<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaaf0148b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011"><num value="4011">§ 4011.</num><heading> Authorization to establish and carry out program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf0148c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/a"><num value="a" class="bold">(a)</num><heading class="bold"> Authorization and establishment</heading><content><p style="-uslm-lc:I11" class="indent0">To carry out the purposes of this chapter, the Administrator of the Federal Emergency Management Agency is authorized to establish and carry out a national flood insurance program which will enable interested persons to purchase insurance against loss resulting from physical damage to or loss of real property or personal property related thereto arising from any flood occurring in the United States.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf0148d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/b"><num value="b" class="bold">(b)</num><heading class="bold"> Additional coverage for compliance with land use and control measures</heading><chapeau style="-uslm-lc:I11" class="indent0">The national flood insurance program established pursuant to subsection (a) shall enable the purchase of insurance to cover the cost of implementing measures that are consistent with land use and control measures established by the community under <ref href="/us/usc/t42/s4102">section 4102 of this title</ref> for—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaaf0148e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/b/1"><num value="1">(1)</num><content> properties that are repetitive loss structures;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf0148f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/b/2"><num value="2">(2)</num><content> properties that are substantially damaged structures;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf01490-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/b/3"><num value="3">(3)</num><content> properties that have sustained flood damage on multiple occasions, if the Administrator determines that it is cost-effective and in the best interests of the National Flood Insurance Fund to require the implementation of such measures; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf01491-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/b/4"><num value="4">(4)</num><chapeau> properties for which an offer of mitigation assistance is made under—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaaf01492-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/b/4/A"><num value="A">(A)</num><content> <ref href="/us/usc/t42/s4104c">section 4104c of this title</ref> (Flood Mitigation Assistance Program);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaaf01493-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/b/4/B"><num value="B">(B)</num><content> the Hazard Mitigation Grant Program authorized under <ref href="/us/usc/t42/s5170c">section 5170c of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaaf01494-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/b/4/C"><num value="C">(C)</num><content> the Predisaster Hazard Mitigation Program under <ref href="/us/usc/t42/s5133">section 5133 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaaf01495-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/b/4/D"><num value="D">(D)</num><content> any programs authorized or for which funds are appropriated to address any unmet needs or for which supplemental funds are made available.</content>
</subparagraph>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">The Administrator shall impose a surcharge on each insured of not more than $75 per policy to provide cost of compliance coverage in accordance with the provisions of this subsection.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf01496-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/c"><num value="c" class="bold">(c)</num><heading class="bold"> Participation and risk sharing by insurers</heading><chapeau style="-uslm-lc:I11" class="indent0">In carrying out the flood insurance program the Administrator shall, to the maximum extent practicable, encourage and arrange for—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaaf01497-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/c/1"><num value="1">(1)</num><content> appropriate financial participation and risk sharing in the program by insurance companies and other insurers, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf01498-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4011/c/2"><num value="2">(2)</num><content> other appropriate participation, on other than a risk-sharing basis, by insurance companies and other insurers, insurance agents and brokers, and insurance adjustment organizations,</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Report</inline>.—</heading><chapeau>Not later than 6 months after the date of enactment of this Act [<date date="2012-07-06">July 6, 2012</date>], the Administrator shall submit a report to Congress that describes—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the results and conclusions of the review under paragraph (1); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> any actions taken, or proposed actions to be taken, by the Administrator to provide for more precise and technical processes and procedures for determining that a flood event has commenced or is in progress.</content>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Effective Date of Policies Covering Properties Affected by Flooding of the Missouri River in </inline>2011.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Eligible coverage</inline>.