terms and conditions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">On the basis of estimates made under <ref href=\"/us/usc/t42/s4014\">section 4014 of this title</ref>, and such other information as may be necessary, the Administrator shall from time to time prescribe, after providing notice—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4cf90-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/a/1\"><num value=\"1\">(1)</num><content> chargeable premium rates for any types and classes of properties for which insurance coverage shall be available under <ref href=\"/us/usc/t42/s4012\">section 4012 of this title</ref> (at less than the estimated risk premium rates under <ref href=\"/us/usc/t42/s4014/a/1\">section 4014(a)(1) of this title</ref>, where necessary), and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4cf91-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/a/2\"><num value=\"2\">(2)</num><content> the terms and conditions under which, and the areas (including subdivisions thereof) within which, such rates shall apply.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf4cf92-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Considerations for rates</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Such rates shall, insofar as practicable, be—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4cf93-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/b/1\"><num value=\"1\">(1)</num><content> based on a consideration of the respective risks involved, including differences in risks due to land use measures, flood-proofing, flood forecasting, and similar measures;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4cf94-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/b/2\"><num value=\"2\">(2)</num><content> adequate, on the basis of accepted actuarial principles, to provide reserves for anticipated losses, or, if less than such amount, consistent with the objective of making flood insurance available where necessary at reasonable rates so as to encourage prospective insureds to purchase such insurance and with the purposes of this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4cf95-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/b/3\"><num value=\"3\">(3)</num><content> adequate, together with the fee under paragraph (1)(B)(iii) or (2) of <ref href=\"/us/usc/t42/s4014/a\">section 4014(a) of this title</ref>, to provide for any administrative expenses of the flood insurance and floodplain management programs (including the costs of mapping activities under <ref href=\"/us/usc/t42/s4101\">section 4101 of this title</ref>);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4cf96-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/b/4\"><num value=\"4\">(4)</num><content> stated so as to reflect the basis for such rates, including the differences (if any) between the estimated risk premium rates under <ref href=\"/us/usc/t42/s4014/a/1\">section 4014(a)(1) of this title</ref> and the estimated rates under <ref href=\"/us/usc/t42/s4014/a/2\">section 4014(a)(2) of this title</ref>; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4cf97-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/b/5\"><num value=\"5\">(5)</num><content> adequate, on the basis of accepted actuarial principles, to cover the average historical loss year obligations incurred by the National Flood Insurance Fund.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf4cf98-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Actuarial rate properties</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Subject only to the limitations provided under paragraphs (1) and (2), the chargeable rate shall not be less than the applicable estimated risk premium rate for such area (or subdivision thereof) under <ref href=\"/us/usc/t42/s4014/a/1\">section 4014(a)(1) of this title</ref> with respect to the following properties:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaaf4cf99-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Post-firm properties</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any property the construction or substantial improvement of which the Administrator determines has been started after <date date=\"1974-12-31\">December 31, 1974</date>, or started after the effective date of the initial rate map published by the Administrator under paragraph (2) of <ref href=\"/us/usc/t42/s4101\">section 4101 of this title</ref> for the area in which such property is located, whichever is later, except that the chargeable rate for properties under this paragraph shall be subject to the limitation under subsection (e).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaaf4cf9a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Certain leased coastal and river properties</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any property leased from the Federal Government (including residential and nonresidential properties) that the Administrator determines is located on the river-facing side of any dike, levee, or other riverine flood control structure, or seaward of any seawall or other coastal flood control structure.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf4cf9b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Payment of certain sums to Administrator; deposits in Fund</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">With respect to any chargeable premium rate prescribed under this section, a sum equal to the portion of the rate that covers any administrative expenses of carrying out the flood insurance and floodplain management programs which have been estimated under paragraphs (1)(B)(ii) and (1)(B)(iii) of <ref href=\"/us/usc/t42/s4014/a\">section 4014(a) of this title</ref> or paragraph (2) of such section (including the fees under such paragraphs), shall be paid to the Administrator. The Administrator shall deposit the sum in the National Flood Insurance Fund established under <ref href=\"/us/usc/t42/s4017\">section 4017 of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf4f6ac-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Annual limitation on premium increases</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Except with respect to properties described under paragraph (2) of subsection (c), and notwithstanding any other provision of this chapter—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4f6ad-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e/1\"><num value=\"1\">(1)</num><chapeau> the chargeable risk premium rate for flood insurance under this chapter for any property may not be increased by more than 18 percent each year, except—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaaf4f6ae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e/1/A\"><num value=\"A\">(A)</num><content> as provided in paragraph (4);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaaf4f6af-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e/1/B\"><num value=\"B\">(B)</num><content> in the case of property identified under <ref href=\"/us/usc/t42/s4014/g\">section 4014(g) of this title</ref>; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaaf4f6b0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e/1/C\"><num value=\"C\">(C)</num><chapeau> in the case of a property that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaaf4f6b1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e/1/C/i\"><num value=\"i\">(i)</num><content> is located in a community that has experienced a rating downgrade under the community rating system program carried out under <ref href=\"/us/usc/t42/s4022/b\">section 4022(b) of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaaf4f6b2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e/1/C/ii\"><num value=\"ii\">(ii)</num><chapeau> is covered by a policy with respect to which the policyholder has—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaaf4f6b3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e/1/C/ii/I\"><num value=\"I\">(I)</num><content> decreased the amount of the deductible; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaaf4f6b4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e/1/C/ii/II\"><num value=\"II\">(II)</num><content> increased the amount of coverage; or</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaaf4f6b5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e/1/C/iii\"><num value=\"iii\">(iii)</num><content> was