<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaafa9bd3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057"><num value="4057">§ 4057.</num><heading> Alternative loss allocation system for indeterminate claims</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaafa9bd4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafa9bd5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Administrator</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Administrator” means the Administrator of the Federal Emergency Management Agency.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafa9bd6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> COASTAL Formula</heading><content><p style="-uslm-lc:I12" class="indent1">The term “COASTAL Formula” means the formula established under subsection (b).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafa9bd7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Coastal State</heading><content><p style="-uslm-lc:I12" class="indent1">The term “coastal State” has the meaning given the term “coastal state” in <ref href="/us/usc/t16/s1453">section 1453 of title 16</ref>.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafa9bd8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Indeterminate loss</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaafa9bd9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The term “indeterminate loss” means, as determined by an insurance claims adjuster certified under the national flood insurance program and in consultation with an engineer as appropriate, a loss resulting from physical damage to, or loss of, property located in any coastal State arising from the combined perils of flood and wind associated with a named storm.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaafa9bda-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Requirements</heading><chapeau style="-uslm-lc:I13" class="indent2">An insurance claims adjuster certified under the national flood insurance program shall only determine that a loss is an indeterminate loss if the claims adjuster determines that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaafa9bdb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/4/B/i"><num value="i">(i)</num><content> no material remnant of physical buildings or man-made structures remain except building foundations for the specific property for which the claim is made; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaafac2ec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/4/B/ii"><num value="ii">(ii)</num><content> there is insufficient or no tangible evidence created, yielded, or otherwise left behind of the specific property for which the claim is made as a result of the named storm.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafac2ed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Named storm</heading><content><p style="-uslm-lc:I12" class="indent1">The term “named storm” means any organized weather system with a defined surface circulation and maximum winds of not less than 39 miles per hour which the National Hurricane Center of the United States National Weather Service names as a tropical storm or a hurricane.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafac2ee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/6"><num value="6" class="bold">(6)</num><heading class="bold"> Post-storm assessment</heading><content><p style="-uslm-lc:I12" class="indent1">The term “post-storm assessment” means the post-storm assessment developed under <ref href="/us/usc/t33/s3611/b">section 3611(b) of title 33</ref>.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafac2ef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/7"><num value="7" class="bold">(7)</num><heading class="bold"> State</heading><content><p style="-uslm-lc:I12" class="indent1">The term “State” means a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, and any other territory or possession of the United States.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafac2f0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/8"><num value="8" class="bold">(8)</num><heading class="bold"> Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Secretary” means the Secretary of Homeland Security.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafac2f1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/9"><num value="9" class="bold">(9)</num><heading class="bold"> Standard insurance policy</heading><content><p style="-uslm-lc:I12" class="indent1">The term “standard insurance policy” means any insurance policy issued under the national flood insurance program that covers loss or damage to property resulting from water peril.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafac2f2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/10"><num value="10" class="bold">(10)</num><heading class="bold"> Property</heading><content><p style="-uslm-lc:I12" class="indent1">The term “property” means real or personal property that is insured under a standard insurance policy for loss or damage to structure or contents.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafac2f3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/a/11"><num value="11" class="bold">(11)</num><heading class="bold"> Under Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Under Secretary” means the Under Secretary of Commerce for Oceans and Atmosphere, in the Under Secretary’s capacity as Administrator of the National Oceanic and Atmospheric Administration.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaafac2f4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/b"><num value="b" class="bold">(b)</num><heading class="bold"> Establishment of flood loss allocation formula for indeterminate claims</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafac2f5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 180 days after the date on which the protocol is established under <ref href="/us/usc/t33/s3611/c/1">section 3611(c)(1) of title 33</ref>, the Secretary, acting through the Administrator and in consultation with the Under Secretary, shall establish by rule a standard formula to determine and allocate wind losses and flood losses for claims involving indeterminate losses.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafac2f6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Contents</heading><chapeau style="-uslm-lc:I12" class="indent1">The standard formula established under paragraph (1) shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaafac2f7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/b/2/A"><num value="A">(A)</num><content> incorporate data available from the Coastal Wind and Water Event Database established under <ref href="/us/usc/t33/s3611/f">section 3611(f) of title 33</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaafac2f8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/b/2/B"><num value="B">(B)</num><content> use relevant data provided on the National Flood Insurance Program Elevation Certificate for each indeterminate loss for which the formula is used;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaafac2f9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/b/2/C"><num value="C">(C)</num><content> consider any sufficient and credible evidence, approved by the Administrator, of the pre-event condition of a specific property, including the findings of any policyholder or insurance claims adjuster in connection with the indeterminate loss to that specific property;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaafac2fa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/b/2/D"><num value="D">(D)</num><content> include other measures, as the Administrator considers appropriate, required to determine and allocate by mathematical formula the property damage caused by flood or storm surge associated with a named storm; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaafac2fb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/b/2/E"><num value="E">(E)</num><content> subject to paragraph (3), for each indeterminate loss, use the post-storm assessment to allocate water damage (flood or storm surge) associated with a named storm.