<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idab86aff5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h"><num value="5189h">§ 5189h.</num><heading> Agency accountability</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab86aff6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/a"><num value="a" class="bold">(a)</num><heading class="bold"> Public assistance</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than 5 days after an award of a public assistance grant is made under <ref href="/us/usc/t42/s5172">section 5172 of this title</ref> that is in excess of $1,000,000, the Administrator of the Federal Emergency Management Agency shall publish on the website of the Federal Emergency Management Agency the specifics of each such grant award, including—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab86d707-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/a/1"><num value="1">(1)</num><content> identifying the Federal Emergency Management Agency Region;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab86d708-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/a/2"><num value="2">(2)</num><content> the disaster or emergency declaration number;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab86d709-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/a/3"><num value="3">(3)</num><content> the State, county, and applicant name;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab86d70a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/a/4"><num value="4">(4)</num><content> if the applicant is a private nonprofit organization;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab86d70b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/a/5"><num value="5">(5)</num><content> the damage category code;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab86d70c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/a/6"><num value="6">(6)</num><content> the amount of the Federal share obligated; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab86d70d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/a/7"><num value="7">(7)</num><content> the date of the award.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab86d70e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b"><num value="b" class="bold">(b)</num><heading class="bold"> Mission assignments</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idab86d70f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 5 days after the issuance of a mission assignment or mission assignment task order, the Administrator of the Federal Emergency Management Agency shall publish on the website of the Federal Emergency Management Agency any mission assignment or mission assignment task order to another Federal department or agency regarding a major disaster in excess of $1,000,000, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d710-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b/1/A"><num value="A">(A)</num><content> the name of the impacted State or Indian Tribe;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d711-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b/1/B"><num value="B">(B)</num><content> the disaster declaration for such State or Indian Tribe;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d712-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b/1/C"><num value="C">(C)</num><content> the assigned agency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d713-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b/1/D"><num value="D">(D)</num><content> the assistance requested;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d714-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b/1/E"><num value="E">(E)</num><content> a description of the disaster;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d715-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b/1/F"><num value="F">(F)</num><content> the total cost estimate;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d716-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b/1/G"><num value="G">(G)</num><content> the amount obligated;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d717-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b/1/H"><num value="H">(H)</num><content> the State or Indian tribal government cost share, if applicable;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d718-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b/1/I"><num value="I">(I)</num><content> the authority under which the mission assignment or mission assignment task order was directed; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d719-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b/1/J"><num value="J">(J)</num><content> if applicable, the date a State or Indian Tribe requested the mission assignment.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idab86d71a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Recording changes</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 10 days after the last day of each month until a mission assignment or mission assignment task order described in paragraph (1) is completed and closed out, the Administrator of the Federal Emergency Management Agency shall update any changes to the total cost estimate and the amount obligated.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab86d71b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c"><num value="c" class="bold">(c)</num><heading class="bold"> Disaster relief monthly report</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than 10 days after the first day of each month, the Administrator of the Federal Emergency Management Agency shall publish on the website of the Federal Emergency Management Agency reports, including a specific description of the methodology and the source data used in developing such reports, including—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab86d71c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/1"><num value="1">(1)</num><chapeau> an estimate of the amounts for the fiscal year covered by the President’s most recent budget pursuant to <ref href="/us/usc/t31/s1105/a">section 1105(a) of title 31</ref> including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d71d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/1/A"><num value="A">(A)</num><content> the unobligated balance of funds to be carried over from the prior fiscal year to the budget year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d71e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/1/B"><num value="B">(B)</num><content> the unobligated balance of funds to be carried over from the budget year to the budget year plus 1;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d71f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/1/C"><num value="C">(C)</num><content> the amount of obligations for noncatastrophic events for the budget year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d720-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/1/D"><num value="D">(D)</num><content> the amount of obligations for the budget year for catastrophic events delineated by event and by State;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d721-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/1/E"><num value="E">(E)</num><content> the total amount that has been previously obligated or will be required for catastrophic events delineated by event and by State for all prior years, the