<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida67784ba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s414"><num value="414">§ 414.</num><heading> Insured status for purposes of old-age and survivors insurance benefits</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For the purposes of this subchapter—</chapeau><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida67784bb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s414/a"><num value="a" class="bold">(a)</num><heading class="bold"> “Fully insured individual” defined</heading><chapeau style="-uslm-lc:I11" class="indent0">The term “fully insured individual” means any individual who had not less than—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida67784bc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s414/a/1"><num value="1">(1)</num><content> one quarter of coverage (whenever acquired) for each calendar year elapsing after 1950 (or, if later, the year in which he attained age 21) and before the year in which he died or (if earlier) the year in which he attained age 62, except that in no case shall an individual be a fully insured individual unless he has at least 6 quarters of coverage; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida67784bd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s414/a/2"><num value="2">(2)</num><content> 40 quarters of coverage; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida67784be-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s414/a/3"><num value="3">(3)</num><content> in the case of an individual who died before 1951, 6 quarters of coverage;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">not counting as an elapsed year for purposes of paragraph (1) any year any part of which was included in a period of disability (as defined in <ref href="/us/usc/t42/s416/i">section 416(i) of this title</ref>), and who satisfies the criterion specified in subsection (c).</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida67784bf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s414/b"><num value="b" class="bold">(b)</num><heading class="bold"> “Currently insured individual” defined</heading><content><p style="-uslm-lc:I11" class="indent0">The term “currently insured individual” means any individual who had not less than six quarters of coverage during the thirteen-quarter period ending with (1) the quarter in which he died, (2) the quarter in which he became entitled to old-age insurance benefits, (3) the quarter in which he became entitled to primary insurance benefits under this subchapter as in effect prior to <date date="1950-08-28">August 28, 1950</date>, or (4) in the case of any individual entitled to disability insurance benefits, the quarter in which he most recently became entitled to disability insurance benefits, not counting as part of such thirteen-quarter period any quarter any part of which was included in a period of disability unless such quarter was a quarter of coverage, and who satisfies the criterion specified in subsection (c).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida67784c0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s414/c"><num value="c" class="bold">(c)</num><heading class="bold"> Criterion described</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of subsections (a) and (b), the criterion specified in this subsection is that the individual, if not a United States citizen or national—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida67784c1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s414/c/1"><num value="1">(1)</num><content> has been assigned a social security account number that was, at the time of assignment, or at any later time, consistent with the requirements of subclause (I) or (III) of <ref href="/us/usc/t42/s405/c/2/B/i">section 405(c)(2)(B)(i) of this title</ref>; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida67784c2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s414/c/2"><num value="2">(2)</num><chapeau> at the time any such quarters of coverage are earned—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida67784c3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s414/c/2/A"><num value="A">(A)</num><content> is described in subparagraph (B) or (D) of <ref href="/us/usc/t8/s1101/a/15">section 1101(a)(15) of title 8</ref>,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida67784c4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s414/c/2/B"><num value="B">(B)</num><content> is lawfully admitted temporarily to the United States for business (in the case of an individual described in such subparagraph (B)) or the performance as a crewman (in the case of an individual described in such subparagraph (D)), and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida67784c5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s414/c/2/C"><num value="C">(C)</num><content> the business engaged in or service as a crewman performed is within the scope of the terms of such individual’s admission to the United States.</content>
