<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idab00410f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d"><num value="4104d">§ 4104d.</num><heading> National Flood Mitigation Fund</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab004110-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment and availability</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator shall establish in the Treasury of the United States a fund to be known as the National Flood Mitigation Fund, which shall be credited with amounts described in subsection (b) and shall be available, to the extent provided in appropriation Acts, for providing assistance under <ref href="/us/usc/t42/s4104c">section 4104c of this title</ref>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab006821-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/b"><num value="b" class="bold">(b)</num><heading class="bold"> Credits</heading><chapeau style="-uslm-lc:I11" class="indent0">The National Flood Mitigation Fund shall be credited with—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab006822-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/b/1"><num value="1">(1)</num><chapeau> in each fiscal year, amounts from the National Flood Insurance Fund not to exceed $90,000,000 and to remain available until expended, of which—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab006823-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/b/1/A"><num value="A">(A)</num><content> not more than $40,000,000 shall be available pursuant to subsection (a) of this section for assistance described in <ref href="/us/usc/t42/s4104c/a/1">section 4104c(a)(1) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab006824-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/b/1/B"><num value="B">(B)</num><content> not more than $40,000,000 shall be available pursuant to subsection (a) of this section for assistance described in <ref href="/us/usc/t42/s4104c/a/2">section 4104c(a)(2) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab006825-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/b/1/C"><num value="C">(C)</num><content> not more than $10,000,000 shall be available pursuant to subsection (a) of this section for assistance described in <ref href="/us/usc/t42/s4104c/a/3">section 4104c(a)(3) of this title</ref>;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab006826-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/b/2"><num value="2">(2)</num><content> any penalties collected under <ref href="/us/usc/t42/s4012a/f">section 4012a(f) of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab006827-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/b/3"><num value="3">(3)</num><content> any amounts recaptured under <ref href="/us/usc/t42/s4104c/e">section 4104c(e) of this title</ref>.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab006828-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/c"><num value="c" class="bold">(c)</num><heading class="bold"> Administrative expenses</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator may use not more than 5 percent of amounts made available under subsection (b) to cover salaries, expenses, and other administrative costs incurred by the Administrator to make grants and provide assistance under <ref href="/us/usc/t42/s4104c">section 4104c of this title</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab006829-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/d"><num value="d" class="bold">(d)</num><heading class="bold"> Prohibition on offsetting collections</heading><content><p style="-uslm-lc:I11" class="indent0">Notwithstanding any other provision of this chapter, amounts made available pursuant to this section shall not be subject to offsetting collections through premium rates for flood insurance coverage under this chapter.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab00682a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/e"><num value="e" class="bold">(e)</num><heading class="bold"> Continued availability and reallocation</heading><content><p style="-uslm-lc:I11" class="indent0">Any amounts made available pursuant to subparagraph (A), (B), or (C) of subsection (b)(1) that are not used in any fiscal year shall continue to be available for the purposes specified in the subparagraph of subsection (b)(1) pursuant to which such amounts were made available, unless the Administrator determines that reallocation of such unused amounts to meet demonstrated need for other mitigation activities under <ref href="/us/usc/t42/s4104c">section 4104c of this title</ref> is in the best interest of the National Flood Insurance Fund.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab00682b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/f"><num value="f" class="bold">(f)</num><heading class="bold"> Investment</heading><content><p style="-uslm-lc:I11" class="indent0">If the Administrator determines that the amounts in the National Flood Mitigation Fund are in excess of amounts needed under subsection (a), the Administrator may invest any excess amounts the Administrator determines advisable in interest-bearing obligations issued or guaranteed by the United States.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab00682c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4104d/g"><num value="g" class="bold">(g)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator shall submit a report to the Congress not later than the expiration of the 1-year period beginning on <date date="1994-09-23">September 23, 1994</date>, and not less than once during each successive 2-year period thereafter. The report shall describe the status of the Fund and any activities carried out with amounts from the Fund.</p>
