The extra comma probably should follow “medicine”.</note> food, and other consumable supplies, and other services and assistance to disaster victims.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7ee74d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Work and services to save lives and protect property</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Performing on public or private lands or waters any work or services essential to saving lives and protecting and preserving property or public health and safety, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7ee74e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3/A\"><num value=\"A\">(A)</num><content> debris removal;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7ee74f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3/B\"><num value=\"B\">(B)</num><content> search and rescue, emergency medical care, emergency mass care, emergency shelter, and provision of food, water, medicine durable medical equipment,,<sup>1</sup> and other essential needs, including movement of supplies or persons;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7ee750-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3/C\"><num value=\"C\">(C)</num><content> clearance of roads and construction of temporary bridges necessary to the performance of emergency tasks and essential community services;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7ee751-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3/D\"><num value=\"D\">(D)</num><content> provision of temporary facilities for schools and other essential community services;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7ee752-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3/E\"><num value=\"E\">(E)</num><content> demolition of unsafe structures which endanger the public;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7ee753-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3/F\"><num value=\"F\">(F)</num><content> warning of further risks and hazards;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7ee754-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3/G\"><num value=\"G\">(G)</num><content> dissemination of public information and assistance regarding health and safety measures;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7ee755-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3/H\"><num value=\"H\">(H)</num><content> provision of technical advice to State and local governments on disaster management and control;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7ee756-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3/I\"><num value=\"I\">(I)</num><content> reduction of immediate threats to life, property, and public health and safety; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7ee757-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3/J\"><num value=\"J\">(J)</num><chapeau> provision of rescue, care, shelter, and essential needs—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idab7ee758-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3/J/i\"><num value=\"i\">(i)</num><content> to individuals with household pets and service animals; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idab7ee759-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/3/J/ii\"><num value=\"ii\">(ii)</num><content> to such pets and animals.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7ee75a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/a/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Contributions</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Making contributions to State or local governments or owners or operators of private nonprofit facilities for the purpose of carrying out the provisions of this subsection.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab7ee75b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Federal share</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Federal share of assistance under this section shall be not less than 75 percent of the eligible cost of such assistance.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab7ee75c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Utilization of DOD resources</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7ee75d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> General rule</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">During the immediate aftermath of an incident which may ultimately qualify for assistance under this subchapter or subchapter IV-A of this chapter, the Governor of the State in which such incident occurred may request the President to direct the Secretary of Defense to utilize the resources of the Department of Defense for the purpose of performing on public and private lands any emergency work which is made necessary by such incident and which is essential for the preservation of life and property. If the President determines that such work is essential for the preservation of life and property, the President shall grant such request to the extent the President determines practicable. Such emergency work may only be carried out for a period not to exceed 10 days.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f0e6e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Rules applicable to debris removal</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any removal of debris and wreckage carried out under this subsection shall be subject to <ref href=\"/us/usc/t42/s5173/b\">section 5173(b) of this title</ref>, relating to unconditional authorization and indemnification for debris removal.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f0e6f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Expenditures out of disaster relief funds</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The cost of any assistance provided pursuant to this subsection shall be reimbursed out of funds made available to carry out this chapter.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f0e70-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/c/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Federal share</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Federal share of assistance under this subsection shall be not less than 75 percent.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f0e71-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/c/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Guidelines</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 180 days after <date date=\"1988-11-23\">November 23, 1988</date>, the President shall issue guidelines for carrying out this subsection. Such guidelines shall consider any likely effect assistance under this subsection will have on the availability of other forms of assistance under this chapter.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f0e72-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/c/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">For purposes of this section—</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idab7f0e73-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/c/6/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Department of Defense</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “Department of Defense” has the meaning the term “department” has under <ref href=\"/us/usc/t10/s101\">section 101 of title 10</ref>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idab7f0e74-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/c/6/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Emergency work</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “emergency work” includes clearance and removal of debris and wreckage and temporary restoration of essential public facilities and services.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab7f0e75-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Salaries and benefits</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f0e76-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">If the President declares a major disaster or emergency for an area within the jurisdiction of a State, tribal, or local government, the President may reimburse the State, tribal, or local government for costs relating to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7f0e77-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/d/1/A\"><num value=\"A\">(A)</num><chapeau> basic pay and benefits for permanent employees of the State, tribal, or local government conducting emergency protective measures under this section, if—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idab7f0e78-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/d/1/A/i\"><num value=\"i\">(i)</num><content> the work is not typically performed by the employees; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idab7f0e79-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/d/1/A/ii\"><num value=\"ii\">(ii)</num><content> the type of work may otherwise be carried out by contract or agreement with private organizations, firms, or individuals.; <ref class=\"footnoteRef\" idref=\"fn003330\">2</ref><note type=\"footnote\" id=\"fn003330\"><num>2</num> So in original.</note> or</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7f0e7a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/d/1/B\"><num value=\"B\">(B)</num><content> overtime and hazardous duty compensation for permanent employees of the State, tribal, or local government conducting emergency protective measures under this section.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f0e7b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Overtime</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The guidelines for reimbursement for costs under paragraph (1) shall ensure that no State, tribal, or local government is denied reimbursement for overtime payments that are required pursuant to the Fair Labor Standards Act of 1938 (<ref href=\"/us/usc/t29/s201\">29 U.S.C. 201</ref> et seq.).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f358c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170b/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> No effect on mutual aid pacts</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Nothing in this subsection shall affect the ability of the President to reimburse labor force expenses provided pursuant to an authorized mutual aid pact.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idab7f358d-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/93/288/tIV/s403\">Pub.
