D, § 1222, Oct. 5, 2018, 132 Stat. 3454.)","seq_in_title":4354,"parent_identifier":"/us/usc/t42/ch68/schIII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch68","level":"chapter","num":"CHAPTER 68—","heading":"DISASTER RELIEF","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch68/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"MAJOR DISASTER AND EMERGENCY ASSISTANCE ADMINISTRATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idab7a2cd7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5149\"><num value=\"5149\">§ 5149.</num><heading> Performance of services</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab7a2cd8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5149/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Utilization of services or facilities of State and local governments</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In carrying out the purposes of this chapter, any Federal agency is authorized to accept and utilize the services or facilities of any State or local government, or of any agency, office, or employee thereof, with the consent of such government.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab7a2cd9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5149/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Appointment of temporary personnel, experts, and consultants; acquisition, rental, or hire of equipment, services, materials and supplies</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In performing any services under this chapter, any Federal agency is authorized—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7a2cda-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5149/b/1\"><num value=\"1\">(1)</num><content> to appoint and fix the compensation of such temporary personnel as may be necessary, without regard to the provisions of title 5 governing appointments in competitive service;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7a2cdb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5149/b/2\"><num value=\"2\">(2)</num><content> to employ experts and consultants in accordance with the provisions of section 3109 of such title, without regard to the provisions of chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule pay rates; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7a53ec-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5149/b/3\"><num value=\"3\">(3)</num><content> to incur obligations on behalf of the United States by contract or otherwise for the acquisition, rental, or hire of equipment, services, materials, and supplies for shipping, drayage, travel, and communications, and for the supervision and administration of such activities. Such obligations, including obligations arising out of the temporary employment of additional personnel, may be incurred by an agency in such amount as may be made available to it by the President.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab7a53ed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5149/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Appointment of temporary personnel in the Federal Emergency Management Agency</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Administrator of the Federal Emergency Management Agency is authorized to appoint temporary personnel, after serving continuously for 3 years, to positions in the Federal Emergency Management Agency in the same manner that competitive service employees with competitive status are considered for transfer, reassignment, or promotion to such positions.
