<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idab83c9c6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5174b"><num value="5174b">§ 5174b.</num><heading> Critical document fee waiver</heading><paragraph style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab83c9c7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5174b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">Notwithstanding <ref href="/us/usc/t22/s214">section 214 of title 22</ref> or any other provision of law, the President, in consultation with the Governor of a State, may provide a waiver under this subsection to an individual or household described in <ref href="/us/usc/t42/s5174/e/1">section 5174(e)(1) of this title</ref> for the following document replacement fees:</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idab83c9c8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5174b/1/A"><num value="A">(A)</num><content> The passport application fee for individuals who lost their United States passport in a major disaster within the preceding three calendar years.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idab83c9c9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5174b/1/B"><num value="B">(B)</num><content> The file search fee for a United States passport.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idab83c9ca-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5174b/1/C"><num value="C">(C)</num><content> The Application for Waiver of Passport and/or Visa form (Form I–193) fee.</content>

<subparagraph style="-uslm-lc:I12" class="indent1" id="idab83c9cb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5174b/1/D"><num value="D">(D)</num><content> The Permanent Resident Card replacement form (Form I–90) filing fee.</content>

<subparagraph style="-uslm-lc:I12" class="indent1" id="idab83c9cf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5174b/1/H"><num value="H">(H)</num><content> The biometric service fee.</content>

<paragraph style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab83c9d0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5174b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Exemption from form requirement</heading><content><p style="-uslm-lc:I11" class="indent0">The authority of the President to waive fees under subparagraphs (C) through (H) of paragraph (1) applies regardless of whether the individual or household qualifies for a Form I–912 Request for Fee Waiver, or any successor thereto.</p>

<paragraph style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab83efe2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5174b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 365 days after <date date="2018-10-05">October 5, 2018</date>, the Administrator and the head of any other agency given critical document fee waiver authority under this subsection shall submit a report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives on the costs associated with providing critical document fee waivers as described in paragraph (1).</p>

<p style="-uslm-lc:I21" class="indent0">(1) delegate to the Secretary of State the functions and authorities vested in the President by sections 1238(a)(1)(A)–(B) of the FAA Reauthorization Act of 2018 (<ref href="/us/pl/115/254">Public Law 115–254</ref>) [<ref href="/us/usc/t42/s5174b/a/1/A">42 U.S.C. 5174b(a)(1)(A)</ref>–(B)]; and</p>

<p style="-uslm-lc:I21" class="indent0">The delegations in this memorandum shall apply to any provisions of any future public law that are the same or substantially the same as the provisions referenced in this memorandum. The Secretary of State and the Secretary of Homeland Security may redelegate within their departments the functions and authorities delegated by this memorandum to the extent authorized by law.</p>
