<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida6a8f53d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609"><num value="609">§ 609.</num><heading> Penalties</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a8f53e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">Subject to this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a8f53f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Use of grant in violation of this part</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a8f540-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> General penalty</heading><content><p style="-uslm-lc:I13" class="indent2">If an audit conducted under chapter 75 of title 31 finds that an amount paid to a State under <ref href="/us/usc/t42/s603">section 603 of this title</ref> for a fiscal year has been used in violation of this part, the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year quarter by the amount so used.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a8f541-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Enhanced penalty for intentional violations</heading><content><p style="-uslm-lc:I13" class="indent2">If the State does not prove to the satisfaction of the Secretary that the State did not intend to use the amount in violation of this part, the Secretary shall further reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year quarter by an amount equal to 5 percent of the State family assistance grant.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a8f542-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Penalty for misuse of competitive welfare-to-work funds</heading><content><p style="-uslm-lc:I13" class="indent2">If the Secretary of Labor finds that an amount paid to an entity under <ref href="/us/usc/t42/s603/a/5/B">section 603(a)(5)(B) of this title</ref> has been used in violation of subparagraph (B) or (C) of <ref href="/us/usc/t42/s603/a/5">section 603(a)(5) of this title</ref>, the entity shall remit to the Secretary of Labor an amount equal to the amount so used.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a8f543-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Failure to submit required report</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a8f544-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Quarterly reports</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida6a8f545-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/2/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">If the Secretary determines that a State has not, within 45 days after the end of a fiscal quarter, submitted the report required by <ref href="/us/usc/t42/s611/a">section 611(a) of this title</ref> for the quarter, the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year by an amount equal to 4 percent of the State family assistance grant.</p>

</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida6a8f546-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/2/A/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Rescission of penalty</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall rescind a penalty imposed on a State under clause (i) with respect to a report if the State submits the report before the end of the fiscal quarter that immediately succeeds the fiscal quarter for which the report was required.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a8f547-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Report on engagement in additional work activities and expenditures for other benefits and services</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida6a8f548-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/2/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">If the Secretary determines that a State has not submitted the report required by <ref href="/us/usc/t42/s611/c/1/A/i">section 611(c)(1)(A)(i) of this title</ref> by <date date="2011-05-31">May 31, 2011</date>, or the report required by <ref href="/us/usc/t42/s611/c/1/A/ii">section 611(c)(1)(A)(ii) of this title</ref> by <date date="2011-08-31">August 31, 2011</date>, the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year by an amount equal to not more than 4 percent of the State family assistance grant.</p>

</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida6a8f549-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/2/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Rescission of penalty</heading><chapeau style="-uslm-lc:I14" class="indent3">The Secretary shall rescind a penalty imposed on a State under clause (i) with respect to a report required by <ref href="/us/usc/t42/s611/c/1/A">section 611(c)(1)(A) of this title</ref> if the State submits the report not later than—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida6a8f54a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/2/B/ii/I"><num value="I">(I)</num><content> in the case of the report required under <ref href="/us/usc/t42/s611/c/1/A/i">section 611(c)(1)(A)(i) of this title</ref>, <date date="2011-06-15">June 15, 2011</date>; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida6a8f54b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/2/B/ii/II"><num value="II">(II)</num><content> in the case of the report required under <ref href="/us/usc/t42/s611/c/1/A/ii">section 611(c)(1)(A)(ii) of this title</ref>, <date date="2011-09-15">September 15, 2011</date>.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida6a8f54c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/2/B/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Penalty based on severity of failure</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall impose a reduction under clause (i) with respect to a fiscal year based on the degree of noncompliance.</p>