—</heading><content>For purposes of this subsection, the term ‘eligible coverage’ means coverage under a new contract for flood insurance coverage under the National Flood Insurance Program, or a modification to coverage under an existing flood insurance contract, for property damaged by the flooding of the Missouri River that commenced on <date date="2011-06-01">June 1, 2011</date>, that was purchased or made during the period beginning <date date="2011-05-01">May 1, 2011</date>, and ending <date date="2011-06-06">June 6, 2011</date>.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Effective dates</inline>.—</heading><chapeau>Notwithstanding section 1306(c) of the National Flood Insurance Act of 1968 (<ref href="/us/usc/t42/s4013/c">42 U.S.C. 4013(c)</ref>), or any other provision of law, any eligible coverage shall—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> be deemed to take effect on the date that is 30 days after the date on which all obligations for the eligible coverage (including completion of the application and payment of any initial premiums owed) are satisfactorily completed; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> cover damage to property occurring after the effective date described in subparagraph (A) that resulted from the flooding of the Missouri River that commenced on <date date="2011-06-01">June 1, 2011</date>, if the property did not suffer damage or loss as a result of such flooding before the effective date described in subparagraph (A).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Timely Notification</inline>.—</heading><content>Not later than 90 days after the date on which the Administrator submits the report required under subsection (a)(2), the Administrator shall, taking into consideration the results of the review under subsection (a)(1)(B), develop procedures for providing timely notification, to the extent practicable, to policyholders who have purchased flood insurance coverage under the National Flood Insurance Program within 30 days of a determination of a flood in progress and who may be affected by the flood of the determination and how the determination may affect their coverage.”</content>

</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> makes flood insurance available on a nationwide basis that would otherwise not be available, to accelerate recovery from floods, mitigate future losses, save lives, and reduce the personal and national costs of flood disasters;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> the national flood insurance program insures approximately 4,400,000 policyholders;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> approximately 48,000 properties currently insured under the program have experienced, within a 10-year period, 2 or more flood losses where each such loss exceeds the amount $1,000;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> approximately 10,000 of these repetitive-loss properties have experienced either 2 or 3 losses that cumulatively exceed building value or 4 or more losses, each exceeding $1,000;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> repetitive-loss properties constitute a significant drain on the resources of the national flood insurance program, costing about $200,000,000 annually;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> repetitive-loss properties comprise approximately 1 percent of currently insured properties but are expected to account for 25 to 30 percent of claims losses;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> the vast majority of repetitive-loss properties were built before local community implementation of floodplain management standards under the program and thus are eligible for subsidized flood insurance;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="8">“(8)</num><content> while some property owners take advantage of the program allowing subsidized flood insurance without requiring mitigation action, others are trapped in a vicious cycle of suffering flooding, then repairing flood damage, then suffering flooding, without the means to mitigate losses or move out of harm’s way;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="9">“(9)</num><content> mitigation of repetitive-loss properties through buyouts, elevations, relocations, or flood-proofing will produce savings for policyholders under the program and for Federal taxpayers through reduced flood insurance losses and reduced Federal disaster assistance;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="10">“(10)</num><content> a strategy of making mitigation offers aimed at high-priority repetitive-loss properties and shifting more of the burden of recovery costs to property owners who choose to remain vulnerable to repetitive flood damage can encourage property owners to take appropriate actions that reduce loss of life and property damage and benefit the financial soundness of the program;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="11">“(11)</num><content> the method for addressing repetitive-loss properties should be flexible enough to take into consideration legitimate circumstances that may prevent an owner from taking a mitigation action; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="12">“(12)</num><content> focusing the mitigation and buy-out of repetitive loss properties upon communities and property owners that choose to voluntarily participate in a mitigation and buy-out program will maximize the benefits of such a program, while minimizing any adverse impact on communities and property owners.”</content>

