<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaaf6568a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017"><num value="4017">§ 4017.</num><heading> National Flood Insurance Fund</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf6568b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment; availability</heading><chapeau style="-uslm-lc:I11" class="indent0">To carry out the flood insurance program authorized by this chapter, the Administrator shall establish in the Treasury of the United States a National Flood Insurance Fund (hereinafter referred to as the “fund”) which shall be an account separate from any other accounts or funds available to the Administrator and shall be available as described in subsection (f), without fiscal year limitation (except as otherwise provided in this section)—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaaf6568c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/a/1"><num value="1">(1)</num><content> for making such payments as may, from time to time, be required under <ref href="/us/usc/t42/s4054">section 4054 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf6568d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/a/2"><num value="2">(2)</num><content> to pay reinsurance claims under the excess loss reinsurance coverage provided under <ref href="/us/usc/t42/s4055">section 4055 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf6568e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/a/3"><num value="3">(3)</num><content> to repay to the Secretary of the Treasury such sums as may be borrowed from him (together with interest) in accordance with the authority provided in <ref href="/us/usc/t42/s4016">section 4016 of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf6568f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/a/4"><num value="4">(4)</num><content> to the extent approved in appropriations Acts, to pay any administrative expenses of the flood insurance and floodplain management programs (including the costs of mapping activities under <ref href="/us/usc/t42/s4101">section 4101 of this title</ref>);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf65690-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/a/5"><num value="5">(5)</num><content> for the purposes specified in subsection (d) under the conditions provided therein;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf65691-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/a/6"><num value="6">(6)</num><content> for carrying out the program under <ref href="/us/usc/t42/s4022/b">section 4022(b) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf65692-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/a/7"><num value="7">(7)</num><content> for transfers to the National Flood Mitigation Fund, but only to the extent provided in <ref href="/us/usc/t42/s4104d/b/1">section 4104d(b)(1) of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf65693-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/a/8"><num value="8">(8)</num><content> for carrying out <ref href="/us/usc/t42/s4104/f">section 4104(f) of this title</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf65694-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/b"><num value="b" class="bold">(b)</num><heading class="bold"> Credits to Fund</heading><chapeau style="-uslm-lc:I11" class="indent0">The fund shall be credited with—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaaf65695-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/b/1"><num value="1">(1)</num><content> such funds borrowed in accordance with the authority provided in <ref href="/us/usc/t42/s4016">section 4016 of this title</ref> as may from time to time be deposited in the fund;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf65696-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/b/2"><num value="2">(2)</num><content> premiums, fees, or other charges which may be paid or collected in connection with the excess loss reinsurance coverage provided under <ref href="/us/usc/t42/s4055">section 4055 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf65697-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/b/3"><num value="3">(3)</num><content> such amounts as may be advanced to the fund from appropriations in order to maintain the fund in an operative condition adequate to meet its liabilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf65698-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/b/4"><num value="4">(4)</num><content> interest which may be earned on investments of the fund pursuant to subsection (c);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf65699-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/b/5"><num value="5">(5)</num><content> such sums as are required to be paid to the Administrator under <ref href="/us/usc/t42/s4015/d">section 4015(d) of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf6569a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/b/6"><num value="6">(6)</num><content> receipts from any other operations under this chapter (including premiums under the conditions specified in subsection (d), and salvage proceeds, if any, resulting from reinsurance coverage).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf67dab-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/c"><num value="c" class="bold">(c)</num><heading class="bold"> Investment of moneys in obligations issued or guaranteed by United States</heading><chapeau style="-uslm-lc:I11" class="indent0">If, after—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaaf67dac-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/c/1"><num value="1">(1)</num><content> all outstanding obligations of the fund have been liquidated, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf67dad-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/c/2"><num value="2">(2)</num><content> any outstanding amounts which may have been advanced to the fund from appropriations authorized under <ref href="/us/usc/t42/s4127/a/2/B">section 4127(a)(2)(B) of this title</ref> have been credited to the appropriation from which advanced, with interest accrued at the rate prescribed under <ref href="/us/usc/t42/s2414/e">section 2414(e) of this title</ref>, as in effect immediately prior to <date date="1968-08-01">August 1, 1968</date>,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">the Administrator determines that the moneys of the fund are in excess of current needs, he may request the investment of such amounts as he deems advisable by the Secretary of the Treasury in obligations issued or guaranteed by the United States.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf67dae-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/d"><num value="d" class="bold">(d)</num><heading class="bold"> Availability of Fund if operation of program is carried out through facilities of Federal Government</heading><chapeau style="-uslm-lc:I11" class="indent0">In the event the Administrator makes a determination in accordance with the provisions of <ref href="/us/usc/t42/s4071">section 4071 of this title</ref> that operation of the flood insurance program, in whole or in part, should be carried out through the facilities of the Federal Government, the fund shall be available for all purposes incident thereto, including—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaaf67daf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/d/1"><num value="1">(1)</num><content> cost incurred in the adjustment and payment of any claims for losses, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaaf67db0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/d/2"><num value="2">(2)</num><content> payment of applicable operating costs set forth in the schedules prescribed under <ref href="/us/usc/t42/s4018">section 4018 of this title</ref>,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">for so long as the program is so carried out, and in such event any premiums paid shall be deposited by the Administrator to the credit of the fund.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf67db1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/e"><num value="e" class="bold">(e)</num><heading class="bold"> Annual budget</heading><content><p style="-uslm-lc:I11" class="indent0">An annual business-type budget for the fund shall be prepared, transmitted to the Congress, considered, and enacted in the manner prescribed by sections 9103 and 9104 of title 31 for wholly-owned Government corporations.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaaf67db2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4017/f"><num value="f" class="bold">(f)</num><heading class="bold"> Availability of funds dependent on future appropriations acts</heading><content><p style="-uslm-lc:I11" class="indent0">The fund shall be available, with respect to any fiscal year beginning on or after <date date="1981-10-01">October 1, 1981</date>, only to the extent approved in appropriation Acts; except that the fund shall be available for the purpose described in subsection (d)(1) without such approval.</p>
