and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab6da8e5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/a/4\"><num value=\"4\">(4)</num><content> the assessment and investigation of cases involving children with disabilities or serious health-related problems who are suspected victims of child abuse or neglect.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab6da8e6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Eligibility requirements</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In order for a State to qualify for assistance under this section, such State shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab6da8e7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/b/1\"><num value=\"1\">(1)</num><content> fulfill the requirements of <ref href=\"/us/usc/t42/s5106a/b\">section 5106a(b) of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab6da8e8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/b/2\"><num value=\"2\">(2)</num><content> establish a task force as provided in subsection (c);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab6da8e9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/b/3\"><num value=\"3\">(3)</num><content> fulfill the requirements of subsection (d);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab6da8ea-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/b/4\"><num value=\"4\">(4)</num><chapeau> submit annually an application to the Secretary at such time and containing such information and assurances as the Secretary considers necessary, including an assurance that the State will—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6da8eb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/b/4/A\"><num value=\"A\">(A)</num><content> make such reports to the Secretary as may reasonably be required; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6da8ec-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/b/4/B\"><num value=\"B\">(B)</num><content> maintain and provide access to records relating to activities under subsections (a) and (b); and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab6da8ed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/b/5\"><num value=\"5\">(5)</num><content> submit annually to the Secretary a report on the manner in which assistance received under this program was expended throughout the State, with particular attention focused on the areas described in paragraphs (1) through (3) of subsection (a).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab6da8ee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> State task forces</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab6da8ef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> General rule</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Except as provided in paragraph (2), a State requesting assistance under this section shall establish or designate, and maintain, a State multidisciplinary task force on children’s justice (hereinafter referred to as “State task force”) composed of professionals with knowledge and experience relating to the criminal justice system and issues of child physical abuse, child neglect, child sexual abuse and exploitation, and child maltreatment related fatalities. The State task force shall include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6dd000-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c/1/A\"><num value=\"A\">(A)</num><content> individuals representing the law enforcement community;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6dd001-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c/1/B\"><num value=\"B\">(B)</num><content> judges and attorneys involved in both civil and criminal court proceedings related to child abuse and neglect (including individuals involved with the defense as well as the prosecution of such cases);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6dd002-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c/1/C\"><num value=\"C\">(C)</num><content> child advocates, including both attorneys for children and, where such programs are in operation, court appointed special advocates;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6dd003-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c/1/D\"><num value=\"D\">(D)</num><content> health and mental health professionals;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6dd004-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c/1/E\"><num value=\"E\">(E)</num><content> individuals representing child protective service agencies;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6dd005-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c/1/F\"><num value=\"F\">(F)</num><content> individuals experienced in working with children with disabilities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6dd006-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c/1/G\"><num value=\"G\">(G)</num><content> parents;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6dd007-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c/1/H\"><num value=\"H\">(H)</num><content> representatives of parents’ groups;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6dd008-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c/1/I\"><num value=\"I\">(I)</num><content> adult former victims of child abuse or neglect; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6dd009-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c/1/J\"><num value=\"J\">(J)</num><content> individuals experienced in working with homeless children and youths (as defined in <ref href=\"/us/usc/t42/s11434a\">section 11434a of this title</ref>).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab6dd00a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Existing task force</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">As determined by the Secretary, a State commission or task force established after <date date=\"1983-01-01\">January 1, 1983</date>, with substantially comparable membership and functions, may be considered the State task force for purposes of this subsection.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab6dd00b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> State task force study</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Before a State receives assistance under this section, and at three year intervals thereafter, the State task force shall comprehensively—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab6dd00c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/d/1\"><num value=\"1\">(1)</num><content> review and evaluate State investigative, administrative and both civil and criminal judicial handling of cases of child abuse and neglect, including child sexual abuse and exploitation, as well as cases involving suspected child maltreatment related fatalities and cases involving a potential combination of jurisdictions, such as intrastate, interstate, Federal-State, and State-Tribal; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab6dd00d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/d/2\"><num value=\"2\">(2)</num><content> make policy and training recommendations in each of the categories described in subsection (e).</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">The task force may make such other comments and recommendations as are considered relevant and useful.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab6dd00e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Adoption of State task force recommendations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab6dd00f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> General rule</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Subject to the provisions of paragraph (2), before a State receives assistance under this section, a State shall adopt recommendations of the State task force in each of the following categories—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6df720-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/e/1/A\"><num value=\"A\">(A)</num><content> investigative, administrative, and judicial handling of cases of child abuse and neglect, including child sexual abuse and exploitation, as well as cases involving suspected child maltreatment related fatalities and cases involving a potential combination of jurisdictions, such as intrastate, interstate, Federal-State, and State-Tribal, in a manner which reduces the additional trauma to the child victim and the victim’s family and which also ensures procedural fairness to the accused;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6df721-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/e/1/B\"><num value=\"B\">(B)</num><content> experimental, model, and demonstration programs for testing innovative approaches and techniques which may improve the prompt and successful resolution of civil and criminal court proceedings or enhance the effectiveness of judicial and administrative action in child abuse and neglect cases, particularly child sexual abuse and exploitation cases, including the enhancement of performance of court-appointed attorneys and guardians ad litem for children, and which also ensure procedural fairness to the accused; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6df722-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/e/1/C\"><num value=\"C\">(C)</num><content> reform of State laws, ordinances, regulations, protocols, and procedures to provide comprehensive protection for children, which may include those children involved in reports of child abuse or neglect with a potential combination of jurisdictions, such as intrastate, interstate, Federal-State, and State-Tribal, from child abuse and neglect, including child sexual abuse and exploitation, while ensuring fairness to all affected persons.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab6df723-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Exemption</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">As determined by the Secretary, a State shall be considered to be in fulfillment of the requirements of this subsection if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6df724-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/e/2/A\"><num value=\"A\">(A)</num><content> the State adopts an alternative to the recommendations of the State task force, which carries out the purpose of this section, in each of the categories under paragraph (1) for which the State task force’s recommendations are not adopted; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab6df725-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/e/2/B\"><num value=\"B\">(B)</num><content> the State is making substantial progress toward adopting recommendations of the State task force or a comparable alternative to such recommendations.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab6df726-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5106c/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Funds available</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For grants under this section, the Secretary shall use the amount authorized by <ref href=\"/us/usc/t34/s20104\">section 20104 of title 34</ref>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idab6df727-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/93/247/tI/s107\">Pub.