</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a8f54d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Failure to satisfy minimum participation rates</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a8f54e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">If the Secretary determines that a State to which a grant is made under <ref href="/us/usc/t42/s603">section 603 of this title</ref> for a fiscal year has failed to comply with <ref href="/us/usc/t42/s607/a">section 607(a) of this title</ref> for the fiscal year, the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year by an amount equal to the applicable percentage of the State family assistance grant.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a91c5f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> “Applicable percentage” defined</heading><chapeau style="-uslm-lc:I13" class="indent2">As used in subparagraph (A), the term “applicable percentage” means, with respect to a State—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6a91c60-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/3/B/i"><num value="i">(i)</num><content> if a penalty was not imposed on the State under subparagraph (A) for the immediately preceding fiscal year, 5 percent; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6a91c61-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/3/B/ii"><num value="ii">(ii)</num><chapeau> if a penalty was imposed on the State under subparagraph (A) for the immediately preceding fiscal year, the lesser of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida6a91c62-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/3/B/ii/I"><num value="I">(I)</num><content> the percentage by which the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> was reduced for such preceding fiscal year, increased by 2 percentage points; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida6a91c63-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/3/B/ii/II"><num value="II">(II)</num><content> 21 percent.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a91c64-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Penalty based on severity of failure</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall impose reductions under subparagraph (A) with respect to a fiscal year based on the degree of noncompliance, and may reduce the penalty if the noncompliance is due to circumstances that caused the State to become a needy State (as defined in <ref href="/us/usc/t42/s603/b/5">section 603(b)(5) of this title</ref>) during the fiscal year or if the noncompliance is due to extraordinary circumstances such as a natural disaster or regional recession. The Secretary shall provide a written report to Congress to justify any waiver or penalty reduction due to such extraordinary circumstances.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a91c65-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Failure to participate in the income and eligibility verification system</heading><content><p style="-uslm-lc:I12" class="indent1">If the Secretary determines that a State program funded under this part is not participating during a fiscal year in the income and eligibility verification system required by <ref href="/us/usc/t42/s1320b–7">section 1320b–7 of this title</ref>, the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year by an amount equal to not more than 2 percent of the State family assistance grant.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a91c66-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Failure to comply with paternity establishment and child support enforcement requirements under part D</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding any other provision of this chapter, if the Secretary determines that the State agency that administers a program funded under this part does not enforce the penalties requested by the agency administering part D against recipients of assistance under the State program who fail to cooperate in establishing paternity or in establishing, modifying, or enforcing a child support order in accordance with such part and who do not qualify for any good cause or other exception established by the State under <ref href="/us/usc/t42/s654/29">section 654(29) of this title</ref>, the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year (without regard to this section) by not more than 5 percent.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a91c67-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/6"><num value="6" class="bold">(6)</num><heading class="bold"> Failure to timely repay a Federal Loan Fund for State Welfare Programs</heading><content><p style="-uslm-lc:I12" class="indent1">If the Secretary determines that a State has failed to repay any amount borrowed from the Federal Loan Fund for State Welfare Programs established under <ref href="/us/usc/t42/s606">section 606 of this title</ref> within the period of maturity applicable to the loan, plus any interest owed on the loan, the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year quarter (without regard to this section) by the outstanding loan amount, plus the interest owed on the outstanding amount. The Secretary shall not forgive any outstanding loan amount or interest owed on the outstanding amount.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a91c68-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7"><num value="7" class="bold">(7)</num><heading class="bold"> Failure of any State to maintain certain level of historic effort</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a91c69-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for a fiscal year by the amount (if any) by which qualified State expenditures for the then immediately preceding fiscal year are less than the applicable percentage of historic State expenditures with respect to such preceding fiscal year.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a91c6a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B"><num value="B" class="bold">(B)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I13" class="indent2">As used in this paragraph:</chapeau><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida6a91c6b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> Qualified State expenditures</heading><subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="ida6a91c6c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i/I"><num value="I" class="bold">(I)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I16" class="indent4">The term “qualified State expenditures” means, with respect to a State and a fiscal year, the total expenditures by the State during the fiscal year, under all State programs, for any of the following with respect to eligible families:</chapeau><item style="-uslm-lc:I580434" class="indent5" id="ida6a9437d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i/I/aa"><num value="aa">(aa)</num><content> Cash assistance, including any amount collected by the State as support pursuant to a plan approved under part D, on behalf of a family receiving assistance under the State program funded under this part, that is distributed to the family under <ref href="/us/usc/t42/s657/a/1/B">section 657(a)(1)(B) of this title</ref> and disregarded in determining the eligibility of the family for, and the amount of, such assistance.</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="ida6a9437e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i/I/bb"><num value="bb">(bb)</num><content> Child care assistance.</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="ida6a9437f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i/I/cc"><num value="cc">(cc)</num><content> Educational activities designed to increase self-sufficiency, job training, and work, excluding any expenditure for public education in the State except expenditures which involve the provision of services or assistance to a member of an eligible family which is not generally available to persons who are not members of an eligible family.</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="ida6a94380-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i/I/dd"><num value="dd">(dd)</num><content> Administrative costs in connection with the matters described in items (aa), (bb), (cc), and (ee), but only to the extent that such costs do not exceed 15 percent of the total amount of qualified State expenditures for the fiscal year.</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="ida6a94381-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i/I/ee"><num value="ee">(ee)</num><content> Any other use of funds allowable under <ref href="/us/usc/t42/s604/a/1">section 604(a)(1) of this title</ref>.</content>

