L. 102–550, title X, § 1061, Oct. 28, 1992, 106 Stat. 3926.)","seq_in_title":4213,"parent_identifier":"/us/usc/t42/ch63A/schIV","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch63A","level":"chapter","num":"CHAPTER 63A—","heading":"RESIDENTIAL LEAD-BASED PAINT HAZARD REDUCTION","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch63A/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"REPORTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idab4d7783-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856\"><num value=\"4856\">§ 4856.</num><heading> Reports of Secretary of Housing and Urban Development</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab4d7784-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Annual report</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall transmit to the Congress an annual report that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab4d7785-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/a/1\"><num value=\"1\">(1)</num><content> sets forth the Secretary’s assessment of the progress made in implementing the various programs authorized by this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab4d7786-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/a/2\"><num value=\"2\">(2)</num><content> summarizes the most current health and environmental studies on childhood lead poisoning, including studies that analyze the relationship between interim control and abatement activities and the incidence of lead poisoning in resident children;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab4d9e97-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/a/3\"><num value=\"3\">(3)</num><content> recommends legislative and administrative initiatives that may improve the performance by the Department of Housing and Urban Development in combating lead hazards through the expansion of lead hazard evaluation and reduction activities;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab4d9e98-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/a/4\"><num value=\"4\">(4)</num><content> describes the results of research carried out in accordance with subchapter III; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab4d9e99-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/a/5\"><num value=\"5\">(5)</num><content> estimates the amount of Federal assistance annually expended on lead hazard evaluation and reduction activities.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab4d9e9a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Biennial report</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab4d9e9b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">24 months after <date date=\"1992-10-28\">October 28, 1992</date>, and at the end of every 24-month period thereafter, the Secretary shall report to the Congress on the progress of the Department of Housing and Urban Development in implementing expanded lead-based paint hazard evaluation and reduction activities.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab4d9e9c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contents</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The report shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab4d9e9d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/b/2/A\"><num value=\"A\">(A)</num><content> assess the effectiveness of <ref href=\"/us/usc/t42/s4852d\">section 4852d of this title</ref> in making the public aware of lead-based paint hazards;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab4d9e9e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/b/2/B\"><num value=\"B\">(B)</num><content> estimate the extent to which lead-based paint hazard evaluation and reduction activities are being conducted in the various categories of housing;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab4d9e9f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/b/2/C\"><num value=\"C\">(C)</num><content> monitor and report expenditures for lead-based paint hazard evaluation and reduction for programs within the jurisdiction of the Department of Housing and Urban Development;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab4d9ea0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/b/2/D\"><num value=\"D\">(D)</num><content> identify the infrastructure needed to eliminate lead-based paint hazards in all housing as expeditiously as possible, including cost-effective technology, standards and regulations, trained and certified contractors, certified laboratories, liability insurance, private financing techniques, and appropriate Government subsidies;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab4d9ea1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4856/b/2/E\"><num value=\"E\">(E)</num><content> assess the extent to which the infrastructure described in subparagraph (D) exists, make recommendations to correct shortcomings, and provide estimates of the costs of measures needed to build an adequate infrastructure;
