The regulations shall require that, before the purchaser or lessee is obligated under any contract to purchase or lease the housing, the seller or lessor shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab4cb3f8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/a/1/A\"><num value=\"A\">(A)</num><content> provide the purchaser or lessee with a lead hazard information pamphlet, as prescribed by the Administrator of the Environmental Protection Agency under section 406 of the Toxic Substances Control Act [<ref href=\"/us/usc/t15/s2686\">15 U.S.C. 2686</ref>];</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab4cb3f9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/a/1/B\"><num value=\"B\">(B)</num><content> disclose to the purchaser or lessee the presence of any known lead-based paint, or any known lead-based paint hazards, in such housing and provide to the purchaser or lessee any lead hazard evaluation report available to the seller or lessor; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab4cb3fa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/a/1/C\"><num value=\"C\">(C)</num><content> permit the purchaser a 10-day period (unless the parties mutually agree upon a different period of time) to conduct a risk assessment or inspection for the presence of lead-based paint hazards.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab4cdb0b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contract for purchase and sale</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Regulations promulgated under this section shall provide that every contract for the purchase and sale of any interest in target housing shall contain a Lead Warning Statement and a statement signed by the purchaser that the purchaser has—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab4cdb0c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/a/2/A\"><num value=\"A\">(A)</num><content> read the Lead Warning Statement and understands its contents;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab4cdb0d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/a/2/B\"><num value=\"B\">(B)</num><content> received a lead hazard information pamphlet; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab4cdb0e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/a/2/C\"><num value=\"C\">(C)</num><content> had a 10-day opportunity (unless the parties mutually agreed upon a different period of time) before becoming obligated under the contract to purchase the housing to conduct a risk assessment or inspection for the presence of lead-based paint hazards.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab4cdb0f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Contents of lead warning statement</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Lead Warning Statement shall contain the following text printed in large type on a separate sheet of paper attached to the contract:</p>\n<p style=\"-uslm-lc:I11\" class=\"indent0\">“Every purchaser of any interest in residential real property on which a residential dwelling was built prior to 1978 is notified that such property may present exposure to lead from lead-based paint that may place young children at risk of developing lead poisoning. Lead poisoning in young children may produce permanent neurological damage, including learning disabilities, reduced intelligence quotient, behavioral problems, and impaired memory. Lead poisoning also poses a particular risk to pregnant women. The seller of any interest in residential real property is required to provide the buyer with any information on lead-based paint hazards from risk assessments or inspections in the seller’s possession and notify the buyer of any known lead-based paint hazards. A risk assessment or inspection for possible lead-based paint hazards is recommended prior to purchase.”.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab4cdb10-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/a/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Compliance assurance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Whenever a seller or lessor has entered into a contract with an agent for the purpose of selling or leasing a unit of target housing, the regulations promulgated under this section shall require the agent, on behalf of the seller or lessor, to ensure compliance with the requirements of this section.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab4cdb11-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/a/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Promulgation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A suit may be brought against the Secretary of Housing and Urban Development and the Administrator of the Environmental Protection Agency under section 20 of the Toxic Substances Control Act [<ref href=\"/us/usc/t15/s2619\">15 U.S.C. 2619</ref>] to compel promulgation of the regulations required under this section and the Federal district court shall have jurisdiction to order such promulgation.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab4d0222-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Penalties for violations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab4d0223-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Monetary penalty</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any person who knowingly violates any provision of this section shall be subject to civil money penalties in accordance with the provisions of <ref href=\"/us/usc/t42/s3545\">section 3545 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab4d0224-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Action by Secretary</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary is authorized to take such lawful action as may be necessary to enjoin any violation of this section.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab4d0225-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Civil liability</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any person who knowingly violates the provisions of this section shall be jointly and severally liable to the purchaser or lessee in an amount equal to 3 times the amount of damages incurred by such individual.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab4d0226-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Costs</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In any civil action brought for damages pursuant to paragraph (3), the appropriate court may award court costs to the party commencing such action, together with reasonable attorney fees and any expert witness fees, if that party prevails.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab4d0227-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/b/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Prohibited act</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">It shall be a prohibited act under section 409 of the Toxic Substances Control Act [<ref href=\"/us/usc/t15/s2689\">15 U.S.C. 2689</ref>] for any person to fail or refuse to comply with a provision of this section or with any rule or order issued under this section. For purposes of enforcing this section under the Toxic Substances Control Act [<ref href=\"/us/usc/t15/s2601\">15 U.S.C. 2601</ref> et seq.], the penalty for each violation applicable under section 16 of that Act [<ref href=\"/us/usc/t15/s2615\">15 U.S.C. 2615</ref>] shall not be more than $10,000.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab4d0228-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Validity of contracts and liens</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section shall affect the validity or enforceability of any sale or contract for the purchase and sale or lease of any interest in residential real property or any loan, loan agreement, mortgage, or lien made or arising in connection with a mortgage loan, nor shall anything in this section create a defect in title.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab4d0229-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4852d/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Effective date</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The regulations under this section shall take effect 3 years after <date date=\"1992-10-28\">October 28, 1992</date>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idab4d022a-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/102/550/tX/s1018\">Pub.
