<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id2937b5b8-4e00-11e3-bfbc-9f3100a4b203" identifier="/us/usc/t42/s4910"><num value="4910">§ 4910.</num><heading> Enforcement</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2937b5b9-4e00-11e3-bfbc-9f3100a4b203" identifier="/us/usc/t42/s4910/a"><num value="a" class="bold">(a)</num><heading class="bold"> Criminal penalties</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id2937b5ba-4e00-11e3-bfbc-9f3100a4b203" identifier="/us/usc/t42/s4910/a/1"><num value="1">(1)</num><content> Any person who willfully or knowingly violates paragraph (1), (3), (5), or (6) of subsection (a) of <ref href="/us/usc/t42/s4909">section 4909 of this title</ref> shall be punished by a fine of not more than $25,000 per day of violation, or by imprisonment for not more than one year, or by both. If the conviction is for a violation committed after a first conviction of such person under this subsection, punishment shall be by a fine of not more than $50,000 per day of violation, or by imprisonment for not more than two years, or by both.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id2937b5bb-4e00-11e3-bfbc-9f3100a4b203" identifier="/us/usc/t42/s4910/a/2"><num value="2">(2)</num><content> Any person who violates paragraph (1), (3), (5), or (6) of subsection (a) of <ref href="/us/usc/t42/s4909">section 4909 of this title</ref> shall be subject to a civil penalty not to exceed $10,000 per day of such violation.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2937b5bc-4e00-11e3-bfbc-9f3100a4b203" identifier="/us/usc/t42/s4910/b"><num value="b" class="bold">(b)</num><heading class="bold"> Separate violations</heading><content><p style="-uslm-lc:I11" class="indent0">For the purpose of this section, each day of violation of any paragraph of <ref href="/us/usc/t42/s4909/a">section 4909(a) of this title</ref> shall constitute a separate violation of that section.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2937b5bd-4e00-11e3-bfbc-9f3100a4b203" identifier="/us/usc/t42/s4910/c"><num value="c" class="bold">(c)</num><heading class="bold"> Actions to restrain violations</heading><content><p style="-uslm-lc:I11" class="indent0">The district courts of the United States shall have jurisdiction of actions brought by and in the name of the United States to restrain any violations of <ref href="/us/usc/t42/s4909/a">section 4909(a) of this title</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2937b5be-4e00-11e3-bfbc-9f3100a4b203" identifier="/us/usc/t42/s4910/d"><num value="d" class="bold">(d)</num><heading class="bold"> Orders issued to protect public health and welfare; notice; opportunity for hearing</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id2937b5bf-4e00-11e3-bfbc-9f3100a4b203" identifier="/us/usc/t42/s4910/d/1"><num value="1">(1)</num><content> Whenever any person is in violation of <ref href="/us/usc/t42/s4909/a">section 4909(a) of this title</ref>, the Administrator may issue an order specifying such relief as he determines is necessary to protect the public health and welfare.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id2937b5c0-4e00-11e3-bfbc-9f3100a4b203" identifier="/us/usc/t42/s4910/d/2"><num value="2">(2)</num><content> Any order under this subsection shall be issued only after notice and opportunity for a hearing in accordance with <ref href="/us/usc/t5/s554">section 554 of title 5</ref>.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2937b5c1-4e00-11e3-bfbc-9f3100a4b203" identifier="/us/usc/t42/s4910/e"><num value="e" class="bold">(e)</num><heading class="bold"> “Person” defined</heading><content><p style="-uslm-lc:I11" class="indent0">The term “person,” as used in this section, does not include a department, agency, or instrumentality of the United States.</p>
