L. 109–58, title VI, § 627, Aug. 8, 2005, 119 Stat. 784.)","seq_in_title":4667,"parent_identifier":"/us/usc/t42/ch73/schII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch73","level":"chapter","num":"CHAPTER 73—","heading":"DEVELOPMENT OF ENERGY SOURCES","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch73/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"NUCLEAR REGULATORY COMMISSION; NUCLEAR WHISTLEBLOWER PROTECTION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8df97557-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s5853\"><num value=\"5853\">§ 5853.</num><heading> Limitation on legal fee reimbursement</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Department of Energy shall not, except as required under a contract entered into before <date date=\"2005-08-08\">August 8, 2005</date>, reimburse any contractor or subcontractor of the Department for any legal fees or expenses incurred with respect to a complaint subsequent to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8df97558-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s5853/1\"><num value=\"1\">(1)</num><content> an adverse determination on the merits with respect to such complaint against the contractor or subcontractor by the Director of the Department of Energy’s Office of Hearings and Appeals pursuant to part 708 of title 10, Code of Federal Regulations, or by a Department of Labor Administrative Law Judge pursuant to <ref href=\"/us/usc/t42/s5851\">section 5851 of this title</ref>; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8df97559-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s5853/2\"><num value=\"2\">(2)</num><content> an adverse final judgment by any State or Federal court with respect to such complaint against the contractor or subcontractor for wrongful termination or retaliation due to the making of disclosures protected under chapter 12 of title 5, <ref href=\"/us/usc/t42/s5851\">section 5851 of this title</ref>, or any comparable State law,</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">unless the adverse determination or final judgment is reversed upon further administrative or judicial review.</continuation>\n<sourceCredit id=\"id8df99c6a-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/93/438/tII/s212\">Pub.
