Such measures shall be identified following the evaluation of natural hazards under <ref href=\"/us/usc/t42/s5165\">section 5165 of this title</ref> and shall be subject to approval by the President. Subject to <ref href=\"/us/usc/t42/s5165\">section 5165 of this title</ref>, the total of contributions under this section for a major disaster or event under <ref href=\"/us/usc/t42/s5187\">section 5187 of this title</ref> shall not exceed 15 percent for amounts not more than $2,000,000,000, 10 percent for amounts of more than $2,000,000,000 and not more than $10,000,000,000, and 7.5 percent on amounts of more than $10,000,000,000 and not more than $35,333,000,000 of the estimated aggregate amount of grants to be made (less any associated administrative costs) under this chapter with respect to the major disaster or event under <ref href=\"/us/usc/t42/s5187\">section 5187 of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab7f5ca5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Property acquisition and relocation assistance</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f5ca6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> General authority</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In providing hazard mitigation assistance under this section in connection with flooding, the Administrator of the Federal Emergency Management Agency may provide property acquisition and relocation assistance for projects that meet the requirements of paragraph (2).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f5ca7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Terms and conditions</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">An acquisition or relocation project shall be eligible to receive assistance pursuant to paragraph (1) only if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7f5ca8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/2/A\"><num value=\"A\">(A)</num><content> the applicant for the assistance is otherwise eligible to receive assistance under the hazard mitigation grant program established under subsection (a); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7f5ca9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/2/B\"><num value=\"B\">(B)</num><chapeau> on or after <date date=\"1993-12-03\">December 3, 1993</date>, the applicant for the assistance enters into an agreement with the Administrator that provides assurances that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idab7f5caa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/2/B/i\"><num value=\"i\">(i)</num><content> any property acquired, accepted, or from which a structure will be removed pursuant to the project will be dedicated and maintained in perpetuity for a use that is compatible with open space, recreational, or wetlands management practices;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idab7f5cab-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/2/B/ii\"><num value=\"ii\">(ii)</num><chapeau> no new structure will be erected on property acquired, accepted or from which a structure was removed under the acquisition or relocation program other than—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idab7f5cac-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/2/B/ii/I\"><num value=\"I\">(I)</num><content> a public facility that is open on all sides and functionally related to a designated open space;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idab7f5cad-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/2/B/ii/II\"><num value=\"II\">(II)</num><content> a rest room; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idab7f5cae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/2/B/ii/III\"><num value=\"III\">(III)</num><content> a structure that the Administrator approves in writing before the commencement of the construction of the structure; and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idab7f5caf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/2/B/iii\"><num value=\"iii\">(iii)</num><chapeau> after receipt of the assistance, with respect to any property acquired, accepted or from which a structure was removed under the acquisition or relocation program—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idab7f5cb0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/2/B/iii/I\"><num value=\"I\">(I)</num><content> no subsequent application for additional disaster assistance for any purpose will be made by the recipient to any Federal entity; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idab7f5cb1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/2/B/iii/II\"><num value=\"II\">(II)</num><content> no assistance referred to in subclause (I) will be provided to the applicant by any Federal source.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f5cb2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Statutory construction</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Nothing in this subsection is intended to alter or otherwise affect an agreement for an acquisition or relocation project carried out pursuant to this section that was in effect on the day before <date date=\"1993-12-03\">December 3, 1993</date>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab7f5cb3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Program administration by States</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f83c4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A State desiring to administer the hazard mitigation grant program established by this section with respect to hazard mitigation assistance in the State may submit to the President an application for the delegation of the authority to administer the program.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f83c5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Criteria</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The President, in consultation and coordination with States and local governments, shall establish criteria for the approval of applications submitted under paragraph (1). Until such time as the Administrator promulgates regulations to implement this paragraph, the Administrator may waive notice and comment rulemaking, if the Administrator determines doing so is necessary to expeditiously implement this section, and may carry out this section as a pilot program. The criteria shall include, at a minimum—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7f83c6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/c/2/A\"><num value=\"A\">(A)</num><content> the demonstrated ability of the State to manage the grant program under this section;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7f83c7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/c/2/B\"><num value=\"B\">(B)</num><content> there being in effect an approved mitigation plan under <ref href=\"/us/usc/t42/s5165\">section 5165 of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7f83c8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/c/2/C\"><num value=\"C\">(C)</num><content> a demonstrated commitment to mitigation activities.