L. 100–17, title IV, § 417, Apr. 2, 1987, 101 Stat. 256.)","seq_in_title":4159,"parent_identifier":"/us/usc/t42/ch61/schIII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch61","level":"chapter","num":"CHAPTER 61—","heading":"UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES FOR FEDERAL AND FEDERALLY ASSISTED PROGRAMS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch61/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"UNIFORM REAL PROPERTY ACQUISITION POLICY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8d9b4fed-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4655\"><num value=\"4655\">§ 4655.</num><heading> Requirements for uniform land acquisition policies; payments of expenses incidental to transfer of real property to State; payment of litigation expenses in certain cases</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d9b4fee-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4655/a\"><num value=\"a\">(a)</num><chapeau> Notwithstanding any other law, the head of a Federal agency shall not approve any program or project or any grant to, or contract or agreement with, an acquiring agency under which Federal financial assistance will be available to pay all or part of the cost of any program or project which will result in the acquisition of real property on and after <date date=\"1971-01-02\">January 2, 1971</date>, unless he receives satisfactory assurances from such acquiring agency that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d9b4fef-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4655/a/1\"><num value=\"1\">(1)</num><content> in acquiring real property it will be guided, to the greatest extent practicable under State law, by the land acquisition policies in <ref href=\"/us/usc/t42/s4651\">section 4651 of this title</ref> and the provisions of <ref href=\"/us/usc/t42/s4652\">section 4652 of this title</ref>, and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d9b4ff0-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4655/a/2\"><num value=\"2\">(2)</num><content> property owners will be paid or reimbursed for necessary expenses as specified in sections 4653 and 4654 of this title.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d9b4ff1-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4655/b\"><num value=\"b\">(b)</num><chapeau> For purposes of this section, the term “acquiring agency” means—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d9b4ff2-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4655/b/1\"><num value=\"1\">(1)</num><content> a State agency (as defined in <ref href=\"/us/usc/t42/s4601/3\">section 4601(3) of this title</ref>) which has the authority to acquire property by eminent domain under State law, and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d9b4ff3-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s4655/b/2\"><num value=\"2\">(2)</num><content> a State agency or person which does not have such authority, to the extent provided by the head of the lead agency by regulation.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id8d9b4ff4-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/91/646/tIII/s305\">Pub.
