L. 108–186, title V, § 501(f), Dec. 16, 2003, 117 Stat. 2697.)","seq_in_title":4456,"parent_identifier":"/us/usc/t42/ch69","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch69","level":"chapter","num":"CHAPTER 69—","heading":"COMMUNITY DEVELOPMENT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idaba2c293-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307\"><num value=\"5307\">§ 5307.</num><heading> Special purpose grants</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaba2c294-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Set-aside</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaba2c295-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">For each fiscal year (except as otherwise provided in this paragraph), of the total amount provided in appropriation Acts under <ref href=\"/us/usc/t42/s5303\">section 5303 of this title</ref> for the fiscal year, $60,000,000 shall be set aside for grants under subsection (b) for such year for the following purposes:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaba2c296-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/a/1/A\"><num value=\"A\">(A)</num><content> $6,500,000 shall be available for grants under subsection (b)(3) <ref class=\"footnoteRef\" idref=\"fn003350\">1</ref><note type=\"footnote\" id=\"fn003350\"><num>1</num> See References in Text note below.</note>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaba2e9a7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/a/1/B\"><num value=\"B\">(B)</num><content> $6,000,000 shall be available for grants under subsection (b)(5) <sup>1</sup>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaba2e9a8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/a/1/C\"><num value=\"C\">(C)</num><content> $6,000,000 shall be available in fiscal year 1993 for grants under subsection (b)(7) <sup>1</sup>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaba2e9a9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/a/1/D\"><num value=\"D\">(D)</num><content> $3,000,000 shall be available for grants under subsection (c);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaba2e9aa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/a/1/E\"><num value=\"E\">(E)</num><content> such sums as may be necessary shall be available for grants under paragraphs (2), (4), and (6) <sup>1</sup> of subsection (b);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaba2e9ab-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/a/1/F\"><num value=\"F\">(F)</num><content> $2,000,000 shall be available in fiscal year 1993 for a grant to the City of Bridgeport, Connecticut, subject to the approval of sufficient amounts in an appropriation Act and to binding commitments made by the City of Bridgeport and the State of Connecticut that the city and State, respectively, will supplement such amount with $2,000,000 of additional funds; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaba2e9ac-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/a/1/G\"><num value=\"G\">(G)</num><content> $7,500,000 shall be available to carry out the Community Outreach Partnership Act of 1992.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaba2e9ad-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Treatment of grants</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any grants made under this section shall be in addition to any other grants that may be made under this chapter to the same entities for the same purposes.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaba2e9ae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Permissible uses of funds</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">From amounts set aside under subsection (a), the Secretary is authorized to make grants—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaba2e9af-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/b/1\"><num value=\"1\">(1)</num><content> to States and units of general local government for the purpose of allocating amounts to any such State or unit of general local government that is determined by the Secretary to have received insufficient amounts under <ref href=\"/us/usc/t42/s5306\">section 5306 of this title</ref> as a result of a miscalculation of its share of funds under such section;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaba2e9b0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/b/2\"><num value=\"2\">(2)</num><content> to historically Black colleges;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaba2e9b1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/b/3\"><num value=\"3\">(3)</num><content> to States, units of general local government, Indian tribes, or areawide planning organizations for the purpose of providing technical assistance in planning, developing, and administering assistance under this chapter and section 1706e <sup>1</sup> of title 12; to groups designated by such governmental units to assist them in carrying out assistance under this chapter; to qualified groups for the purpose of assisting more than one such governmental unit to carry out assistance under this chapter; the Secretary may also provide technical assistance, directly or through contracts, to such governmental units and groups; for purposes of this paragraph the term “technical assistance” means the facilitating of skills and knowledge in planning, developing, and administering activities under this chapter in entities that may need but do not possess such skills and knowledge, and includes assessing programs and activities under this chapter; except that any recipient of a grant under this paragraph that provides technical assistance pursuant to this paragraph shall provide for the notification of the availability of such assistance and shall have specific criteria for selection of recipients of such assistance that are published and publicly available;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaba2e9b2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/b/4\"><num value=\"4\">(4)</num><content> to States and units of general local government and institutions of higher education having a demonstrated capacity to carry out eligible activities under this chapter, except that the Secretary may make a grant under this paragraph only to a State or unit of general local government that jointly, with an institution of higher education, has