<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idab5f9f62-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056"><num value="5056">§ 5056.</num><heading> Evaluation of programs and projects</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab5f9f63-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/a"><num value="a" class="bold">(a)</num><heading class="bold"> General objectives; persons conducting the evaluation</heading><content><p style="-uslm-lc:I11" class="indent0">The Director shall measure and evaluate the impact of all programs authorized by this chapter, their effectiveness in achieving stated goals, in general, and in relation to their cost, their impact on related programs, and their structure and mechanism for delivery of services. Each program shall be evaluated at least once every three years. Evaluations shall be conducted by persons not immediately involved in the administration of the program or project evaluated. Such evaluation shall also measure and evaluate compliance with the equitable distribution requirement of <ref href="/us/usc/t42/s5054">section 5054 of this title</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab5fc674-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/b"><num value="b" class="bold">(b)</num><heading class="bold"> General standards; publication; reports of ensuing actions</heading><content><p style="-uslm-lc:I11" class="indent0">The Director shall develop and publish general standards for evaluation of program and project effectiveness in achieving the objectives of this chapter. Reports submitted pursuant to section 5047 <ref class="footnoteRef" idref="fn003311">1</ref><note type="footnote" id="fn003311"><num>1</num> See References in Text note below.</note> of this title shall describe the actions taken as a result of evaluations carried out under this section.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab5fc675-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/c"><num value="c" class="bold">(c)</num><heading class="bold"> Opinions of participants</heading><content><p style="-uslm-lc:I11" class="indent0">In carrying out evaluations under this subchapter, the Director shall, whenever possible, arrange to obtain the opinions of program and project participants about the strengths and weaknesses of such programs and projects.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab5fc676-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/d"><num value="d" class="bold">(d)</num><heading class="bold"> Summaries of results; publication</heading><content><p style="-uslm-lc:I11" class="indent0">The Director shall publish summaries of the results of evaluations of program and project impact and effectiveness no later than sixty days after the completion thereof.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab5fc677-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/e"><num value="e" class="bold">(e)</num><heading class="bold"> Federal property</heading><content><p style="-uslm-lc:I11" class="indent0">The Director shall take the necessary action to assure that all studies, evaluations, proposals, and data produced or developed with Federal funds shall become the property of the United States.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab5fc678-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/f"><num value="f" class="bold">(f)</num><heading class="bold"> Evaluation of programs that relate to services that assist families caring for frail and disabled adult family members; evaluation of impact by volunteers on such programs; report to committees of Congress</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than <date date="1988-12-31">December 31, 1988</date>, the Director shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab5fc679-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/f/1"><num value="1">(1)</num><chapeau> evaluate the impact of Corporation programs carried out under subchapter II that relate to services that assist families caring for frail and disabled adult family members and shall include in such evaluation information on—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab5fc67a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/f/1/A"><num value="A">(A)</num><content> the range and extent of service needs of, and the services provided to, family caregivers assisted by volunteers;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab5fc67b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/f/1/B"><num value="B">(B)</num><content> the characteristics of volunteers and the skills, training, and supervision necessary to provide various types of volunteer assistance to family caregivers;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab5fc67c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/f/1/C"><num value="C">(C)</num><content> administrative costs, including recruitment, training, and supervision costs, associated with volunteer assistance to family caregivers; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab5fed8d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/f/1/D"><num value="D">(D)</num><content> such other issues as may be relevant to provide services to assist family caregivers;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab5fed8e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/f/2"><num value="2">(2)</num><chapeau> evaluate the impact that volunteers who participate in programs under parts B and C of subchapter II without receiving a stipend have on such programs and shall include in such evaluation—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab5fed8f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/f/2/A"><num value="A">(A)</num><content> information on adminstrative <ref class="footnoteRef" idref="fn003312">2</ref><note type="footnote" id="fn003312"><num>2</num> So in original. Probably should be “administrative”.</note> costs associated with such volunteers;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab5fed90-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/f/2/B"><num value="B">(B)</num><content> a comparison of the quality of services provided by such volunteers and the quality of services provided by volunteers who receive a stipend under such parts, including the rate of absenteeism and turnover; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab5fed91-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/f/2/C"><num value="C">(C)</num><content> a review of the effect that participation by volunteers who do not receive such stipend have on the administration of such programs; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab5fed92-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/f/3"><num value="3">(3)</num><content> submit to the authorizing committees a report summarizing in detail the results of the evaluations made under paragraphs (1) and (2).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab5fed93-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5056/g"><num value="g" class="bold">(g)</num><heading class="bold"> Funds limitation; reduction of allotments</heading><content><p style="-uslm-lc:I11" class="indent0">The Director is authorized to use such sums as are required, but not to exceed 1 per centum of the funds appropriated under this chapter, to conduct program and project evaluations (directly, or by grants or contracts) as required by this chapter. In the case of allotments from such an appropriation, the amount available for such allotments (and the amount deemed appropriate therefor) shall be reduced accordingly.</p>
