<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8d7726aa-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4055"><num value="4055">§ 4055.</num><heading> Reinsurance coverage</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8d7726ab-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4055/a"><num value="a" class="bold">(a)</num><heading class="bold"> Availability for excess losses</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8d7726ac-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4055/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator is authorized to take such action as may be necessary in order to make available, to the pool formed or otherwise created under <ref href="/us/usc/t42/s4051">section 4051 of this title</ref>, reinsurance for losses (due to claims for proved and approved losses covered by flood insurance) which are in excess of losses assumed by such pool in accordance with the excess loss agreement entered into under subsection (c).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8d7726ad-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4055/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Private reinsurance</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator is authorized to secure reinsurance of coverage provided by the flood insurance program from the private market at rates and on terms determined by the Administrator to be reasonable and appropriate, in an amount sufficient to maintain the ability of the program to pay claims.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8d7726ae-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4055/b"><num value="b" class="bold">(b)</num><heading class="bold"> Availability pursuant to contract, agreement, or other arrangement; payment of premium, fee, or other charge</heading><content><p style="-uslm-lc:I11" class="indent0">Such reinsurance shall be made available pursuant to contract, agreement, or any other arrangement, in consideration of such payment of a premium, fee, or other charge as the Administrator finds necessary to cover anticipated losses and other costs of providing such reinsurance.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8d7726af-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4055/c"><num value="c" class="bold">(c)</num><heading class="bold"> Excess loss agreement; negotiation</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator is authorized to negotiate an excess loss agreement, from time to time, under which the amount of flood insurance retained by the pool, after ceding reinsurance, shall be adequate to further the purposes of this chapter, consistent with the objective of maintaining appropriate financial participation and risk sharing to the maximum extent practicable on the part of participating insurance companies and other insurers.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8d7726b0-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s4055/d"><num value="d" class="bold">(d)</num><heading class="bold"> Submission of excess losses on portfolio basis</heading><content><p style="-uslm-lc:I11" class="indent0">All reinsurance claims for losses in excess of losses assumed by the pool shall be submitted on a portfolio basis by such pool in accordance with terms and conditions established by the Administrator.</p>
