<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8d732ee1-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4018"><num value="4018">§ 4018.</num><heading> Operating costs and allowances; definitions</heading><subsection style="-uslm-lc:I11" class="indent0" id="id8d732ee2-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4018/a"><num value="a">(a)</num><chapeau> The Administrator shall from time to time negotiate with appropriate representatives of the insurance industry for the purpose of establishing—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8d732ee3-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4018/a/1"><num value="1">(1)</num><content> a current schedule of operating costs applicable both to risk-sharing insurance companies and other insurers and to insurance companies and other insurers, insurance agents and brokers, and insurance adjustment organizations participating on other than a risk-sharing basis, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8d732ee4-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4018/a/2"><num value="2">(2)</num><content> a current schedule of operating allowances applicable to risk-sharing insurance companies and other insurers,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">which may be payable in accordance with the provisions of subchapter II, and such schedules shall from time to time be prescribed in regulations.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id8d732ee5-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4018/b"><num value="b">(b)</num><chapeau> For purposes of subsection (a)—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8d732ee6-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4018/b/1"><num value="1">(1)</num><chapeau> the term “operating costs” shall (without limiting such term) include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8d732ee7-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4018/b/1/A"><num value="A">(A)</num><content> expense reimbursements covering the direct, actual, and necessary expenses incurred in connection with selling and servicing flood insurance coverage;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8d7355f8-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4018/b/1/B"><num value="B">(B)</num><content> reasonable compensation payable for selling and servicing flood insurance coverage, or commissions or service fees paid to producers;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8d7355f9-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4018/b/1/C"><num value="C">(C)</num><content> loss adjustment expenses; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8d7355fa-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4018/b/1/D"><num value="D">(D)</num><content> other direct, actual, and necessary expenses which the Administrator finds are incurred in connection with selling or servicing flood insurance coverage; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8d7355fb-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4018/b/2"><num value="2">(2)</num><content> the term “operating allowances” shall (without limiting such term) include amounts for profit and contingencies which the Administrator finds reasonable and necessary to carry out the purposes of this chapter.</content>
