F, title II, § 100238(b)(1), July 6, 2012, 126 Stat. 958.)","seq_in_title":3967,"parent_identifier":"/us/usc/t42/ch50/schII/ptB","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch50","level":"chapter","num":"CHAPTER 50—","heading":"NATIONAL FLOOD INSURANCE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch50/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"ORGANIZATION AND ADMINISTRATION OF FLOOD INSURANCE PROGRAM","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch50/schII/ptB","level":"part","num":"Part B—","heading":"Government Program With Industry Assistance","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8d785e84-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4071\"><num value=\"4071\">§ 4071.</num><heading> Federal operation of program; determination by Administrator; fiscal agents; report to Congress</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d785e85-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4071/a\"><num value=\"a\">(a)</num><chapeau> If at any time, after consultation with representatives of the insurance industry, the Administrator determines that operation of the flood insurance program as provided under part A cannot be carried out, or that such operation, in itself, would be assisted materially by the Federal Government’s assumption, in whole or in part, of the operational responsibility for flood insurance under this chapter (on a temporary or other basis) he shall promptly undertake any necessary arrangements to carry out the program of flood insurance authorized under subchapter I through the facilities of the Federal Government, utilizing, for purposes of providing flood insurance coverage, either—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d785e86-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4071/a/1\"><num value=\"1\">(1)</num><content> insurance companies and other insurers, insurance agents and brokers, and insurance adjustment organizations, as fiscal agents of the United States,</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d785e87-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4071/a/2\"><num value=\"2\">(2)</num><content> such other officers and employees of any executive agency (as defined in <ref href=\"/us/usc/t5/s105\">section 105 of title 5</ref>) as the Administrator and the head of any such agency may from time to time, agree upon, on a reimbursement or other basis, or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d785e88-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4071/a/3\"><num value=\"3\">(3)</num><content> both the alternatives specified in paragraphs (1) and (2).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d785e89-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4071/b\"><num value=\"b\">(b)</num><chapeau> Upon making the determination referred to in subsection (a), the Administrator shall make a report to the Congress and, at the same time, to the private insurance companies participating in the National Flood Insurance Program pursuant to <ref href=\"/us/usc/t42/s4017\">section 4017 of this title</ref>. Such report shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d785e8a-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4071/b/1\"><num value=\"1\">(1)</num><content> state the reason for such determinations,</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d785e8b-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4071/b/2\"><num value=\"2\">(2)</num><content> be supported by pertinent findings,</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d785e8c-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4071/b/3\"><num value=\"3\">(3)</num><content> indicate the extent to which it is anticipated that the insurance industry will be utilized in providing flood insurance coverage under the program, and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d785e8d-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4071/b/4\"><num value=\"4\">(4)</num><content> contain such recommendations as the Administrator deems advisable.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">The Administrator shall not implement the program of flood insurance authorized under subchapter I through the facilities of the Federal Government until 9 months after the date of submission of the report under this subsection unless it would be impossible to continue to effectively carry out the National Flood Insurance Program operations during this time.</continuation>\n</subsection>\n<sourceCredit id=\"id8d78859e-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/90/448/tXIII/s1340\">Pub.
