<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida6a599b2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a"><num value="604a">§ 604a.</num><heading> Services provided by charitable, religious, or private organizations</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a599b3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a599b4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> State options</heading><chapeau style="-uslm-lc:I12" class="indent1">A State may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6a599b5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/a/1/A"><num value="A">(A)</num><content> administer and provide services under the programs described in subparagraphs (A) and (B)(i) of paragraph (2) through contracts with charitable, religious, or private organizations; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6a599b6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/a/1/B"><num value="B">(B)</num><content> provide beneficiaries of assistance under the programs described in subparagraphs (A) and (B)(ii) of paragraph (2) with certificates, vouchers, or other forms of disbursement which are redeemable with such organizations.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a599b7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Programs described</heading><chapeau style="-uslm-lc:I12" class="indent1">The programs described in this paragraph are the following programs:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6a599b8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/a/2/A"><num value="A">(A)</num><content> A State program funded under this part (as amended by section 103(a) of this Act).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6a599b9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/a/2/B"><num value="B">(B)</num><chapeau> Any other program established or modified under title I or II of this Act, that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6a599ba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/a/2/B/i"><num value="i">(i)</num><content> permits contracts with organizations; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6a599bb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/a/2/B/ii"><num value="ii">(ii)</num><content> permits certificates, vouchers, or other forms of disbursement to be provided to beneficiaries, as a means of providing assistance.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a599bc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Religious organizations</heading><content><p style="-uslm-lc:I11" class="indent0">The purpose of this section is to allow States to contract with religious organizations, or to allow religious organizations to accept certificates, vouchers, or other forms of disbursement under any program described in subsection (a)(2), on the same basis as any other nongovernmental provider without impairing the religious character of such organizations, and without diminishing the religious freedom of beneficiaries of assistance funded under such program.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a599bd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Nondiscrimination against religious organizations</heading><content><p style="-uslm-lc:I11" class="indent0">In the event a State exercises its authority under subsection (a), religious organizations are eligible, on the same basis as any other private organization, as contractors to provide assistance, or to accept certificates, vouchers, or other forms of disbursement, under any program described in subsection (a)(2) so long as the programs are implemented consistent with the Establishment Clause of the United States Constitution. Except as provided in subsection (k), neither the Federal Government nor a State receiving funds under such programs shall discriminate against an organization which is or applies to be a contractor to provide assistance, or which accepts certificates, vouchers, or other forms of disbursement, on the basis that the organization has a religious character.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a5c0ce-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Religious character and freedom</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a5c0cf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Religious organizations</heading><content><p style="-uslm-lc:I12" class="indent1">A religious organization with a contract described in subsection (a)(1)(A), or which accepts certificates, vouchers, or other forms of disbursement under subsection (a)(1)(B), shall retain its independence from Federal, State, and local governments, including such organization’s control over the definition, development, practice, and expression of its religious beliefs.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a5c0d0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Additional safeguards</heading><chapeau style="-uslm-lc:I12" class="indent1">Neither the Federal Government nor a State shall require a religious organization to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6a5c0d1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/d/2/A"><num value="A">(A)</num><content> alter its form of internal governance; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6a5c0d2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/d/2/B"><num value="B">(B)</num><content> remove religious art, icons, scripture, or other symbols;</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">in order to be eligible to contract to provide assistance, or to accept certificates, vouchers, or other forms of disbursement, funded under a program described in subsection (a)(2).</continuation>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a5c0d3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/e"><num value="e" class="bold">(e)</num><heading class="bold"> Rights of beneficiaries of assistance</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a5c0d4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">If an individual described in paragraph (2) has an objection to the religious character of the organization or institution from which the individual receives, or would receive, assistance funded under any program described in subsection (a)(2), the State in which the individual resides shall provide such individual (if otherwise eligible for such assistance) within a reasonable period of time after the date of such objection with assistance from an alternative provider that is accessible to the individual and the value of which is not less than the value of the assistance which the individual would have received from such organization.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a5c0d5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Individual described</heading><content><p style="-uslm-lc:I12" class="indent1">An individual described in this paragraph is an individual who receives, applies for, or requests to apply for, assistance under a program described in subsection (a)(2).</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a5c0d6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/f"><num value="f" class="bold">(f)</num><heading class="bold"> Employment practices</heading><content><p style="-uslm-lc:I11" class="indent0">A religious organization’s exemption provided under <ref href="/us/usc/t42/s2000e–1">section 2000e–1 of this title</ref> regarding employment practices shall not be affected by its participation in, or receipt of funds from, programs described in subsection (a)(2).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a5c0d7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/g"><num value="g" class="bold">(g)</num><heading class="bold"> Nondiscrimination against beneficiaries</heading><content><p style="-uslm-lc:I11" class="indent0">Except as otherwise provided in law, a religious organization shall not discriminate against an individual in regard to rendering assistance funded under any program described in subsection (a)(2) on the basis of religion, a religious belief, or refusal to actively participate in a religious practice.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a5c0d8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/h"><num value="h" class="bold">(h)</num><heading class="bold"> Fiscal accountability</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a5c0d9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Except as provided in paragraph (2), any religious organization contracting to provide assistance funded under any program described in subsection (a)(2) shall be subject to the same regulations as other contractors to account in accord with generally accepted auditing principles for the use of such funds provided under such programs.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a5c0da-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Limited audit</heading><content><p style="-uslm-lc:I12" class="indent1">If such organization segregates Federal funds provided under such programs into separate accounts, then only the financial assistance provided with such funds shall be subject to audit.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a5c0db-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/i"><num value="i" class="bold">(i)</num><heading class="bold"> Compliance</heading><content><p style="-uslm-lc:I11" class="indent0">Any party which seeks to enforce its rights under this section may assert a civil action for injunctive relief exclusively in an appropriate State court against the entity or agency that allegedly commits such violation.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a5c0dc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/j"><num value="j" class="bold">(j)</num><heading class="bold"> Limitations on use of funds for certain purposes</heading><content><p style="-uslm-lc:I11" class="indent0">No funds provided directly to institutions or organizations to provide services and administer programs under subsection (a)(1)(A) shall be expended for sectarian worship, instruction, or proselytization.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a5c0dd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s604a/k"><num value="k" class="bold">(k)</num><heading class="bold"> Preemption</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall be construed to preempt any provision of a State constitution or State statute that prohibits or restricts the expenditure of State funds in or by religious organizations.</p>
