<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idab6e6c5b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5106d"><num value="5106d">§ 5106d.</num><heading> Miscellaneous requirements relating to assistance</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab6e6c5c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5106d/a"><num value="a" class="bold">(a)</num><heading class="bold"> Construction of facilities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idab6e6c5d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5106d/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Restriction on use of funds</heading><content><p style="-uslm-lc:I12" class="indent1">Assistance provided under this subchapter and subchapter III may not be used for construction of facilities.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idab6e6c5e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5106d/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Lease, rental, or repair</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary may authorize the use of funds received under this subchapter and subchapter III—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab6e6c5f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5106d/a/2/A"><num value="A">(A)</num><content> where adequate facilities are not otherwise available, for the lease or rental of facilities; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab6e6c60-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5106d/a/2/B"><num value="B">(B)</num><content> for the repair or minor remodeling or alteration of existing facilities.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab6e6c61-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5106d/b"><num value="b" class="bold">(b)</num><heading class="bold"> Geographical distribution</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall establish criteria designed to achieve equitable distribution of assistance under this subchapter and subchapter III among the States, among geographic areas of the Nation, and among rural and urban areas of the Nation. To the extent possible, the Secretary shall ensure that the citizens of each State receive assistance from at least one project under this subchapter and subchapter III.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab6e6c62-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5106d/c"><num value="c" class="bold">(c)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I11" class="indent0">No funds appropriated for any grant or contract pursuant to authorizations made in this subchapter and subchapter III may be used for any purpose other than that for which such funds were authorized to be appropriated.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab6e6c63-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5106d/d"><num value="d" class="bold">(d)</num><heading class="bold"> Sense of Congress</heading><chapeau style="-uslm-lc:I11" class="indent0">It is the sense of Congress that the Secretary should encourage all States and public and private entities that receive assistance under this subchapter to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab6e6c64-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5106d/d/1"><num value="1">(1)</num><content> ensure that children and families with limited English proficiency who participate in programs under this subchapter are provided with materials and services through such programs in an appropriate language other than English; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab6eba85-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5106d/d/2"><num value="2">(2)</num><content> ensure that individuals with disabilities who participate in programs under this subchapter are provided with materials and services through such programs that are appropriate to their disabilities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab6eba86-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5106d/e"><num value="e" class="bold">(e)</num><heading class="bold"> Annual report</heading><content><p style="-uslm-lc:I11" class="indent0">A State that receives funds under <ref href="/us/usc/t42/s5106a/a">section 5106a(a) of this title</ref> shall annually prepare and submit to the Secretary a report describing the manner in which funds provided under this subchapter and subchapter III, alone or in combination with other Federal funds, were used to address the purposes and achieve the objectives of <ref href="/us/usc/t42/s5106a">section 5106a of this title</ref>.</p>
