appointment of Director</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There is hereby established in the Commission an Office of Nuclear Material Safety and Safeguards under the direction of a Director of Nuclear Material Safety and Safeguards, who shall be appointed by the Commission, who may report directly to the Commission as provided in <ref href=\"/us/usc/t42/s5849\">section 5849 of this title</ref>, and who shall serve at the pleasure of and be removable by the Commission.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabba6a02-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5844/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Functions of Director</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Subject to the provisions of this chapter, the Director of Nuclear Material Safety and Safeguards shall perform such functions as the Commission shall delegate including:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabba6a03-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5844/b/1\"><num value=\"1\">(1)</num><content> Principal licensing and regulation involving all facilities and materials, licensed under the Atomic Energy Act of 1954, as amended [<ref href=\"/us/usc/t42/s2011\">42 U.S.C. 2011</ref> et seq.], associated with the processing, transport, and handling of nuclear materials, including the provision and maintenance of safeguards against threats, thefts, and sabotage of such licensed facilities, and materials.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabba9114-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5844/b/2\"><num value=\"2\">(2)</num><chapeau> Review safety and safeguards of all such facilities and materials licensed under the Atomic Energy Act of 1954, as amended, and such review shall include, but not be limited to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabba9115-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5844/b/2/A\"><num value=\"A\">(A)</num><content> monitoring, testing, and recommending upgrading of internal accounting systems for special nuclear and other nuclear materials licensed under the Atomic Energy Act of 1954, as amended;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabba9116-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5844/b/2/B\"><num value=\"B\">(B)</num><content> developing, in consultation and coordination with the Administration, contingency plans for dealing with threats, thefts, and sabotage relating to special nuclear materials, high-level radioactive wastes and nuclear facilities resulting from all activities licensed under the Atomic Energy Act of 1954, as amended;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabba9117-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5844/b/2/C\"><num value=\"C\">(C)</num><content> assessing the need for, and the feasibility of, establishing a security agency within the office for the performance of the safeguards functions, and a report with recommendations on this matter shall be prepared within one year of the effective date of this chapter and promptly transmitted to the Congress by the Commission.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabba9118-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5844/b/3\"><num value=\"3\">(3)</num><content> Recommending research to enable the Commission to more effectively perform its functions.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabba9119-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s5844/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Responsibility for safeguarding special nuclear materials; high-level radioactive wastes and nuclear facilities</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section shall be construed to limit in any way the functions of the Administration relating to the safeguarding of special nuclear materials, high-level radioactive wastes and nuclear facilities resulting from all activities within the jurisdiction of the Administration pursuant to this chapter.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idabba911a-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/93/438/tII/s204\">Pub.