<section style="-uslm-lc:I580467"><num value="201">“SEC. 201.</num><heading> DEFINITIONS.</heading><chapeau style="-uslm-lc:I21" class="indent0">“In this title, the following definitions shall apply:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Director</inline>.—</heading><content>The term ‘Director’ means the Administrator of the Federal Emergency Management Agency.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Flood insurance policy</inline>.—</heading><content>The term ‘flood insurance policy’ means a flood insurance policy issued under the National Flood Insurance Act of 1968 (42 U.S.C. [4001] et seq.).</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Program</inline>.—</heading><content>The term ‘Program’ means the National Flood Insurance Program established under the National Flood Insurance Act of 1968 (<ref href="/us/usc/t42/s4001">42 U.S.C. 4001</ref> et seq.).</content>
</paragraph>
</section>
<section style="-uslm-lc:I580467"><num value="202">“SEC. 202.</num><heading> SUPPLEMENTAL FORMS.</heading><subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>Not later than 6 months after the date of enactment of this Act [<date date="2004-06-30">June 30, 2004</date>], the Director shall develop supplemental forms to be issued in conjunction with the issuance of a flood insurance policy that set forth, in simple terms—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the exact coverages being purchased by a policyholder;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> any exclusions from coverage that apply to the coverages purchased;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> an explanation, including illustrations, of how lost items and damages will be valued under the policy at the time of loss;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> the number and dollar value of claims filed under a flood insurance policy over the life of the property, and the effect, under the National Flood Insurance Act of 1968 (<ref href="/us/usc/t42/s4001">42 U.S.C. 4001</ref> et seq.), of the filing of any further claims under a flood insurance policy with respect to that property; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> any other information that the Director determines will be helpful to policyholders in understanding flood insurance coverage.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Distribution</inline>.—</heading><chapeau>The forms developed under subsection (a) shall be given to—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> all holders of a flood insurance policy at the time of purchase and renewal; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> insurance companies and agents that are authorized to sell flood insurance policies.</content>
</paragraph>
</subsection>
</section>
<section style="-uslm-lc:I580467"><num value="203">“SEC. 203.</num><heading> ACKNOWLEDGEMENT FORM.</heading><subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>Not later than 6 months after the date of enactment of this Act [<date date="2004-06-30">June 30, 2004</date>], the Director shall develop an acknowledgement form to be signed by the purchaser of a flood insurance policy that contains—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> an acknowledgement that the purchaser has received a copy of the standard flood insurance policy, and any forms developed under section 202; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> an acknowledgement that the purchaser has been told that the contents of a property or dwelling are not covered under the terms of the standard flood insurance policy, and that the policyholder has the option to purchase additional coverage for such contents.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Distribution</inline>.—</heading><content>Copies of an acknowledgement form executed under subsection (a) shall be made available to the purchaser and the Director.</content>
</subsection>
</section>
<section style="-uslm-lc:I580467"><num value="204">“SEC. 204.</num><heading> FLOOD INSURANCE CLAIMS HANDBOOK.</heading><subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>Not later than 6 months after the date of enactment of this Act [<date date="2004-06-30">June 30, 2004</date>], the Director shall develop a flood insurance claims handbook that contains—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> a description of the procedures to be followed to file a claim under the Program, including how to pursue a claim to completion;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> how to file supplementary claims, proof of loss, and any other information relating to the filing of claims under the Program; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> detailed information regarding the appeals process established under section 205.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Distribution</inline>.—</heading><chapeau>The handbook developed under subsection (a) shall be made available to—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> each insurance company and agent authorized to sell flood insurance policies; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> each purchaser, at the time of purchase and renewal, of a flood insurance policy, and at the time of any flood loss sustained by such purchaser.</content>
</paragraph>
</subsection>
</section>
<section style="-uslm-lc:I580467"><num value="205">“SEC. 205.</num><heading> APPEAL OF DECISIONS RELATING TO FLOOD INSURANCE COVERAGE.</heading><chapeau style="-uslm-lc:I21" class="indent0">“Not later than 6 months after the date of enactment of this Act [<date date="2004-06-30">June 30, 2004</date>], the Director shall, by regulation, establish an appeals process through which holders of a flood insurance policy may appeal the decisions, with respect to claims, proofs of loss, and loss estimates relating to such flood insurance policy, of—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> any insurance agent or adjuster, or insurance company; or</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> any employee or contractor of the Federal Emergency Management Agency.</content>