current fiscal year, the budget year, and each fiscal year thereafter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d722-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/1/F"><num value="F">(F)</num><content> the amount of previously obligated funds that will be recovered for the budget year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86d723-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/1/G"><num value="G">(G)</num><content> the amount that will be required for obligations for emergencies, as described in <ref href="/us/usc/t42/s5122/1">section 5122(1) of this title</ref>, major disasters, as described in <ref href="/us/usc/t42/s5122/2">section 5122(2) of this title</ref>, fire management assistance grants, as described in <ref href="/us/usc/t42/s5187">section 5187 of this title</ref>, surge activities, and disaster readiness and support activities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86fd34-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/1/H"><num value="H">(H)</num><content> the amount required for activities not covered under <ref href="/us/usc/t2/s901/b/2/D/iii">section 901(b)(2)(D)(iii) of title 2</ref>; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab86fd35-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/2"><num value="2">(2)</num><chapeau> an estimate or actual amounts, if available, of the following for the current fiscal year, which shall be submitted not later than the fifth day of each month, published by the Administrator of the Federal Emergency Management Agency on the website of the Federal Emergency Management Agency not later than the fifth day of each month:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab86fd36-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/2/A"><num value="A">(A)</num><content> A summary of the amount of appropriations made available by source, the transfers executed, the previously allocated funds recovered, and the commitments, allocations, and obligations made.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86fd37-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/2/B"><num value="B">(B)</num><chapeau> A table of disaster relief activity delineated by month, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idab86fd38-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/2/B/i"><num value="i">(i)</num><content> the beginning and ending balances;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idab86fd39-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/2/B/ii"><num value="ii">(ii)</num><content> the total obligations to include amounts obligated for fire assistance, emergencies, surge, and disaster support activities;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idab86fd3a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/2/B/iii"><num value="iii">(iii)</num><content> the obligations for catastrophic events delineated by event and by State; and</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86fd3d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/2/D"><num value="D">(D)</num><chapeau> The cost of the following categories of spending:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idab86fd3e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/c/2/D/i"><num value="i">(i)</num><content> Public assistance.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab86fd45-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/d"><num value="d" class="bold">(d)</num><heading class="bold"> Contracts</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idab86fd46-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Information</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 10 days after the first day of each month, the Administrator of the Federal Emergency Management Agency shall publish on the website of the Federal Emergency Management Agency the specifics of each contract in excess of $1,000,000 that the Federal Emergency Management Agency enters into, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab86fd47-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/d/1/A"><num value="A">(A)</num><content> the name of the party;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86fd48-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/d/1/B"><num value="B">(B)</num><content> the date the contract was awarded;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab86fd49-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/d/1/C"><num value="C">(C)</num><content> the amount and scope of the contract;</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idab86fd4d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Report</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 10 days after the last day of the fiscal year, the Administrator of the Federal Emergency Management Agency shall provide a report to the appropriate committees of Congress summarizing the following information for the preceding fiscal year:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab86fd4e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/d/2/A"><num value="A">(A)</num><content> The number of contracts awarded without competitive bidding.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab87245f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/d/2/B"><num value="B">(B)</num><content> The reasons why a competitive bidding process was not used.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab872460-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/d/2/C"><num value="C">(C)</num><content> The total amount of contracts awarded with no competitive bidding.</content>
</subparagraph>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idab872462-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/e"><num value="e" class="bold">(e)</num><heading class="bold"> Collection of public assistance recipient and subrecipient contracts</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idab872463-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 180 days after <date date="2018-10-05">October 5, 2018</date>, the Administrator of the Federal Emergency Management Agency shall initiate and maintain an effort to collect and store information, prior to the project closeout phase on any contract entered into by a public assistance recipient or subrecipient that through the base award, available options, or any subsequent modifications has an estimated value of more than $1,000,000 and is funded through section 5165b, 5170b, 5170c, 5172, 5173, 5189f, or 5192 of this title, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab872464-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/e/1/A"><num value="A">(A)</num><content> the disaster number, project worksheet number, and the category of work associated with each contract;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab872465-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/e/1/B"><num value="B">(B)</num><content> the name of each party;</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idab87246c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s5189h/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 365 days after <date date="2018-10-05">October 5, 2018</date>, the Administrator of the Federal Emergency Management Agency shall submit a report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives on the efforts of the Federal Emergency Management Agency to collect the information described in paragraph (1).</p>