</subclause>
<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="ida6a94382-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i/II"><num value="II" class="bold">(II)</num><heading class="bold"> Exclusion of transfers from other State and local programs</heading><chapeau style="-uslm-lc:I16" class="indent4">Such term does not include expenditures under any State or local program during a fiscal year, except to the extent that—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="ida6a94383-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i/II/aa"><num value="aa">(aa)</num><content> the expenditures exceed the amount expended under the State or local program in the fiscal year most recently ending before <date date="1996-08-22">August 22, 1996</date>; or</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="ida6a94384-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i/II/bb"><num value="bb">(bb)</num><content> the State is entitled to a payment under former <ref href="/us/usc/t42/s603">section 603 of this title</ref> (as in effect immediately before <date date="1996-08-22">August 22, 1996</date>) with respect to the expenditures.</content>

</subclause>
<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="ida6a94385-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i/III"><num value="III" class="bold">(III)</num><heading class="bold"> Exclusion of amounts expended to replace penalty grant reductions</heading><content><p style="-uslm-lc:I16" class="indent4">Such term does not include any amount expended in order to comply with paragraph (12).</p>

</subclause>
<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="ida6a94386-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i/IV"><num value="IV" class="bold">(IV)</num><heading class="bold"> Eligible families</heading><content><p style="-uslm-lc:I16" class="indent4">As used in subclause (I), the term “eligible families” means families eligible for assistance under the State program funded under this part, families that would be eligible for such assistance but for the application of <ref href="/us/usc/t42/s608/a/7">section 608(a)(7) of this title</ref>, and families of aliens lawfully present in the United States that would be eligible for such assistance but for the application of title IV of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 [<ref href="/us/usc/t8/s1601">8 U.S.C. 1601</ref> et seq.].</p>

</subclause>
<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="ida6a94387-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/i/V"><num value="V" class="bold">(V)</num><heading class="bold"> Counting of spending on certain pro-family activities</heading><content><p style="-uslm-lc:I16" class="indent4">The term “qualified State expenditures” includes the total expenditures by the State during the fiscal year under all State programs for a purpose described in paragraph (3) or (4) of <ref href="/us/usc/t42/s601/a">section 601(a) of this title</ref>.</p>

</subclause>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida6a94388-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Applicable percentage</heading><content><p style="-uslm-lc:I14" class="indent3">The term “applicable percentage” means 80 percent (or, if the State meets the requirements of <ref href="/us/usc/t42/s607/a">section 607(a) of this title</ref>, 75 percent).</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida6a94389-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Historic State expenditures</heading><chapeau style="-uslm-lc:I14" class="indent3">The term “historic State expenditures” means, with respect to a State, the lesser of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida6a9438a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/7/B/iii/I"><num value="I">(I)</num><content> the expenditures by the State under parts A and F (as in effect during fiscal year 1994) for fiscal year 1994; or</content>
</subclause>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a96aa4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8"><num value="8" class="bold">(8)</num><heading class="bold"> Noncompliance of State child support enforcement program with requirements of part D</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a96aa5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">If the Secretary finds, with respect to a State’s program under part D, in a fiscal year beginning on or after <date date="1997-10-01">October 1, 1997</date>—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6a96aa6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/A/i"><num value="i">(i)</num><subclause style="-uslm-lc:I14" class="indent3" id="ida6a96aa7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/A/i/I"><num value="I">(I)</num><content> on the basis of data submitted by a State pursuant to <ref href="/us/usc/t42/s654/15/B">section 654(15)(B) of this title</ref>, or on the basis of the results of a review conducted under <ref href="/us/usc/t42/s652/a/4">section 652(a)(4) of this title</ref>, that the State program failed to achieve the paternity establishment percentages (as defined in <ref href="/us/usc/t42/s652/g/2">section 652(g)(2) of this title</ref>), or to meet other performance measures that may be established by the Secretary;</content>