</paragraph>
</section>
<section style="-uslm-lc:I580467"><num value="206">“SEC. 206.</num><heading> STUDY AND REPORT ON USE OF COST COMPLIANCE COVERAGE.</heading><chapeau style="-uslm-lc:I21" class="indent0">“Not later than 1 year after the date of enactment of this Act [<date date="2004-06-30">June 30, 2004</date>], the Administrator of the Federal Emergency Management Agency shall submit to Congress a report that sets forth—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the use of cost of compliance coverage under section 1304(b) of the National Flood Insurance Act of 1968 (<ref href="/us/usc/t42/s4011/b">42 U.S.C. 4011(b)</ref>) in connection with flood insurance policies;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> any barriers to policyholders using the funds provided by cost of compliance coverage under that section 1304(b) under a flood insurance policy, and recommendations to address those barriers; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the steps that the Federal Emergency Management Agency has taken to ensure that funds paid for cost of compliance coverage under that section 1304(b) are being used to lessen the burdens on all homeowners and the Program.</content>
</paragraph>
</section>
<section style="-uslm-lc:I580467"><num value="207">“SEC. 207.</num><heading> MINIMUM TRAINING AND EDUCATION REQUIREMENTS.</heading><chapeau style="-uslm-lc:I21" class="indent0">“The Administrator of the Federal Emergency Management Agency shall, in cooperation with the insurance industry, State insurance regulators, and other interested parties—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> establish minimum training and education requirements for all insurance agents who sell flood insurance policies; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> not later than 6 months after the date of enactment of this Act [<date date="2004-06-30">June 30, 2004</date>], publish these requirements in the Federal Register, and inform insurance companies and agents of the requirements.</content>
</paragraph>
</section>
<section style="-uslm-lc:I580467"><num value="208">“SEC. 208.</num><heading> GAO STUDY AND REPORT.</heading><subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Study</inline>.—</heading><chapeau>The Comptroller General of the United States shall conduct a study of—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the adequacy of the scope of coverage provided under flood insurance policies in meeting the intended goal of Congress that flood victims be restored to their pre-flood conditions, and any recommendations to ensure that goal is being met;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> the adequacy of payments to flood victims under flood insurance policies; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the practices of the Federal Emergency Management Agency and insurance adjusters in estimating losses incurred during a flood, and how such practices affect the adequacy of payments to flood victims.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Report</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act [<date date="2004-06-30">June 30, 2004</date>], the Comptroller General shall submit to Congress a report regarding the results of the study under subsection (a).</content>
</subsection>

<section style="-uslm-lc:I580467"><num value="209">“SEC. 209.</num><heading> PROSPECTIVE PAYMENT OF FLOOD INSURANCE PREMIUMS.</heading><note topic="miscellaneous" style="-uslm-lc:I21" id="idaaf0d7f3-09a0-11eb-a85b-f5cef3d06f4d">
<p class="indent0">[Amended <ref href="/us/usc/t42/s4015">section 4015 of this title</ref>.]</p></note>
</section>
<section style="-uslm-lc:I580467"><num value="210">“SEC. 210.</num><heading> REPORT ON CHANGES TO FEE SCHEDULE OR FEE PAYMENT ARRANGEMENTS.</heading><chapeau style="-uslm-lc:I21" class="indent0">“Not later than 3 months after the date of enactment of this Act [<date date="2004-06-30">June 30, 2004</date>], the Director shall submit a report on any changes or modifications made to the fee schedule or fee payment arrangements between the Federal Emergency Management Agency and insurance adjusters who provide services with respect to flood insurance policies to—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the Committee on Banking, Housing, and Urban Affairs of the Senate; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> the Committee on Financial Services of the House of Representatives.”</content>

L. 103–325</ref> provided that:<quotedContent origin="/us/pl/103/325/s561">
<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Establishment</inline>.—</heading><content>There is hereby established an interagency task force to be known as the Flood Insurance Task Force (in this section referred to as the ‘Task Force’).</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Membership.