F, title II, § 100223, July 6, 2012, 126 Stat. 934.)","seq_in_title":3944,"parent_identifier":"/us/usc/t42/ch50/schI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch50","level":"chapter","num":"CHAPTER 50—","heading":"NATIONAL FLOOD INSURANCE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch50/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"THE NATIONAL FLOOD INSURANCE PROGRAM","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idaaf74057-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021\"><num value=\"4021\">§ 4021.</num><heading> Participation in State disaster claims mediation programs</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf74058-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Requirement to participate</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In the case of the occurrence of a major disaster, as defined in <ref href=\"/us/usc/t42/s5122\">section 5122 of this title</ref>, that may have resulted in flood damage covered under the national flood insurance program established under this chapter and other personal lines residential property insurance coverage offered by a State regulated insurer, upon a request made by the insurance commissioner of a State (or such other official responsible for regulating the business of insurance in the State) for the participation of representatives of the Administrator in a program sponsored by such State for nonbinding mediation of insurance claims resulting from a major disaster, the Administrator shall cause representatives of the national flood insurance program to participate in such a State program where claims under the national flood insurance program are involved to expedite settlement of flood damage claims resulting from such disaster.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf76769-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Extent of participation</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In satisfying the requirements of subsection (a), the Administrator shall require that each representative of the Administrator—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf7676a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/b/1\"><num value=\"1\">(1)</num><content> be certified for purposes of the national flood insurance program to settle claims against such program resulting from such disaster in amounts up to the limits of policies under such program;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf7676b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/b/2\"><num value=\"2\">(2)</num><content> attend State-sponsored mediation meetings regarding flood insurance claims resulting from such disaster at such times and places as may be arranged by the State;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf7676c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/b/3\"><num value=\"3\">(3)</num><content> participate in good-faith negotiations toward the settlement of such claims with policyholders of coverage made available under the national flood insurance program; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf7676d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/b/4\"><num value=\"4\">(4)</num><content> finalize the settlement of such claims on behalf of the national flood insurance program with such policyholders.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf7676e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Coordination</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Representatives of the Administrator shall at all times coordinate their activities with insurance officials of the State and representatives of insurers for the purposes of consolidating and expediting settlement of claims under the national flood insurance program resulting from such disaster.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf7676f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Qualifications of mediators</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Each State mediator participating in State-sponsored mediation under this section shall be—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf76770-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/d/1\"><num value=\"1\">(1)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf76771-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/d/1/A\"><num value=\"A\">(A)</num><content> a member in good standing of the State bar in the State in which the mediation is to occur with at least 2 years of practical experience; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf76772-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/d/1/B\"><num value=\"B\">(B)</num><content> an active member of such bar for at least 1 year prior to the year in which such mediator’s participation is sought; or</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf76773-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/d/2\"><num value=\"2\">(2)</num><content> a retired trial judge from any United States jurisdiction who was a member in good standing of the bar in the State in which the judge presided for at least 5 years prior to the year in which such mediator’s participation is sought.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf76774-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Mediation proceedings and documents privileged</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">As a condition of participation, all statements made and documents produced pursuant to State-sponsored mediation involving representatives of the Administrator shall be deemed privileged and confidential settlement negotiations made in anticipation of litigation.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf76775-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Liability, rights, or obligations not affected</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Participation in State-sponsored mediation, as described in this section does not—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf76776-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/f/1\"><num value=\"1\">(1)</num><content> affect or expand the liability of any party in contract or in tort; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf76777-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/f/2\"><num value=\"2\">(2)</num><chapeau> affect the rights or obligations of the parties, as established—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaaf76778-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/f/2/A\"><num value=\"A\">(A)</num><content> in any regulation issued by the Administrator, including any regulation relating to a standard flood insurance policy;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaaf76779-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/f/2/B\"><num value=\"B\">(B)</num><content> under this chapter; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaaf7677a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/f/2/C\"><num value=\"C\">(C)</num><content> under any other provision of Federal law.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf7677b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Exclusive Federal jurisdiction</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Participation in State-sponsored mediation shall not alter, change, or modify the original exclusive jurisdiction of United States courts, as set forth in this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf7677c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Cost limitation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section shall be construed to require the Administrator or a representative of the Administrator to pay additional mediation fees relating to flood insurance claims associated with a State-sponsored mediation program in which such representative of the Administrator participates.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf78e8d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Exception</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In the case of the occurrence of a major disaster that results in flood damage claims under the national flood insurance program and that does not result in any loss covered by a personal lines residential property insurance policy—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf78e8e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/i/1\"><num value=\"1\">(1)</num><content> this section shall not apply; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaf78e8f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/i/2\"><num value=\"2\">(2)</num><content> the provisions of the standard flood insurance policy under the national flood insurance program and the appeals process established under section 205 of the Bunning-Bereuter-Blumenauer Flood Insurance Reform Act of 2004 (<ref href=\"/us/usc/t42/s4011\">42 U.S.C. 4011</ref> note) and the regulations issued pursuant to such section shall apply exclusively.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaaf78e90-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4021/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Representatives of the Administrator</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section, the term “representatives of the Administrator” means representatives of the national flood insurance program who participate in the appeals process established under section 205 of the Bunning-Bereuter-Blumenauer Flood Insurance Reform Act of 2004 (<ref href=\"/us/usc/t42/s4011\">42 U.S.C. 4011</ref> note).</p>\n</content>\n</subsection>\n<sourceCredit id=\"idaaf78e91-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/90/448/tXIII/s1314\">Pub.
