L. 106–569, title VI, § 609, Dec. 27, 2000, 114 Stat. 3010.)","seq_in_title":4492,"parent_identifier":"/us/usc/t42/ch70","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch70","level":"chapter","num":"CHAPTER 70—","heading":"MANUFACTURED HOME CONSTRUCTION AND SAFETY STANDARDS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idabae827b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419\"><num value=\"5419\">§ 5419.</num><heading> Authority to collect fee</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabae827c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In carrying out inspections under this chapter, in developing standards and regulations pursuant to <ref href=\"/us/usc/t42/s5403\">section 5403 of this title</ref>, and in facilitating the acceptance of the affordability and availability of manufactured housing within the Department, the Secretary may—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabaea98d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/a/1\"><num value=\"1\">(1)</num><chapeau> establish and collect from manufactured home manufacturers a reasonable fee, as may be necessary to offset the expenses incurred by the Secretary in connection with carrying out the responsibilities of the Secretary under this chapter, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabaea98e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/a/1/A\"><num value=\"A\">(A)</num><content> conducting inspections and monitoring;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabaea98f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/a/1/B\"><num value=\"B\">(B)</num><content> providing funding to States for the administration and implementation of approved State plans under <ref href=\"/us/usc/t42/s5422\">section 5422 of this title</ref>, including reasonable funding for cooperative educational and training programs designed to facilitate uniform enforcement under this chapter, which funds may be paid directly to the States or may be paid or provided to any person or entity designated to receive and disburse such funds by cooperative agreements among participating States, provided that such person or entity is not otherwise an agent of the Secretary under this chapter;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabaea990-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/a/1/C\"><num value=\"C\">(C)</num><content> providing the funding for a noncareer administrator within the Department to administer the manufactured housing program;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabaea991-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/a/1/D\"><num value=\"D\">(D)</num><content> providing the funding for salaries and expenses of employees of the Department to carry out the manufactured housing program;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabaea992-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/a/1/E\"><num value=\"E\">(E)</num><content> administering the consensus committee as set forth in <ref href=\"/us/usc/t42/s5403\">section 5403 of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabaea993-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/a/1/F\"><num value=\"F\">(F)</num><content> facilitating the acceptance of the quality, durability, safety, and affordability of manufactured housing within the Department; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabaea994-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/a/1/G\"><num value=\"G\">(G)</num><content> the administration and enforcement of the installation standards authorized by <ref href=\"/us/usc/t42/s5404\">section 5404 of this title</ref> in States in which the Secretary is required to implement an installation program after the expiration of the 5-year period set forth in <ref href=\"/us/usc/t42/s5404/c/2/B\">section 5404(c)(2)(B) of this title</ref>, and the administration and enforcement of a dispute resolution program described in <ref href=\"/us/usc/t42/s5422/c/12\">section 5422(c)(12) of this title</ref> in States in which the Secretary is required to implement such a program after the expiration of the 5-year period set forth in <ref href=\"/us/usc/t42/s5422/g/2\">section 5422(g)(2) of this title</ref>; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabaea995-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/a/2\"><num value=\"2\">(2)</num><content> subject to subsection (e), use amounts from any fee collected under paragraph (1) of this subsection to pay expenses referred to in that paragraph, which shall be exempt and separate from any limitations on the Department regarding full-time equivalent positions and travel.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabaea996-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Contractors</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In using amounts from any fee collected under this section, the Secretary shall ensure that separate and independent contractors are retained to carry out monitoring and inspection work and any other work that may be delegated to a contractor under this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabaed0a7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Prohibited use</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No amount from any fee collected under this section may be used for any purpose or activity not specifically authorized by this chapter, unless such activity was already engaged in by the Secretary prior to <date date=\"2000-12-27\">December 27, 2000</date>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabaed0a8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Modification</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Beginning on <date date=\"2000-12-27\">December 27, 2000</date>, the amount of any fee collected under this section may only be modified—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabaed0a9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/d/1\"><num value=\"1\">(1)</num><content> as specifically authorized in advance in an annual appropriations Act; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabaed0aa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/d/2\"><num value=\"2\">(2)</num><content> pursuant to rulemaking in accordance with <ref href=\"/us/usc/t5/s553\">section 553 of title 5</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabaed0ab-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Appropriation and deposit of fees</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idabaed0ac-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There is established in the Treasury of the United States a fund to be known as the “Manufactured Housing Fees Trust Fund” for deposit of amounts from any fee collected under this section. Such amounts shall be held in trust for use only as provided in this chapter.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idabaed0ad-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Appropriation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Amounts from any fee collected under this section shall be available for expenditure only to the extent approved in advance in an annual appropriations Act. Any change in the expenditure of such amounts shall be specifically authorized in advance in an annual appropriations Act.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idabaed0ae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5419/e/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Payments to States</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">On and after the effective date of the Manufactured Housing Improvement Act of 2000, the Secretary shall continue to fund the States having approved State plans in the amounts which are not less than the allocated amounts, based on the fee distribution system in effect on the day before such effective date.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idabaed0af-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/93/383/tVI/s620\">Pub.
