L. 106–390, title II, § 201, Oct. 30, 2000, 114 Stat. 1559.)","seq_in_title":4359,"parent_identifier":"/us/usc/t42/ch68/schIII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch68","level":"chapter","num":"CHAPTER 68—","heading":"DISASTER RELIEF","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch68/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"MAJOR DISASTER AND EMERGENCY ASSISTANCE ADMINISTRATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8dbf2c4b-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s5154\"><num value=\"5154\">§ 5154.</num><heading> Insurance</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8dbf2c4c-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s5154/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Applicants for replacement of damaged facilities</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8dbf2c4d-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s5154/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Compliance with certain regulations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An applicant for assistance under <ref href=\"/us/usc/t42/s5172\">section 5172 of this title</ref> (relating to repair, restoration, and replacement of damaged facilities), <ref href=\"/us/usc/t42/s5189\">section 5189 of this title</ref> (relating to simplified procedure) or <ref href=\"/us/usc/t42/s3149/c/2\">section 3149(c)(2) of this title</ref> shall comply with regulations prescribed by the President to assure that, with respect to any property to be replaced, restored, repaired, or constructed with such assistance, such types and extent of insurance will be obtained and maintained as may be reasonably available, adequate, and necessary, to protect against future loss to such property.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8dbf2c4e-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s5154/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Determination</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In making a determination with respect to availability, adequacy, and necessity under paragraph (1), the President shall not require greater types and extent of insurance than are certified to him as reasonable by the appropriate State insurance commissioner responsible for regulation of such insurance.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8dbf2c4f-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s5154/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Maintenance of insurance</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No applicant for assistance under <ref href=\"/us/usc/t42/s5172\">section 5172 of this title</ref> (relating to repair, restoration, and replacement of damaged facilities), <ref href=\"/us/usc/t42/s5189\">section 5189 of this title</ref> (relating to simplified procedure), or <ref href=\"/us/usc/t42/s3149/c/2\">section 3149(c)(2) of this title</ref> may receive such assistance for any property or part thereof for which the applicant has previously received assistance under this chapter unless all insurance required pursuant to this section has been obtained and maintained with respect to such property. The requirements of this subsection may not be waived under <ref href=\"/us/usc/t42/s5141\">section 5141 of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8dbf2c50-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s5154/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> State acting as self-insurer</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">A State may elect to act as a self-insurer with respect to any or all of the facilities owned by the State. Such an election, if declared in writing at the time of acceptance of assistance under section 5172 or 5189 of this title or <ref href=\"/us/usc/t42/s3149/c/2\">section 3149(c)(2) of this title</ref> or subsequently and accompanied by a plan for self-insurance which is satisfactory to the President, shall be deemed compliance with subsection (a).