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafac2fc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Degree of accuracy required</heading><content><p style="-uslm-lc:I12" class="indent1">The standard formula established under paragraph (1) shall specify that the Administrator may only use the post-storm assessment for purposes of the formula if the Under Secretary certifies that the post-storm assessment has a degree of accuracy of not less than 90 percent in connection with the specific indeterminate loss for which the assessment and formula are used.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaafac2fd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c"><num value="c" class="bold">(c)</num><heading class="bold"> Authorized use of post-storm assessment and COASTAL Formula</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafac2fe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Subject to paragraph (3), the Administrator may use the post-storm assessment and the COASTAL Formula to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaafac2ff-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/1/A"><num value="A">(A)</num><content> review flood loss payments for indeterminate losses, including as part of the quality assurance reinspection program of the Federal Emergency Management Agency for claims under the national flood insurance program and any other process approved by the Administrator to review and validate payments under the national flood insurance program for indeterminate losses following a named storm; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaafaea10-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/1/B"><num value="B">(B)</num><chapeau> assist the national flood insurance program to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaafaea11-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/1/B/i"><num value="i">(i)</num><content> properly cover qualified flood loss for claims for indeterminate losses; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaafaea12-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/1/B/ii"><num value="ii">(ii)</num><content> avoid paying for any loss or damage to property caused by any peril (including wind), other than flood or storm surge, that is not covered under a standard policy under the national flood insurance program.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafaea13-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Federal disaster declaration</heading><content><p style="-uslm-lc:I12" class="indent1">Subject to paragraph (3), in order to expedite claims and reduce costs to the national flood insurance program, following any major disaster declared by the President under <ref href="/us/usc/t42/s5170">section 5170 of this title</ref> relating to a named storm in a coastal State, the Administrator may use the COASTAL Formula to determine and pay for any flood loss covered under a standard insurance policy under the national flood insurance program, if the loss is an indeterminate loss.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafaea14-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> National Academy of Sciences evaluation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaafaea15-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Evaluation required</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idaafaea16-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/3/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> Evaluation</heading><chapeau style="-uslm-lc:I14" class="indent3">Upon the issuance of the rule establishing the COASTAL Formula, and each time the Administrator modifies the COASTAL Formula, the National Academy of Sciences shall—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idaafaea17-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/3/A/i/I"><num value="I">(I)</num><content> evaluate the expected financial impact on the national flood insurance program of the use of the COASTAL Formula as so established or modified; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idaafaea18-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/3/A/i/II"><num value="II">(II)</num><content> evaluate the validity of the scientific assumptions upon which the formula is based and determine whether the COASTAL formula <ref class="footnoteRef" idref="fn003272">1</ref><note type="footnote" id="fn003272"><num>1</num> So in original. Probably should be capitalized.</note> can achieve a degree of accuracy of not less than 90 percent in allocating flood losses for indeterminate losses.</content>
</subclause>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idaafaea19-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/3/A/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I14" class="indent3">The National Academy of Sciences shall submit a report containing the results of each evaluation under clause (i) to the Administrator, the Committee on Banking, Housing, and Urban Affairs and the Committee on Commerce, Science, and Transportation of the Senate, and the Committee on Financial Services and the Committee on Science, Space, and Technology of the House of Representatives.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaafaea1a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Effective date and applicability</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idaafaea1b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/3/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> Effective date</heading><content><p style="-uslm-lc:I14" class="indent3">Paragraphs (1) and (2) of this subsection shall not take effect unless the report under subparagraph (A) relating to the establishment of the COASTAL Formula concludes that the use of the COASTAL Formula for purposes of paragraph <ref class="footnoteRef" idref="fn003273">2</ref><note type="footnote" id="fn003273"><num>2</num> So in original. Probably should be “paragraphs”.</note> (1) and (2) would not have an adverse financial impact on the national flood insurance program and that the COASTAL Formula is based on valid scientific assumptions that would allow a degree of accuracy of not less than 90 percent to be achieved in allocating flood losses for indeterminate losses.</p>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idaafaea1c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/3/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Effect of modifications</heading><content><p style="-uslm-lc:I14" class="indent3">Unless the report under subparagraph (A) relating to a modification of the COASTAL Formula concludes that the use of the COASTAL Formula, as so modified, for purposes of paragraphs (1) and (2) would not have an adverse financial impact on the national flood insurance program and that the COASTAL Formula is based on valid scientific assumptions that would allow a degree of accuracy of not less than 90 percent to be achieved in allocating flood losses for indeterminate losses the Administrator may not use the COASTAL Formula, as so modified, for purposes of paragraphs (1) and (2).</p>

