<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idab25f17b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4370c"><num value="4370c">§ 4370c.</num><heading> Environmental Protection Agency fees</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab25f17c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4370c/a"><num value="a" class="bold">(a)</num><heading class="bold"> Assessment and collection</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator of the Environmental Protection Agency shall, by regulation, assess and collect fees and charges for services and activities carried out pursuant to laws administered by the Environmental Protection Agency.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab25f17d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4370c/b"><num value="b" class="bold">(b)</num><heading class="bold"> Amount of fees and charges</heading><chapeau style="-uslm-lc:I11" class="indent0">Fees and charges assessed pursuant to this section shall be in such amounts as may be necessary to ensure that the aggregate amount of fees and charges collected pursuant to this section, in excess of the amount of fees and charges collected under current law—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab26188e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4370c/b/1"><num value="1">(1)</num><content> in fiscal year 1991, is not less than $28,000,000; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab26188f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4370c/b/2"><num value="2">(2)</num><content> in each of fiscal years 1992, 1993, 1994, and 1995, is not less than $38,000,000.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab261890-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4370c/c"><num value="c" class="bold">(c)</num><heading class="bold"> Limitation on fees and charges</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idab261891-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4370c/c/1"><num value="1">(1)</num><chapeau> The maximum aggregate amount of fees and charges in excess of the amounts being collected under current law which may be assessed and collected pursuant to this section in a fiscal year—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idab261892-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4370c/c/1/A"><num value="A">(A)</num><content> for services and activities carried out pursuant ot <ref class="footnoteRef" idref="fn003286">1</ref><note type="footnote" id="fn003286"><num>1</num> So in original. Probably should be “to”.</note> the Federal Water Pollution Control Act [<ref href="/us/usc/t33/s1251">33 U.S.C. 1251</ref> et seq.] is $10,000,000; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idab261893-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4370c/c/1/B"><num value="B">(B)</num><content> for services and activities in programs within the jurisdiction of the House Committee on Energy and Commerce and administered by the Environmental Protection Agency through the Administrator, shall be limited to such sums collected as of <date date="1990-11-05">November 5, 1990</date>, pursuant to sections 2625(b) and 2665(e)(2) <ref class="footnoteRef" idref="fn003287">2</ref><note type="footnote" id="fn003287"><num>2</num> See References in Text note below.</note> of title 15, and such sums specifically authorized by the Clean Air Act Amendments of 1990.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idab261894-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4370c/c/2"><num value="2">(2)</num><content> Any remaining amounts required to be collected under this section shall be collected from services and programs administered by the Environmental Protection Agency other than those specified in subparagraphs (A) and (B) of paragraph (1).</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab263fa5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4370c/d"><num value="d" class="bold">(d)</num><heading class="bold"> Rule of construction</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section increases or diminishes the authority of the Administrator to promulgate regulations pursuant to <ref href="/us/usc/t31/s9701">section 9701 of title 31</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab263fa6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s4370c/e"><num value="e" class="bold">(e)</num><heading class="bold"> Uses of fees</heading><content><p style="-uslm-lc:I11" class="indent0">Fees and charges collected pursuant to this section shall be deposited into a special account for environmental services in the Treasury of the United States. Subject to appropriation Acts, such funds shall be available to the Environmental Protection Agency to carry out the activities for which such fees and charges are collected. Such funds shall remain available until expended.</p>