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f83c9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Approval</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The President shall approve an application submitted under paragraph (1) that meets the criteria established under paragraph (2).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f83ca-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/c/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Withdrawal of approval</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If, after approving an application of a State submitted under paragraph (1), the President determines that the State is not administering the hazard mitigation grant program established by this section in a manner satisfactory to the President, the President shall withdraw the approval.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f83cb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/c/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Audits</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The President shall provide for periodic audits of the hazard mitigation grant programs administered by States under this subsection.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab7f83cc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Streamlined procedures</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f83cd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">For the purpose of providing assistance under this section, the President shall ensure that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7f83ce-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/d/1/A\"><num value=\"A\">(A)</num><content> adequate resources are devoted to ensure that applicable environmental reviews under the National Environmental Policy Act of 1969 [<ref href=\"/us/usc/t42/s4321\">42 U.S.C. 4321</ref> et seq.] and historic preservation reviews under the National Historic Preservation Act <ref class=\"footnoteRef\" idref=\"fn003331\">1</ref><note type=\"footnote\" id=\"fn003331\"><num>1</num> See References in Text note below.</note> are completed on an expeditious basis; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab7f83cf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/d/1/B\"><num value=\"B\">(B)</num><content> the shortest existing applicable process under the National Environmental Policy Act of 1969 [<ref href=\"/us/usc/t42/s4321\">42 U.S.C. 4321</ref> et seq.] and the National Historic Preservation Act <sup>1</sup> is utilized.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idab7f83d0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Authority for other expedited procedures</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The President may utilize expedited procedures in addition to those required under paragraph (1) for the purpose of providing assistance under this section, such as procedures under the Prototype Programmatic Agreement of the Federal Emergency Management Agency, for the consideration of multiple structures as a group and for an analysis of the cost-effectiveness and fulfillment of cost-share requirements for proposed hazard mitigation measures.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab7faae1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Advance assistance</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The President may provide not more than 25 percent of the amount of the estimated cost of hazard mitigation measures to a State grantee eligible for a grant under this section before eligible costs are incurred.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab7faae2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Use of assistance</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Recipients of hazard mitigation assistance provided under this section and <ref href=\"/us/usc/t42/s5133\">section 5133 of this title</ref> may use the assistance to conduct activities to help reduce the risk of future damage, hardship, loss, or suffering in any area affected by a wildfire or windstorm, such as—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faae3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/1\"><num value=\"1\">(1)</num><content> reseeding ground cover with quick-growing or native species;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faae4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/2\"><num value=\"2\">(2)</num><content> mulching with straw or chipped wood;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faae5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/3\"><num value=\"3\">(3)</num><content> constructing straw, rock, or log dams in small tributaries to prevent flooding;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faae6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/4\"><num value=\"4\">(4)</num><content> placing logs and other erosion barriers to catch sediment on hill slopes;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faae7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/5\"><num value=\"5\">(5)</num><content> installing debris traps to modify road and trail drainage mechanisms;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faae8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/6\"><num value=\"6\">(6)</num><content> modifying or removing culverts to allow drainage to flow freely;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faae9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/7\"><num value=\"7\">(7)</num><content> adding drainage dips and constructing emergency spillways to keep roads and bridges from washing out during floods;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faaea-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/8\"><num value=\"8\">(8)</num><content> planting grass to prevent the spread of noxious weeds;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faaeb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/9\"><num value=\"9\">(9)</num><content> installing warning signs;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faaec-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/10\"><num value=\"10\">(10)</num><content> establishing defensible space measures;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faaed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/11\"><num value=\"11\">(11)</num><content> reducing hazardous fuels;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faaee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/12\"><num value=\"12\">(12)</num><content> mitigating windstorm damage, including replacing or installing electrical transmission or distribution utility pole structures with poles that are resilient to extreme wind and combined ice and wind loadings for the basic wind speeds and ice conditions associated with the relevant location;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faaef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/13\"><num value=\"13\">(13)</num><content> removing standing burned trees; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab7faaf0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/f/14\"><num value=\"14\">(14)</num><content> replacing water systems that have been burned and have caused contamination.