</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaafaea1d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/c/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Funding</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding <ref href="/us/usc/t42/s4017">section 4017 of this title</ref>, there shall be available to the Administrator from the National Flood Insurance Fund, of amounts not otherwise obligated, not more than $750,000 to carry out this paragraph.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaafaea1e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/d"><num value="d" class="bold">(d)</num><heading class="bold"> Disclosure of COASTAL Formula</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than 30 days after the date on which a post-storm assessment is submitted to the Secretary under <ref href="/us/usc/t33/s3611/b/2/C">section 3611(b)(2)(C) of title 33</ref>, for each indeterminate loss for which the COASTAL Formula is used pursuant to subsection (c)(2), the Administrator shall disclose to the policyholder that makes a claim relating to the indeterminate loss—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaafb112f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/d/1"><num value="1">(1)</num><content> that the Administrator used the COASTAL Formula with respect to the indeterminate loss; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaafb1130-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/d/2"><num value="2">(2)</num><content> a summary of the results of the use of the COASTAL Formula.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaafb1131-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/e"><num value="e" class="bold">(e)</num><heading class="bold"> Consultation</heading><chapeau style="-uslm-lc:I11" class="indent0">In carrying out subsections (b) and (c), the Secretary shall consult with—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaafb1132-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/e/1"><num value="1">(1)</num><content> the Under Secretary for Oceans and Atmosphere;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaafb1133-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/e/2"><num value="2">(2)</num><content> the Director of the National Institute of Standards and Technology;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaafb1134-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/e/3"><num value="3">(3)</num><content> the Chief of Engineers of the Corps of Engineers;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaafb1135-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/e/4"><num value="4">(4)</num><content> the Director of the United States Geological Survey;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaafb1136-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/e/5"><num value="5">(5)</num><content> the Office of the Federal Coordinator for Meteorology;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaafb1137-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/e/6"><num value="6">(6)</num><content> State insurance regulators of coastal States; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaafb1138-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/e/7"><num value="7">(7)</num><content> such public, private, and academic sector entities as the Secretary considers appropriate for purposes of carrying out such subsections.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaafb1139-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/f"><num value="f" class="bold">(f)</num><heading class="bold"> Recordkeeping</heading><content><p style="-uslm-lc:I11" class="indent0">Each consideration and measure the Administrator determines necessary to carry out subsection (b) may be required, with advanced approval of the Administrator, to be provided for on the National Flood Insurance Program Elevation Certificate, or maintained otherwise on record if approved by the Administrator, for any property that qualifies for the COASTAL Formula under subsection (c).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaafb113a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/g"><num value="g" class="bold">(g)</num><heading class="bold"> Civil penalty</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafb113b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">If an insurance claims adjuster knowingly and willfully makes a false or inaccurate determination relating to an indeterminate loss, the Administrator may, after notice and opportunity for hearing, impose on the insurance claims adjuster a civil penalty of not more than $1,000.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaafb113c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Deposit</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding <ref href="/us/usc/t31/s3302">section 3302 of title 31</ref> or any other law relating to the crediting of money, the Administrator shall deposit in the National Flood Insurance Fund any amounts received under this subsection, which shall remain available until expended and be available to the Administrator for purposes authorized for the National Flood Insurance Fund without further appropriation.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaafb113d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/h"><num value="h" class="bold">(h)</num><heading class="bold"> Rule of construction</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this subsection <ref class="footnoteRef" idref="fn003274">3</ref><note type="footnote" id="fn003274"><num>3</num> So in original. Probably should be “this section”.</note> shall be construed to require the Administrator to make any payment under the national flood insurance program, or an insurance company to make any payment, for an indeterminate loss based upon post-storm assessment or the COASTAL Formula.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaafb113e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/i"><num value="i" class="bold">(i)</num><heading class="bold"> Applicability</heading><content><p style="-uslm-lc:I11" class="indent0">Subsection (c) shall apply with respect to an indeterminate loss associated with a named storm that occurs after the date on which the Administrator issues the rule establishing the COASTAL Formula under subsection (b).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaafb113f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4057/j"><num value="j" class="bold">(j)</num><heading class="bold"> Rule of Construction</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this subsection <sup>3</sup> shall be construed to negate, set aside, or void any policy limit, including any loss limitation, set forth in a standard insurance policy.</p>