prepared and submitted to the Secretary an application for such grant, as the Secretary shall by regulation require;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaba2e9b3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/b/5\"><num value=\"5\">(5)</num><chapeau> to units of general local government in nonentitlement areas for planning community adjustments and economic diversification activities, which may include any eligible activities under <ref href=\"/us/usc/t42/s5305\">section 5305 of this title</ref>, required—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaba2e9b4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/b/5/A\"><num value=\"A\">(A)</num><content> by the proposed or actual establishment, realignment, or closure of a military installation,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaba310c5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/b/5/B\"><num value=\"B\">(B)</num><content> by the cancellation or termination of a Department of Defense contract or the failure to proceed with an approved major weapon system program, or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaba310c6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/b/5/C\"><num value=\"C\">(C)</num><content> by a publicly announced planned major reduction in Department of Defense spending that would directly and adversely affect a unit of general local government and will result in the loss of 1,000 or more full-time Department of Defense and contractor employee positions over a 5-year period in the unit of general local government and the surrounding area, or</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">if the Secretary (in consultation with the Secretary of Defense) determines that an action described in subparagraph (A), (B), or (C) is likely to have a direct and significant adverse consequence on the unit of general local government; and</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaba310c7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/b/6\"><num value=\"6\">(6)</num><content> for the purposes of rebuilding and revitalizing distressed areas of the Los Angeles metropolitan area.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaba310c8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Assistance to economically disadvantaged and minority students participating in community development work study programs</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Of the amount set aside for use under subsection (b) in any fiscal year, the Secretary shall,<ref class=\"footnoteRef\" idref=\"fn003351\">2</ref><note type=\"footnote\" id=\"fn003351\"><num>2</num> So in original. The comma probably should not appear.</note> make grants to institutions of higher education, either directly or through areawide planning organizations or States, for the purpose of providing assistance to economically disadvantaged and minority students who participate in community development work study programs and are enrolled in full-time graduate or undergraduate programs in community and economic development, community planning, or community management.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaba310c9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Continued availability of unused funds</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Amounts set aside for use under subsection (b) in any fiscal year but not used in that year shall remain available for use in subsequent fiscal years in accordance with the provisions of that subsection.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaba310ca-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Satisfactory assurances required, special assurances required of Indian tribes</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idaba310cb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/e/1\"><num value=\"1\">(1)</num><content> Except as provided in paragraph (2), no grant may be made under this section or <ref href=\"/us/usc/t42/s5318\">section 5318 of this title</ref> and no assistance may be made available under section 1437<i>o</i> <ref class=\"footnoteRef\" idref=\"fn003352\">3</ref><note type=\"footnote\" id=\"fn003352\"><num>3</num> See References in Text note below.</note> of this title unless the grantee provides satisfactory assurances that its program will be conducted and administered in conformity with the Civil Rights Act of 1964 [<ref href=\"/us/usc/t42/s2000a\">42 U.S.C. 2000a</ref> et seq.] and the Fair Housing Act [<ref href=\"/us/usc/t42/s3601\">42 U.S.C. 3601</ref> et seq.].</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idaba310cc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/e/2\"><num value=\"2\">(2)</num><content> No grant may be made to an Indian tribe under this section, <ref href=\"/us/usc/t42/s5306/a/1\">section 5306(a)(1) of this title</ref>, or <ref href=\"/us/usc/t42/s5318\">section 5318 of this title</ref> unless the applicant provides satisfactory assurances that its program will be conducted and administered in conformity with title II of <ref href=\"/us/pl/90/284\">Public Law 90–284</ref> [<ref href=\"/us/usc/t25/s1301\">25 U.S.C. 1301</ref> et seq.]. The Secretary may waive, in connection with grants to Indian tribes, the provisions of <ref href=\"/us/usc/t42/s5309\">section 5309 of this title</ref> and <ref href=\"/us/usc/t42/s5310\">section 5310 of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idaba310cd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/e/3\"><num value=\"3\">(3)</num><content> The Secretary may accept a certification from the grantee or applicant that it has complied with the requirements of paragraph (1) or (2), as appropriate.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaba310ce-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5307/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Criteria for selection of recipients</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Any grant made under this section shall be made pursuant to criteria for selection of recipients of such grants that the Secretary shall by regulation establish and which the Secretary shall publish together with any notification of availability of amounts under this section.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idaba310cf-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/93/383/tI/s107\">Pub.
