L. 100–707, title I, § 104, Nov. 23, 1988, 102 Stat. 4690.)","seq_in_title":4343,"parent_identifier":"/us/usc/t42/ch68/schII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch68","level":"chapter","num":"CHAPTER 68—","heading":"DISASTER RELIEF","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch68/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"DISASTER PREPAREDNESS AND MITIGATION ASSISTANCE","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idab783063-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131\"><num value=\"5131\">§ 5131.</num><heading> Federal and State disaster preparedness programs</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab783064-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Utilization of services of other agencies</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The President is authorized to establish a program of disaster preparedness that utilizes services of all appropriate agencies and includes—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab783065-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/a/1\"><num value=\"1\">(1)</num><content> preparation of disaster preparedness plans for mitigation, warning, emergency operations, rehabilitation, and recovery;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab783066-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/a/2\"><num value=\"2\">(2)</num><content> training and exercises;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab783067-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/a/3\"><num value=\"3\">(3)</num><content> postdisaster critiques and evaluations;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab783068-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/a/4\"><num value=\"4\">(4)</num><content> annual review of programs;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab783069-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/a/5\"><num value=\"5\">(5)</num><content> coordination of Federal, State, and local preparedness programs;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab78306a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/a/6\"><num value=\"6\">(6)</num><content> application of science and technology;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab78306b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/a/7\"><num value=\"7\">(7)</num><content> research.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab78306c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Technical assistance for the development of plans and programs</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The President shall provide technical assistance to the States in developing comprehensive plans and practicable programs for preparation against disasters, including hazard reduction, avoidance, and mitigation; for assistance to individuals, businesses, and State and local governments following such disasters; and for recovery of damaged or destroyed public and private facilities.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab78306d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Grants to States for development of plans and programs</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Upon application by a State, the President is authorized to make grants, not to exceed in the aggregate to such State $250,000, for the development of plans, programs, and capabilities for disaster preparedness and prevention. Such grants shall be applied for within one year from <date date=\"1974-05-22\">May 22, 1974</date>. Any State desiring financial assistance under this section shall designate or create an agency to plan and administer such a disaster preparedness program, and shall, through such agency, submit a State plan to the President, which shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab78577e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/c/1\"><num value=\"1\">(1)</num><content> set forth a comprehensive and detailed State program for preparation against and assistance following, emergencies and major disasters, including provisions for assistance to individuals, businesses, and local governments; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab78577f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/c/2\"><num value=\"2\">(2)</num><content> include provisions for appointment and training of appropriate staffs, formulation of necessary regulations and procedures and conduct of required exercises.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab785780-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5131/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Grants for improvement, maintenance, and updating of State plans</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The President is authorized to make grants not to exceed 50 per centum of the cost of improving, maintaining and updating State disaster assistance plans, including evaluations of natural hazards and development of the programs and actions required to mitigate such hazards; except that no such grant shall exceed $50,000 per annum to any State.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idab785781-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/93/288/tII/s201\">Pub.