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab7faaf1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5170c/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Use of assistance for earthquake hazards</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Recipients of hazard mitigation assistance provided under this section and <ref href=\"/us/usc/t42/s5133\">section 5133 of this title</ref> may use the assistance to conduct activities to help reduce the risk of future damage, hardship, loss, or suffering in any area affected by earthquake hazards, including—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" Stafford Disaster Relief and Emergency Assistance Act (<ref href=\"/us/usc/t42/s5155\">42 U.S.C. 5155</ref>) and its implementing regulations, assistance provided pursuant to section 404 of such Act [<ref href=\"/us/usc/t42/s5170c\">42 U.S.C. 5170c</ref>] may be used to fund activities authorized for construction within the scope of a federally authorized water resources development project of the Army Corps of Engineers if such activities are also eligible activities under such section.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Federal funding</inline>.—</heading><content>All Federal funding provided under section 404 pursuant to this section shall be applied toward the Federal share of such project.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Non-federal match</inline>.—</heading><content>All non-Federal matching funds required under section 404 pursuant to this section shall be applied toward the non-Federal share of such project.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Total federal share</inline>.—</heading><content>Funding provided under section 404 pursuant to this section may not exceed the total Federal share for such project.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"5\">“(5)</num><heading> <inline class=\"small-caps\">No effect</inline>.—</heading><chapeau>Nothing in this section shall—</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><content> affect the cost-share requirement of a hazard mitigation measure under section 404;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><content> affect the eligibility criteria for a hazard mitigation measure under section 404;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"C\">“(C)</num><content> affect the cost share requirements of a federally authorized water resources development project; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"D\">“(D)</num><content> affect the responsibilities of a non-Federal interest with respect to the project, including those related to the provision of lands, easements, rights-of-way, dredge material disposal areas, and necessary relocations.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"6\">“(6)</num><heading> <inline class=\"small-caps\">Limitation</inline>.—</heading><content>If a federally authorized water resources development project of the Army Corps of Engineers is constructed with funding provided under section 404 pursuant to this subsection, no further Federal funding shall be provided for construction of such project.”</content>\n</paragraph>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idab80202f-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Guidance on Hazard Mitigation Assistance</heading><p><ref href=\"/us/pl/115/254/dD/s1231\">Pub. L. 115–254, div. D, § 1231</ref>, <date date=\"2018-10-05\">Oct. 5, 2018</date>, <ref href=\"/us/stat/132/3459\">132 Stat. 3459</ref>, provided that:<quotedContent origin=\"/us/pl/115/254/dD/s1231\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this Act [<date date=\"2018-10-05\">Oct. 5, 2018</date>], the Administrator [of the Federal Emergency Management Agency] shall issue guidance regarding the acquisition of property for open space as a mitigation measure under section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href=\"/us/usc/t42/s5170c\">42 U.S.C. 5170c</ref>) that includes—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><chapeau> a process by which the State hazard mitigation officer appointed for such an acquisition shall, not later than 60 days after the applicant for assistance enters into an agreement with the Administrator regarding the acquisition, provide written notification to each affected unit of local government for such acquisition that includes—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the location of the acquisition;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> the State-local assistance agreement for the hazard mitigation grant program;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> a description of the acquisition; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> a copy of the deed restriction; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><chapeau> recommendations for entering into and implementing a memorandum of understanding between units of local government and covered entities that includes provisions to allow an affected unit of local government notified under paragraph (1) to—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> use and maintain the open space created by such a project, consistent with section 404 [<ref href=\"/us/usc/t42/s5170c\">42 U.S.C. 5170c</ref>] (including related regulations, standards, and guidance) and consistent with all adjoining property, subject to the notification of the adjoining property, so long as the cost of the maintenance is borne by the local government; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> maintain the open space pursuant to standards exceeding any local government standards defined in the agreement with the Administrator described under paragraph (1).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Affected unit of local government</inline>.—</heading><content>The term ‘affected unit of local government’ means any entity covered by the definition of local government in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href=\"/us/usc/t42/s5122\">42 U.S.C. 5122</ref>), that has jurisdiction over the property subject to the acquisition described in subsection (a).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Covered entity</inline>.—</heading><chapeau>The term ‘covered entity’ means—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the grantee or subgrantee receiving assistance for an open space project described in subsection (a);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> the State in which such project is located; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> the applicable Regional Administrator of the Agency.”</content>\n</subparagraph>\n</paragraph>\n</subsection>\n</quotedContent>\n</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">[For definition of “State” as used in <ref href=\"/us/pl/115/254/s1231\">section 1231 of Pub.
