<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaaf2d44e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013"><num value="4013">§ 4013.</num><heading> Nature and limitation of insurance coverage</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf2d44f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/a"><num value="a" class="bold">(a)</num><heading class="bold"> Regulations respecting general terms and conditions of insurability</heading><chapeau style="-uslm-lc:I11" class="indent0">The Administrator shall from time to time, after consultation with the advisory committee authorized under <ref href="/us/usc/t42/s4025">section 4025 of this title</ref>, appropriate representatives of the pool formed or otherwise created under <ref href="/us/usc/t42/s4051">section 4051 of this title</ref>, and appropriate representatives of the insurance authorities of the respective States, provide by regulation for general terms and conditions of insurability which shall be applicable to properties eligible for flood insurance coverage under <ref href="/us/usc/t42/s4012">section 4012 of this title</ref>, including—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaaf2d450-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/a/1"><num value="1">(1)</num><content> the types, classes, and locations of any such properties which shall be eligible for flood insurance;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf2d451-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/a/2"><num value="2">(2)</num><content> the nature and limits of loss or damage in any areas (or subdivisions thereof) which may be covered by such insurance;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf2d452-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/a/3"><num value="3">(3)</num><content> the classification, limitation, and rejection of any risks which may be advisable;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf2d453-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/a/4"><num value="4">(4)</num><content> appropriate minimum premiums;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf2d454-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/a/5"><num value="5">(5)</num><content> appropriate loss-deductibles; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf2d455-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/a/6"><num value="6">(6)</num><content> any other terms and conditions relating to insurance coverage or exclusion which may be necessary to carry out the purposes of this chapter.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf2d456-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b"><num value="b" class="bold">(b)</num><heading class="bold"> Regulations respecting amount of coverage</heading><chapeau style="-uslm-lc:I11" class="indent0">In addition to any other terms and conditions under subsection (a), such regulations shall provide that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaaf2d457-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/1"><num value="1">(1)</num><chapeau> any flood insurance coverage based on chargeable premium rates under <ref href="/us/usc/t42/s4015">section 4015 of this title</ref> which are less than the estimated premium rates under <ref href="/us/usc/t42/s4014/a/1">section 4014(a)(1) of this title</ref> shall not exceed—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaaf2d458-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/1/A"><num value="A">(A)</num><chapeau> in the case of residential properties—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaaf2d459-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/1/A/i"><num value="i">(i)</num><content> $35,000 aggregate liability for any single-family dwelling, and $100,000 for any residential structure containing more than one dwelling unit,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaaf2d45a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/1/A/ii"><num value="ii">(ii)</num><content> $10,000 aggregate liability per dwelling unit for any contents related to such unit, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaaf2d45b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/1/A/iii"><num value="iii">(iii)</num><content> in the States of Alaska and Hawaii, and in the Virgin Islands and Guam; the limits provided in clause (i) of this sentence shall be: $50,000 aggregate liability for any single-family dwelling, and $150,000 for any residential structure containing more than one dwelling unit;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaaf2d45c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/1/B"><num value="B">(B)</num><content> in the case of business properties which are owned or leased and operated by small business concerns, an aggregate liability with respect to any single structure, including any contents thereof related to premises of small business occupants (as that term is defined by the Administrator), which shall be equal to (i) $100,000 plus (ii) $100,000 multiplied by the number of such occupants and shall be allocated among such occupants (or among the occupant or occupants and the owner) under regulations prescribed by the Administrator; except that the aggregate liability for the structure itself may in no case exceed $100,000; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaaf2d45d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/1/C"><num value="C">(C)</num><chapeau> in the case of church properties and any other properties which may become eligible for flood insurance under <ref href="/us/usc/t42/s4012">section 4012 of this title</ref>—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaaf2d45e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/1/C/i"><num value="i">(i)</num><content> $100,000 aggregate liability for any single structure, and</content>

<clause style="-uslm-lc:I14" class="indent3" id="idaaf2d45f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/1/C/ii"><num value="ii">(ii)</num><content> $100,000 aggregate liability per unit for any contents related to such unit; and</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf2d460-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/2"><num value="2">(2)</num><content> in the case of any residential building designed for the occupancy of from 1 to 4 families for which the risk premium rate is determined in accordance with the provisions of <ref href="/us/usc/t42/s4014/a/1">section 4014(a)(1) of this title</ref>, additional flood insurance in excess of the limits specified in clause (i) of subparagraph (A) of paragraph (1) shall be made available, with respect to any single such building, up to an aggregate liability (including such limits specified in paragraph (1)(A)(i)) of $250,000;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf2fb71-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/3"><num value="3">(3)</num><content> in the case of any residential property for which the risk premium rate is determined in accordance with the provisions of <ref href="/us/usc/t42/s4014/a/1">section 4014(a)(1) of this title</ref>, additional flood insurance in excess of the limits specified in clause (ii) of subparagraph (A) of paragraph (1) shall be made available to every insured