L. 100–17, title IV, § 404, Apr. 2, 1987, 101 Stat. 248.)","seq_in_title":4137,"parent_identifier":"/us/usc/t42/ch61/schII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch61","level":"chapter","num":"CHAPTER 61—","heading":"UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES FOR FEDERAL AND FEDERALLY ASSISTED PROGRAMS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch61/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"UNIFORM RELOCATION ASSISTANCE","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idab3b00af-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621\"><num value=\"4621\">§ 4621.</num><heading> Declaration of findings and policy</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab3b00b0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Findings</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Congress finds and declares that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab3b00b1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621/a/1\"><num value=\"1\">(1)</num><content> displacement as a direct result of programs or projects undertaken by a Federal agency or with Federal financial assistance is caused by a number of activities, including rehabilitation, demolition, code enforcement, and acquisition;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab3b00b2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621/a/2\"><num value=\"2\">(2)</num><content> relocation assistance policies must provide for fair, uniform, and equitable treatment of all affected persons;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab3b00b3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621/a/3\"><num value=\"3\">(3)</num><content> the displacement of businesses often results in their closure;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab3b00b4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621/a/4\"><num value=\"4\">(4)</num><content> minimizing the adverse impact of displacement is essential to maintaining the economic and social well-being of communities; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab3b00b5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621/a/5\"><num value=\"5\">(5)</num><content> implementation of this chapter has resulted in burdensome, inefficient, and inconsistent compliance requirements and procedures which will be improved by establishing a lead agency and allowing for State certification and implementation.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab3b27c6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Policy</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">This subchapter establishes a uniform policy for the fair and equitable treatment of persons displaced as a direct result of programs or projects undertaken by a Federal agency or with Federal financial assistance. The primary purpose of this subchapter is to ensure that such persons shall not suffer disproportionate injuries as a result of programs and projects designed for the benefit of the public as a whole and to minimize the hardship of displacement on such persons.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab3b27c7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Congressional intent</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">It is the intent of Congress that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab3b27c8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621/c/1\"><num value=\"1\">(1)</num><content> Federal agencies shall carry out this subchapter in a manner which minimizes waste, fraud, and mismanagement and reduces unnecessary administrative costs borne by States and State agencies in providing relocation assistance;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab3b27c9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621/c/2\"><num value=\"2\">(2)</num><content> uniform procedures for the administration of relocation assistance shall, to the maximum extent feasible, assure that the unique circumstances of any displaced person are taken into account and that persons in essentially similar circumstances are accorded equal treatment under this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab3b27ca-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621/c/3\"><num value=\"3\">(3)</num><content> the improvement of housing conditions of economically disadvantaged persons under this subchapter shall be undertaken, to the maximum extent feasible, in coordination with existing Federal, State, and local governmental programs for accomplishing such goals; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab3b27cb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4621/c/4\"><num value=\"4\">(4)</num><content> the policies and procedures of this chapter will be administered in a manner which is consistent with fair housing requirements and which assures all persons their rights under title VIII of the Act of <date date=\"1968-04-11\">April 11, 1968</date> (<ref href=\"/us/pl/90/284\">Public Law 90–284</ref>), commonly known as the Civil Rights Act of 1968 [<ref href=\"/us/usc/t42/s3601\">42 U.S.C. 3601</ref> et seq.], and title VI of the Civil Rights Act of 1964 [<ref href=\"/us/usc/t42/s2000d\">42 U.S.C. 2000d</ref> et seq.].</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idab3b4edc-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/91/646/tII/s201\">Pub.
