Jan. 1, 1979, 43 F.R. 36037, 92 Stat. 3783.)","seq_in_title":4179,"parent_identifier":"/us/usc/t42/ch62/schIV","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch62","level":"chapter","num":"CHAPTER 62—","heading":"INTERGOVERNMENTAL PERSONNEL PROGRAM","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch62/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"GENERAL PROVISIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idab4587a2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763\"><num value=\"4763\">§ 4763.</num><heading> General administrative provisions</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab4587a3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Administration by Office</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Unless otherwise specifically provided, the Office shall administer this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab4587a4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Advice and assistance</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Office shall furnish such advice and assistance to State and local governments as may be necessary to carry out the purposes of this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab45aeb5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Regulations and standards; contracts: modification, covenants, conditions, and provisions; utilization of other agencies</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In the performance of, and with respect to, the functions, powers, and duties vested in it by this chapter, the Office may—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab45aeb6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/c/1\"><num value=\"1\">(1)</num><content> issue such standards and regulations as may be necessary to carry out the purposes of this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab45aeb7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/c/2\"><num value=\"2\">(2)</num><content> consent to the modification of any contract entered into pursuant to this chapter, such consent being subject to any specific limitations of this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab45aeb8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/c/3\"><num value=\"3\">(3)</num><content> include in any contract made pursuant to this chapter such covenants, conditions, or provisions as it deems necessary to assure that the purposes of this chapter will be achieved; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab45aeb9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/c/4\"><num value=\"4\">(4)</num><content> utilize the services and facilities of any Federal agency, any State or local government, and any other public or nonprofit agency or institution, on a reimbursable basis or otherwise, in accordance with agreements between the Office and the head thereof.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab45aeba-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Information: collection and availability; research and evaluation; administration report; coordination of Federal programs</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In the performance of, and with respect to the functions, powers, and duties vested in it by this chapter, the Office—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab45aebb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/d/1\"><num value=\"1\">(1)</num><content> may collect information from time to time with respect to State and local government training programs and personnel administration improvement programs and projects under this chapter, and make such information available to interested groups, organizations, or agencies, public or private;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab45aebc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/d/2\"><num value=\"2\">(2)</num><content> may conduct such research and make such evaluation as needed for the efficient administration of this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab45aebd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/d/3\"><num value=\"3\">(3)</num><content> shall include in its annual report a report of the administration of this chapter; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab45aebe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/d/4\"><num value=\"4\">(4)</num><content> shall make such arrangements as may be necessary to avoid duplication of programs providing for training and to insure consistent administration of the related Federal training activities, with particular regard to title I of the Higher Education Act of 1965 [<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref> et seq.].</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab45d5cf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4763/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Additional authority</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The provisions of this chapter are not a limitation on existing authorities under other statutes but are in addition to any such authorities, unless otherwise specifically provided in this chapter.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idab45d5d0-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/91/648/tV/s503\">Pub.
