect to the relevant jurisdiction.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae71480-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idaae71481-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/3/A"><num value="A">(A)</num><chapeau> The Secretary may certify an agency under this subsection only if the Secretary determines that—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idaae71482-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/3/A/i"><num value="i">(i)</num><content> the substantive rights protected by such agency in the jurisdiction with respect to which certification is to be made;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaae71483-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/3/A/ii"><num value="ii">(ii)</num><content> the procedures followed by such agency;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaae71484-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/3/A/iii"><num value="iii">(iii)</num><content> the remedies available to such agency; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaae71485-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/3/A/iv"><num value="iv">(iv)</num><content> the availability of judicial review of such agency’s action;</content>
</clause>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">are substantially equivalent to those created by and under this subchapter.</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idaae71486-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/3/B"><num value="B">(B)</num><content> Before making such certification, the Secretary shall take into account the current practices and past performance, if any, of such agency.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae71487-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/4"><num value="4">(4)</num><content> During the period which begins on <date date="1988-09-13">September 13, 1988</date>, and ends 40 months after <date date="1988-09-13">September 13, 1988</date>, each agency certified (including an agency certified for interim referrals pursuant to 24 CFR 115.11, unless such agency is subsequently denied recognition under 24 CFR 115.7) for the purposes of this subchapter on the day before <date date="1988-09-13">September 13, 1988</date>, shall for the purposes of this subsection be considered certified under this subsection with respect to those matters for which such agency was certified on <date date="1988-09-13">September 13, 1988</date>. If the Secretary determines in an individual case that an agency has not been able to meet the certification requirements within this 40-month period due to exceptional circumstances, such as the infrequency of legislative sessions in that jurisdiction, the Secretary may extend such period by not more than 8 months.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae73b98-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/f/5"><num value="5">(5)</num><content> Not less frequently than every 5 years, the Secretary shall determine whether each agency certified under this subsection continues to qualify for certification. The Secretary shall take appropriate action with respect to any agency not so qualifying.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaae73b99-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/g"><num value="g" class="bold">(g)</num><heading class="bold"> Reasonable cause determination and effect</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idaae73b9a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/g/1"><num value="1">(1)</num><content> The Secretary shall, within 100 days after the filing of the complaint (or, when the Secretary takes further action under subsection (f)(2) with respect to a complaint, within 100 days after the commencement of such further action), determine based on the facts whether reasonable cause exists to believe that a discriminatory housing practice has occurred or is about to occur, unless it is impracticable to do so, or unless the Secretary has approved a conciliation agreement with respect to the complaint. If the Secretary is unable to make the determination within 100 days after the filing of the complaint (or, when the Secretary takes further action under subsection (f)(2) with respect to a complaint, within 100 days after the commencement of such further action), the Secretary shall notify the complainant and respondent in writing of the reasons for not doing so.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae73b9b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/g/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idaae73b9c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/g/2/A"><num value="A">(A)</num><content> If the Secretary determines that reasonable cause exists to believe that a discriminatory housing practice has occurred or is about to occur, the Secretary shall, except as provided in subparagraph (C), immediately issue a charge on behalf of the aggrieved person, for further proceedings under <ref href="/us/usc/t42/s3612">section 3612 of this title</ref>.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idaae73b9d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/g/2/B"><num value="B">(B)</num><chapeau> Such charge—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idaae73b9e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/g/2/B/i"><num value="i">(i)</num><content> shall consist of a short and plain statement of the facts upon which the Secretary has found reasonable cause to believe that a discriminatory housing practice has occurred or is about to occur;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaae73b9f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/g/2/B/ii"><num value="ii">(ii)</num><content> shall be based on the final investigative report; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaae73ba0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/g/2/B/iii"><num value="iii">(iii)</num><content> need not be limited to the facts or grounds alleged in the complaint filed under subsection (a).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idaae73ba1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/g/2/C"><num value="C">(C)</num><content> If the Secretary determines that the matter involves the legality of any State or local zoning or other land use law or ordinance, the Secretary shall immediately refer the matter to the Attorney General for appropriate action under <ref href="/us/usc/t42/s3614">section 3614 of this title</ref>, instead of issuing such charge.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaae73ba2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/g/3"><num value="3">(3)</num><content> If the Secretary determines that no reasonable cause exists to believe that a discriminatory housing practice has occurred or is about to occur, the Secretary shall promptly dismiss the complaint. <paragraph style="-uslm-lc:I11" class="indent0" id="idaae73ba3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/g/4"><num value="4">(4)</num><content> The Secretary may not issue a charge under this section regarding an alleged discriminatory housing practice after the beginning of the trial of a civil action commenced by the aggrieved party under an Act of Congress or a State law, seeking relief with respect to that discriminatory housing practice.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaae73ba4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/h"><num value="h" class="bold">(h)</num><heading class="bold"> Service of copies of charge</heading><chapeau style="-uslm-lc:I11" class="indent0">After the Secretary issues a charge under this section, the Secretary shall cause a copy thereof, together with information as to how to make an election under <ref href="/us/usc/t42/s3612/a">section 3612(a) of this title</ref> and the effect of such an election, to be served—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaae73ba5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/h/1"><num value="1">(1)</num><content> on each respondent named in such charge, together with a notice of opportunity for a hearing at a time and place specified in the notice, unless that election is made; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idaae73ba6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3610/h/2"><num value="2">(2)</num><content> on each aggrieved person on whose behalf the complaint was filed.</content>