upon renewal and every applicant for insurance so as to enable any such insured or applicant to receive coverage up to a total amount (including such limits specified in paragraph (1)(A)(ii)) of $100,000;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf2fb72-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/4"><num value="4">(4)</num><content> in the case of any nonresidential building, including a church, for which the risk premium rate is determined in accordance with the provisions of <ref href="/us/usc/t42/s4014/a/1">section 4014(a)(1) of this title</ref>, additional flood insurance in excess of the limits specified in subparagraphs (B) and (C) of paragraph (1) shall be made available with respect to any single such building, up to an aggregate liability (including such limits specified in subparagraph (B) or (C) of paragraph (1), as applicable) of $500,000, and coverage shall be made available up to a total of $500,000 aggregate liability for contents owned by the building owner and $500,000 aggregate liability for each unit within the building for contents owned by the tenant; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf2fb73-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/b/5"><num value="5">(5)</num><content> any flood insurance coverage which may be made available in excess of the limits specified in subparagraph (A), (B), or (C) of paragraph (1), shall be based only on chargeable premium rates under <ref href="/us/usc/t42/s4015">section 4015 of this title</ref>, which are not less than the estimated premium rates under <ref href="/us/usc/t42/s4014/a/1">section 4014(a)(1) of this title</ref>, and the amount of such excess coverage shall not in any case exceed an amount equal to the applicable limit so specified (or allocated) under paragraph (1)(C), (2), (3), or (4), as applicable.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf2fb74-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/c"><num value="c" class="bold">(c)</num><heading class="bold"> Effective date of policies</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaaf2fb75-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Waiting period</heading><content><p style="-uslm-lc:I12" class="indent1">Except as provided in paragraph (2), coverage under a new contract for flood insurance coverage under this chapter entered into after <date date="1994-09-23">September 23, 1994</date>, and any modification to coverage under an existing flood insurance contract made after <date date="1994-09-23">September 23, 1994</date>, shall become effective upon the expiration of the 30-day period beginning on the date that all obligations for such coverage (including completion of the application and payment of any initial premiums owed) are satisfactorily completed.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaaf2fb76-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Exception</heading><chapeau style="-uslm-lc:I12" class="indent1">The provisions of paragraph (1) shall not apply to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaaf2fb77-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/c/2/A"><num value="A">(A)</num><content> the initial purchase of flood insurance coverage under this chapter when the purchase of insurance is in connection with the making, increasing, extension, or renewal of a loan;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaaf2fb78-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/c/2/B"><num value="B">(B)</num><content> the initial purchase of flood insurance coverage pursuant to a revision or updating of floodplain areas or flood-risk zones under <ref href="/us/usc/t42/s4101/f">section 4101(f) of this title</ref>, if such purchase occurs during the 1-year period beginning upon publication of notice of the revision or updating under <ref href="/us/usc/t42/s4101/h">section 4101(h) of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaaf2fb79-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/c/2/C"><num value="C">(C)</num><chapeau> the initial purchase of flood insurance coverage for private property if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaaf2fb7a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/c/2/C/i"><num value="i">(i)</num><content> the Administrator determines that the property is affected by flooding on Federal land that is a result of, or is exacerbated by, post-wildfire conditions, after consultation with an authorized employee of the Federal agency that has jurisdiction of the land on which the wildfire that caused the post-wildfire conditions occurred; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaaf2fb7b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/c/2/C/ii"><num value="ii">(ii)</num><content> the flood insurance coverage was purchased not later than 60 days after the fire containment date, as determined by the appropriate Federal employee, relating to the wildfire that caused the post-wildfire conditions described in clause (i).</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf2fb7c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/d"><num value="d" class="bold">(d)</num><heading class="bold"> Optional high-deductible policies for residential properties</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaaf2fb7d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Availability</heading><content><p style="-uslm-lc:I12" class="indent1">In the case of residential properties, the Administrator shall make flood insurance coverage available, at the option of the insured, that provides for a loss-deductible for damage to the covered property in various amounts, up to and including $10,000.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaaf3228e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Disclosure</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaaf3228f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/d/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Form</heading><content><p style="-uslm-lc:I13" class="indent2">The Administrator shall provide the information described in subparagraph (B) clearly and conspicuously on the application form for flood insurance coverage or on a separate form, segregated from all unrelated information and other required disclosures.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaaf32290-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/d/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Information</heading><chapeau style="-uslm-lc:I13" class="indent2">The information described in this subparagraph is—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaaf32291-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/d/2/B/i"><num value="i">(i)</num><content> information sufficient to inform the applicant of the availability of the coverage option required by paragraph (1) to applicants for flood insurance coverage; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaaf32292-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4013/d/2/B/ii"><num value="ii">(ii)</num><content> a statement explaining the effect of a loss-deductible and that, in the event of an insured loss, the insured is responsible out-of-pocket for losses to the extent of the deductible selected.</content>