misrated;</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4f6b6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e/2\"><num value=\"2\">(2)</num><content> the chargeable risk premium rates for flood insurance under this chapter for any properties initially rated under <ref href=\"/us/usc/t42/s4014/a/2\">section 4014(a)(2) of this title</ref> within any single risk classification, excluding properties for which the chargeable risk premium rate is not less than the applicable estimated risk premium rate under <ref href=\"/us/usc/t42/s4014/a/1\">section 4014(a)(1) of this title</ref>, shall be increased by an amount that results in an average of such rate increases for properties within the risk classification during any 12-month period of not less than 5 percent of the average of the risk premium rates for such properties within the risk classification upon the commencement of such 12-month period;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4f6b7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e/3\"><num value=\"3\">(3)</num><content> the chargeable risk premium rates for flood insurance under this chapter for any properties within any single risk classification may not be increased by an amount that would result in the average of such rate increases for properties within the risk classification during any 12-month period exceeding 15 percent of the average of the risk premium rates for properties within the risk classification upon the commencement of such 12-month period; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4f6b8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/e/4\"><num value=\"4\">(4)</num><content> the chargeable risk premium rates for flood insurance under this chapter for any properties described in subparagraphs (A) through (E) of <ref href=\"/us/usc/t42/s4014/a/2\">section 4014(a)(2) of this title</ref> shall be increased by 25 percent each year, until the average risk premium rate for such properties is equal to the average of the risk premium rates for properties described under paragraph (3).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf4f6b9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Adjustment of premium</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding any other provision of law, if the Administrator determines that the holder of a flood insurance policy issued under this chapter is paying a lower premium than is required under this section due to an error in the flood plain determination, the Administrator may only prospectively charge the higher premium rate.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf4f6ba-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Frequency of premium collection</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">With respect to any chargeable premium rate prescribed under this section, the Administrator shall provide policyholders that are not required to escrow their premiums and fees for flood insurance as set forth under <ref href=\"/us/usc/t42/s4012a\">section 4012a of this title</ref> with the option of paying their premiums annually or monthly.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf4f6bb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Rule of construction</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section, the calculation of an “average historical loss year”—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4f6bc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/h/1\"><num value=\"1\">(1)</num><content> includes catastrophic loss years; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf4f6bd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/h/2\"><num value=\"2\">(2)</num><content> shall be computed in accordance with generally accepted actuarial principles.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf51dce-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Rates for properties newly mapped into areas with special flood hazards</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding subsection (f), the premium rate for flood insurance under this chapter that is purchased on or after <date date=\"2014-03-21\">March 21, 2014</date>—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf51dcf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/i/1\"><num value=\"1\">(1)</num><content> on a property located in an area not previously designated as having special flood hazards and that, pursuant to any issuance, revision, updating, or other change in a flood insurance map, becomes designated as such an area; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf51dd0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/i/2\"><num value=\"2\">(2)</num><content> where such flood insurance premium rate is calculated under subsection (a)(1) of <ref href=\"/us/usc/t42/s4014\">section 4014 of this title</ref>,</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">shall for the first policy year be the preferred risk premium for the property and upon renewal shall be calculated in accordance with subsection (e) of this section until the rate reaches the rate calculated under subsection (a)(1) of <ref href=\"/us/usc/t42/s4014\">section 4014 of this title</ref>.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf51dd1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Premiums and reports</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In setting premium risk rates, in addition to striving to achieve the objectives of this chapter the Administrator shall also strive to minimize the number of policies with annual premiums that exceed one percent of the total coverage provided by the policy. For any policies premiums that exceed this one percent threshold, the Administrator shall report such exceptions to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf51dd2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/k\"><num value=\"k\" class=\"bold\">(k)</num><heading class=\"bold\"> Consideration of mitigation methods</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In calculating the risk premium rate charged for flood insurance for a property under this section, the Administrator shall take into account the implementation of any mitigation method identified by the Administrator in the guidance issued under <ref href=\"/us/usc/t42/s4102/d\">section 4102(d) of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf51dd3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/l\"><num value=\"l\" class=\"bold\">(l)</num><heading class=\"bold\"> Clear communications</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Administrator shall clearly communicate full flood risk determinations to individual property owners regardless of whether their premium rates are full actuarial rates.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf51dd4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/m\"><num value=\"m\" class=\"bold\">(m)</num><heading class=\"bold\"> Protection of small businesses, non-profits, houses of worship, and residences</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaaf51dd5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/m/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Report</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 18 months after <date date=\"2014-03-21\">March 21, 2014</date>,<ref class=\"footnoteRef\" idref=\"fn003268\">1</ref><note type=\"footnote\" id=\"fn003268\"><num>1</num> See References in Text note below.</note> and semiannually thereafter, the Administrator shall monitor and report to Committee on Financial Services of the House Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate, the Administrator’s assessment of the impact, if any, of the rate increases required under subparagraphs (A) and (D) of <ref href=\"/us/usc/t42/s4014/a/2\">section 4014(a)(2) of this title</ref> and the surcharges required under <ref href=\"/us/usc/t42/s4015a\">section 4015a of this title</ref> on the affordability of flood insurance for—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaaf51dd6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/m/1/A\"><num value=\"A\">(A)</num><content> small businesses with less than 100 employees;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaaf51dd7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/m/1/B\"><num value=\"B\">(B)</num><content> non-profit entities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaaf51dd8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4015/m/1/C\"><num value=\"C\">(C)</num><content> houses of worship;