<subclause style="-uslm-lc:I14" class="indent3" id="ida6a96aa9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/A/i/III"><num value="III">(III)</num><content> on the basis of the results of an audit or audits conducted under <ref href="/us/usc/t42/s652/a/4/C">section 652(a)(4)(C) of this title</ref> that a State failed to substantially comply with 1 or more of the requirements of part D (other than paragraph (24), or subparagraph (A) or (B)(i) of paragraph (27), of <ref href="/us/usc/t42/s654">section 654 of this title</ref>); and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6a96aaa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/A/ii"><num value="ii">(ii)</num><chapeau> that, with respect to the succeeding fiscal year—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida6a96aab-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/A/ii/I"><num value="I">(I)</num><content> the State failed to take sufficient corrective action to achieve the appropriate performance levels or compliance as described in subparagraph (A)(i); or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida6a96aac-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/A/ii/II"><num value="II">(II)</num><content> the data submitted by the State pursuant to <ref href="/us/usc/t42/s654/15/B">section 654(15)(B) of this title</ref> is incomplete or unreliable;</content>
</subclause>
</clause>

<continuation style="-uslm-lc:I32" class="indent2 firstIndent0">the amounts otherwise payable to the State under this part for quarters following the end of such succeeding fiscal year, prior to quarters following the end of the first quarter throughout which the State program has achieved the paternity establishment percentages or other performance measures as described in subparagraph (A)(i)(I), or is in substantial compliance with 1 or more of the requirements of part D as described in subparagraph (A)(i)(III), as appropriate, shall be reduced by the percentage specified in subparagraph (B).</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a96aad-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/B"><num value="B" class="bold">(B)</num><heading class="bold"> Amount of reductions</heading><chapeau style="-uslm-lc:I13" class="indent2">The reductions required under subparagraph (A) shall be—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6a96aae-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/B/i"><num value="i">(i)</num><content> not less than 1 nor more than 2 percent;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6a96aaf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/B/ii"><num value="ii">(ii)</num><content> not less than 2 nor more than 3 percent, if the finding is the 2nd consecutive finding made pursuant to subparagraph (A); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6a96ab0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/B/iii"><num value="iii">(iii)</num><content> not less than 3 nor more than 5 percent, if the finding is the 3rd or a subsequent consecutive such finding.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a96ab1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/C"><num value="C" class="bold">(C)</num><heading class="bold"> Disregard of noncompliance which is of a technical nature</heading><chapeau style="-uslm-lc:I13" class="indent2">For purposes of this section and <ref href="/us/usc/t42/s652/a/4">section 652(a)(4) of this title</ref>, a State determined as a result of an audit—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6a96ab2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/C/i"><num value="i">(i)</num><content> to have failed to have substantially complied with 1 or more of the requirements of part D shall be determined to have achieved substantial compliance only if the Secretary determines that the extent of the noncompliance is of a technical nature which does not adversely affect the performance of the State’s program under part D; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6a991c3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/8/C/ii"><num value="ii">(ii)</num><content> to have submitted incomplete or unreliable data pursuant to <ref href="/us/usc/t42/s654/15/B">section 654(15)(B) of this title</ref> shall be determined to have submitted adequate data only if the Secretary determines that the extent of the incompleteness or unreliability of the data is of a technical nature which does not adversely affect the determination of the level of the State’s paternity establishment percentages (as defined under <ref href="/us/usc/t42/s652/g/2">section 652(g)(2) of this title</ref>) or other performance measures that may be established by the Secretary.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a991c4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/9"><num value="9" class="bold">(9)</num><heading class="bold"> Failure to comply with 5-year limit on assistance</heading><content><p style="-uslm-lc:I12" class="indent1">If the Secretary determines that a State has not complied with <ref href="/us/usc/t42/s608/a/7">section 608(a)(7) of this title</ref> during a fiscal year, the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year by an amount equal to 5 percent of the State family assistance grant.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a991c5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/10"><num value="10" class="bold">(10)</num><heading class="bold"> Failure of State receiving amounts from Contingency Fund to maintain 100 percent of historic effort</heading><content><p style="-uslm-lc:I12" class="indent1">If, at the end of any fiscal year during which amounts from the Contingency Fund for State Welfare Programs have been paid to a State, the Secretary finds that the qualified State expenditures (as defined in paragraph (7)(B)(i) (other than the expenditures described in subclause (I)(bb) of that paragraph)) under the State program funded under this part for the fiscal year are less than 100 percent of historic State expenditures (as defined in paragraph (7)(B)(iii) of this subsection), excluding any amount expended by the State for child care under subsection (g) or (i) of <ref href="/us/usc/t42/s602">section 602 of this title</ref> (as in effect during fiscal year 1994) for fiscal year 1994, the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year by the total of the amounts so paid to the State that the State has not remitted under <ref href="/us/usc/t42/s603/b/6">section 603(b)(6) of this title</ref>.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a991c6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/11"><num value="11" class="bold">(11)</num><heading class="bold"> Failure to maintain assistance to adult single custodial parent who cannot obtain child care for child under age 6</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a991c7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/11/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">If the Secretary determines that a State to which a grant is made under <ref href="/us/usc/t42/s603">section 603 of this title</ref> for a fiscal year has violated <ref href="/us/usc/t42/s607/e/2">section 607(e)(2) of this title</ref> during the fiscal year, the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year by an amount equal to not more than 5 percent of the State family assistance grant.