Probably should be subsection “(f)”.</note>), or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab4fe820-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4911/a/2\"><num value=\"2\">(2)</num><chapeau> against—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab4fe821-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4911/a/2/A\"><num value=\"A\">(A)</num><content> the Administrator of the Environmental Protection Agency where there is alleged a failure of such Administrator to perform any act or duty under this chapter which is not discretionary with such Administrator, or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab500f32-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4911/a/2/B\"><num value=\"B\">(B)</num><content> the Administrator of the Federal Aviation Administration where there is alleged a failure of such Administrator to perform any act or duty under <ref href=\"/us/usc/t49/s44715\">section 44715 of title 49</ref> which is not discretionary with such Administrator.</content>\n</subparagraph>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">The district courts of the United States shall have jurisdiction, without regard to the amount in controversy, to restrain such person from violating such noise control requirement or to order such Administrator to perform such act or duty, as the case may be.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab500f33-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4911/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Notice</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">No action may be commenced—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab500f34-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4911/b/1\"><num value=\"1\">(1)</num><chapeau> under subsection (a)(1)—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab500f35-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4911/b/1/A\"><num value=\"A\">(A)</num><content> prior to sixty days after the plaintiff has given notice of the violation (i) to the Administrator of the Environmental Protection Agency (and to the Federal Aviation Administrator in the case of a violation of a noise control requirement under such <ref href=\"/us/usc/t49/s44715\">section 44715 of title 49</ref>) and (ii) to any alleged violator of such requirement, or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab500f36-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4911/b/1/B\"><num value=\"B\">(B)</num><content> if an Administrator has commenced and is diligently prosecuting a civil action to require compliance with the noise control requirement, but in any such action in a court of the United States any person may intervene as a matter of right, or</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab500f37-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4911/b/2\"><num value=\"2\">(2)</num><content> under subsection (a)(2) prior to sixty days after the plaintiff has given notice to the defendant that he will commence such action.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">Notice under this subsection shall be given in such manner as the Administrator of the Environmental Protection Agency shall prescribe by regulation.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab500f38-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4911/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Intervention</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In an action under this section, the Administrator of the Environmental Protection Agency, if not a party, may intervene as a matter of right. In an action under this section respecting a noise control requirement under <ref href=\"/us/usc/t49/s44715\">section 44715 of title 49</ref>, the Administrator of the Federal Aviation Administration, if not a party, may also intervene as a matter of right.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab500f39-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4911/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Litigation costs</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The court, in issuing any final order in any action brought pursuant to subsection (a) of this section, may award costs of litigation (including reasonable attorney and expert witness fees) to any party, whenever the court determines such an award is appropriate.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab50364a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4911/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Other common law or statutory rights of action</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section shall restrict any right which any person (or class of persons) may have under any statute or common law to seek enforcement of any noise control requirement or to seek any other relief (including relief against an Administrator).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab50364b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s4911/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> “Noise control requirement” defined</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section, the term “noise control requirement” means paragraph (1), (2), (3), (4), or (5) of <ref href=\"/us/usc/t42/s4909/a\">section 4909(a) of this title</ref>, or a standard, rule, or regulation issued under section 4916 or 4917 of this title or under <ref href=\"/us/usc/t49/s44715\">section 44715 of title 49</ref>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idab50364c-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/92/574/s12\">Pub.
