P, title III, § 302, Mar. 23, 2018, 132 Stat. 1087.)","seq_in_title":4410,"parent_identifier":"/us/usc/t42/ch68/schIV","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch68","level":"chapter","num":"CHAPTER 68—","heading":"DISASTER RELIEF","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch68/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"MAJOR DISASTER ASSISTANCE PROGRAMS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idab861365-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e\"><num value=\"5189e\">§ 5189e.</num><heading> Essential service providers</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab861366-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Definition</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section, the term “essential service provider” means an entity that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab861367-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/1\"><num value=\"1\">(1)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab861368-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/1/A\"><num value=\"A\">(A)</num><chapeau> provides</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab861369-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/1/A/i\"><num value=\"i\">(i)</num><content> wireline or mobile telephone service, Internet access service, radio or television broadcasting, cable service, or direct broadcast satellite service;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab86136a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/1/A/ii\"><num value=\"ii\">(ii)</num><content> electrical power;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab86136b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/1/A/iii\"><num value=\"iii\">(iii)</num><content> natural gas;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab86136c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/1/A/iv\"><num value=\"iv\">(iv)</num><content> water and sewer services; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab86136d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/1/A/v\"><num value=\"v\">(v)</num><content> any other essential service, as determined by the President; or</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab86136e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/1/B\"><num value=\"B\">(B)</num><content> is a tower owner or operator;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab86136f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/2\"><num value=\"2\">(2)</num><chapeau> is—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab861370-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/2/A\"><num value=\"A\">(A)</num><content> a municipal entity;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab861371-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/2/B\"><num value=\"B\">(B)</num><content> a nonprofit entity; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab861372-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/2/C\"><num value=\"C\">(C)</num><content> a private, for profit entity; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab861373-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/a/3\"><num value=\"3\">(3)</num><content> is contributing to efforts to respond to an emergency or major disaster.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab861374-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Authorization for accessibility</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Unless exceptional circumstances apply, in an emergency or major disaster, the head of a Federal agency, to the greatest extent practicable, shall not—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab861375-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/b/1\"><num value=\"1\">(1)</num><content> deny or impede access to the disaster site to an essential service provider whose access is necessary to restore and repair an essential service; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab861376-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/b/2\"><num value=\"2\">(2)</num><content> impede the restoration or repair of the services described in subsection (a)(1).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idab861377-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5189e/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Implementation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In implementing this section, the head of a Federal agency shall follow all applicable Federal laws, regulations, and policies.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idab861378-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/93/288/tIV/s427\">Pub.
