<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8df7a0e1-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s5842"><num value="5842">§ 5842.</num><heading> Licensing and related regulatory functions respecting selected Administration facilities</heading>
<chapeau style="-uslm-lc:I11" class="indent0">Notwithstanding the exclusions provided for in section 110a. [<ref href="/us/usc/t42/s2140/a">42 U.S.C. 2140(a)</ref>] or any other provisions of the Atomic Energy Act of 1954, as amended [<ref href="/us/usc/t42/s2011">42 U.S.C. 2011</ref> et seq.], the Nuclear Regulatory Commission shall, except as otherwise specifically provided by section 110b. of the Atomic Energy Act of 1954, as amended (<ref href="/us/usc/t42/s2140/b">42 U.S.C. 2140(b)</ref>), or other law, have licensing and related regulatory authority pursuant to chapters 6, 7, 8, and 10 of the Atomic Energy Act of 1954, as amended [<ref href="/us/usc/t42/s2071">42 U.S.C. 2071</ref> et seq., 2091 et seq., 2111 et seq., 2131 et seq.], as to the following facilities of the Administration:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8df7a0e2-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s5842/1"><num value="1">(1)</num><content> Demonstration Liquid Metal Fast Breeder reactors when operated as part of the power generation facilities of an electric utility system, or when operated in any other manner for the purpose of demonstrating the suitability for commercial application of such a reactor.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id8df7a0e3-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s5842/2"><num value="2">(2)</num><content> Other demonstration nuclear reactors—except those in existence on the effective date of this chapter—when operated as part of the power generation facilities of an electric utility system, or when operated in any other manner for the purpose of demonstrating the suitability for commercial application of such a reactor.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id8df7a0e4-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s5842/3"><num value="3">(3)</num><content> Facilities used primarily for the receipt and storage of high-level radioactive wastes resulting from activities licensed under such Act.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id8df7a0e5-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s5842/4"><num value="4">(4)</num><content> Retrievable Surface Storage Facilities and other facilities authorized for the express purpose of subsequent long-term storage of high-level radioactive waste generated by the Administration, which are not used for, or are part of, research and development activities.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id8df7a0e6-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s5842/5"><num value="5">(5)</num><content> Any facility under a contract with and for the account of the Department of Energy that is utilized for the express purpose of fabricating mixed plutonium-uranium oxide nuclear reactor fuel for use in a commercial nuclear reactor licensed under such Act, other than any such facility that is utilized for research, development, demonstration, testing, or analysis purposes.</content>
