<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idab7c767b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165"><num value="5165">§ 5165.</num><heading> Mitigation planning</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab7c767c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/a"><num value="a" class="bold">(a)</num><heading class="bold"> Requirement of mitigation plan</heading><content><p style="-uslm-lc:I11" class="indent0">As a condition of receipt of an increased Federal share for hazard mitigation measures under subsection (e), a State, local, or tribal government shall develop and submit for approval to the President a mitigation plan that outlines processes for identifying the natural hazards, risks, and vulnerabilities of the area under the jurisdiction of the government.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab7c767d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/b"><num value="b" class="bold">(b)</num><heading class="bold"> Local and tribal plans</heading><chapeau style="-uslm-lc:I11" class="indent0">Each mitigation plan developed by a local or tribal government shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab7c767e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/b/1"><num value="1">(1)</num><content> describe actions to mitigate hazards, risks, and vulnerabilities identified under the plan; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab7c767f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/b/2"><num value="2">(2)</num><content> establish a strategy to implement those actions.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab7c7680-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/c"><num value="c" class="bold">(c)</num><heading class="bold"> State plans</heading><chapeau style="-uslm-lc:I11" class="indent0">The State process of development of a mitigation plan under this section shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab7c7681-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/c/1"><num value="1">(1)</num><content> identify the natural hazards, risks, and vulnerabilities of areas in the State;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab7c7682-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/c/2"><num value="2">(2)</num><content> support development of local mitigation plans;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab7c7683-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/c/3"><num value="3">(3)</num><content> provide for technical assistance to local and tribal governments for mitigation planning; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab7c7684-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/c/4"><num value="4">(4)</num><content> identify and prioritize mitigation actions that the State will support, as resources become available.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab7c7685-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/d"><num value="d" class="bold">(d)</num><heading class="bold"> Funding</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idab7c7686-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Federal contributions under <ref href="/us/usc/t42/s5170c">section 5170c of this title</ref> may be used to fund the development and updating of mitigation plans under this section.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idab7c7687-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Maximum Federal contribution</heading><content><p style="-uslm-lc:I12" class="indent1">With respect to any mitigation plan, a State, local, or tribal government may use an amount of Federal contributions under <ref href="/us/usc/t42/s5170c">section 5170c of this title</ref> not to exceed 7 percent of the amount of such contributions available to the government as of a date determined by the government.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab7c7688-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/e"><num value="e" class="bold">(e)</num><heading class="bold"> Increased Federal share for hazard mitigation measures</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idab7c7689-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">If, at the time of the declaration of a major disaster or event under <ref href="/us/usc/t42/s5187">section 5187 of this title</ref>, a State has in effect an approved mitigation plan under this section, the President may increase to 20 percent, with respect to the major disaster or event under <ref href="/us/usc/t42/s5187">section 5187 of this title</ref>, the maximum percentage specified in the last sentence of <ref href="/us/usc/t42/s5170c/a">section 5170c(a) of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idab7c768a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Factors for consideration</heading><chapeau style="-uslm-lc:I12" class="indent1">In determining whether to increase the maximum percentage under paragraph (1), the President shall consider whether the State has established—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab7c768b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/e/2/A"><num value="A">(A)</num><content> eligibility criteria for property acquisition and other types of mitigation measures;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab7c768c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/e/2/B"><num value="B">(B)</num><content> requirements for cost effectiveness that are related to the eligibility criteria;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab7c768d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/e/2/C"><num value="C">(C)</num><content> a system of priorities that is related to the eligibility criteria; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab7c768e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5165/e/2/D"><num value="D">(D)</num><content> a process by which an assessment of the effectiveness of a mitigation action may be carried out after the mitigation action is complete.</content>