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Task Force shall be composed of 10 members, who shall be the designees of—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the Federal Insurance Administrator;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> the Federal Housing Commissioner;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> the Secretary of Veterans Affairs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> the Administrator of the Farmers Home Administration;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="E">“(E)</num><content> the Administrator of the Small Business Administration;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="F">“(F)</num><content> the Chairman of the Board of Directors of the Farm Credit Administration;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="G">“(G)</num><content> a designee of the Financial Institutions Examination Council;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="H">“(H)</num><content> the Director of the Office of Federal Housing Enterprise Oversight;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="I">“(I)</num><content> the chairman of the Board of Directors of the Federal Home Loan Mortgage Corporation; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="J">“(J)</num><content> the chairman of the Board of Directors of the Federal National Mortgage Association.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Qualifications</inline>.—</heading><content>Members of the Task Force shall be designated for membership on the Task Force by reason of demonstrated knowledge and competence regarding the national flood insurance program.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Duties</inline>.—</heading><chapeau>The Task Force shall carry out the following duties:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Recommendations of standardized enforcement procedures</inline>.—</heading><content>Make recommendations to the head of each Federal agency and enterprise referred to under subsection (b)(1) regarding establishment or adoption of standardized enforcement procedures among such agencies and corporations responsible for enforcing compliance with the requirements under the national flood insurance program to ensure fullest possible compliance with such requirements.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Study of compliance assistance</inline>.—</heading><content>Conduct a study of the extent to which Federal agencies and the secondary mortgage market can provide assistance in ensuring compliance with the requirements under the national flood insurance program and submit to the Congress a report describing the study and any conclusions.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Study of compliance model</inline>.—</heading><content>Conduct a study of the extent to which existing programs of Federal agencies and corporations for compliance with the requirements under the national flood insurance program can serve as a model for other Federal agencies responsible for enforcing compliance, and submit to the Congress a report describing the study and any conclusions.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">Recommendations for enforcement and compliance procedures</inline>.—</heading><content>Develop recommendations regarding enforcement and compliance procedures, based on the studies and findings of the Task Force, and publish such recommendations.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><heading> <inline class="small-caps">Study of determination fees</inline>.—</heading><chapeau>Conduct a study of—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the reasonableness of fees charged pursuant to 102(h) of the Flood Disaster Protection Act of 1973 [<ref href="/us/usc/t42/s4012a/h">42 U.S.C. 4012a(h)</ref>] for costs of determining whether the property securing a loan is located in an area having special flood hazards; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> whether the fees charged pursuant to such section by lenders and servicers are greater than the amounts paid by such lenders and servicers to persons actually conducting such determinations and the extent to which the fees exceed such amounts.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Noncompensation</inline>.—</heading><content>Members of the Task Force shall receive no additional pay by reason of their service on the Task Force.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Chairperson</inline>.—</heading><content>The members of the Task Force shall elect one member as chairperson of the Task Force.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Meetings and Action</inline>.—</heading><content>The Task Force shall meet at the call of the chairman or a majority of the members of the Task Force and may take action by a vote of the majority of the members. The Federal Insurance Administrator shall coordinate and call the initial meeting of the Task Force.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="g">“(g)</num><heading> <inline class="small-caps">Officers</inline>.—</heading><content>The chairperson of the Task Force may appoint any officers to carry out the duties of the Task Force under subsection (c).</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="h">“(h)</num><heading> <inline class="small-caps">Staff of Federal Agencies</inline>.—</heading><content>Upon request of the chairperson of the Task Force, the head of any of the Federal agencies and entities referred to under subsection (b)(1) may detail, on a nonreimbursable basis, any of the personnel of such agency to the Task Force to assist the Task Force in carrying out its duties under this section.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="i">“(i)</num><heading> <inline class="small-caps">Powers</inline>.—</heading><content>In carrying out this section, the Task Force may hold hearings, sit and act at times and places, take testimony, receive evidence and assistance, provide information, and conduct research as the Task Force considers appropriate.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="j">“(j)</num><heading> <inline class="small-caps">Termination</inline>.—</heading><content>The Task Force shall terminate upon the expiration of the 24-month period beginning upon the designation of the last member to be designated under subsection (b)(1).”</content>