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a991c8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/11/B"><num value="B" class="bold">(B)</num><heading class="bold"> Penalty based on severity of failure</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall impose reductions under subparagraph (A) with respect to a fiscal year based on the degree of noncompliance.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a991c9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/12"><num value="12" class="bold">(12)</num><heading class="bold"> Requirement to expend additional State funds to replace grant reductions; penalty for failure to do so</heading><chapeau style="-uslm-lc:I12" class="indent1">If the grant payable to a State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for a fiscal year is reduced by reason of this subsection, the State shall, during the immediately succeeding fiscal year, expend under the State program funded under this part an amount equal to the total amount of such reductions. If the State fails during such succeeding fiscal year to make the expenditure required by the preceding sentence from its own funds, the Secretary may reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the fiscal year that follows such succeeding fiscal year by an amount equal to the sum of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6a991ca-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/12/A"><num value="A">(A)</num><content> not more than 2 percent of the State family assistance grant; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6a991cb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/12/B"><num value="B">(B)</num><content> the amount of the expenditure required by the preceding sentence.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a991cc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/13"><num value="13" class="bold">(13)</num><heading class="bold"> Penalty for failure of State to maintain historic effort during year in which welfare-to-work grant is received</heading><content><p style="-uslm-lc:I12" class="indent1">If a grant is made to a State under <ref href="/us/usc/t42/s603/a/5/A">section 603(a)(5)(A) of this title</ref> for a fiscal year and paragraph (7) of this subsection requires the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> to be reduced for the immediately succeeding fiscal year, then the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for such succeeding fiscal year by the amount of the grant made to the State under <ref href="/us/usc/t42/s603/a/5/A">section 603(a)(5)(A) of this title</ref> for the fiscal year.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a9b8dd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/14"><num value="14" class="bold">(14)</num><heading class="bold"> Penalty for failure to reduce assistance for recipients refusing without good cause to work</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a9b8de-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/14/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">If the Secretary determines that a State to which a grant is made under <ref href="/us/usc/t42/s603">section 603 of this title</ref> in a fiscal year has violated <ref href="/us/usc/t42/s607/e">section 607(e) of this title</ref> during the fiscal year, the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year by an amount equal to not less than 1 percent and not more than 5 percent of the State family assistance grant.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a9b8df-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/14/B"><num value="B" class="bold">(B)</num><heading class="bold"> Penalty based on severity of failure</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall impose reductions under subparagraph (A) with respect to a fiscal year based on the degree of noncompliance.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a9b8e0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/15"><num value="15" class="bold">(15)</num><heading class="bold"> Penalty for failure to establish or comply with work participation verification procedures</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a9b8e1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/15/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">If the Secretary determines that a State to which a grant is made under <ref href="/us/usc/t42/s603">section 603 of this title</ref> in a fiscal year has violated <ref href="/us/usc/t42/s607/i/2">section 607(i)(2) of this title</ref> during the fiscal year, the Secretary shall reduce the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year by an amount equal to not less than 1 percent and not more than 5 percent of the State family assistance grant.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a9b8e2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/15/B"><num value="B" class="bold">(B)</num><heading class="bold"> Penalty based on severity of failure</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall impose reductions under subparagraph (A) with respect to a fiscal year based on the degree of noncompliance.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a9b8e3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/16"><num value="16" class="bold">(16)</num><heading class="bold"> Penalty for failure to enforce spending policies</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a9b8e4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/16/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">If, within 2 years after <date date="2012-02-22">February 22, 2012</date>, any State has not reported to the Secretary on such State’s implementation of the policies and practices required by <ref href="/us/usc/t42/s608/a/12">section 608(a)(12) of this title</ref>, or the Secretary determines, based on the information provided in State reports, that any State has not implemented and maintained such policies and practices, the Secretary shall reduce, by an amount equal to 5 percent of the State family assistance grant, the grant payable to such State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6a9b8e5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/16/A/i"><num value="i">(i)</num><content> the fiscal year immediately succeeding the year in which such 2-year period ends; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6a9b8e6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/16/A/ii"><num value="ii">(ii)</num><content> each succeeding fiscal year in which the State does not demonstrate that such State has implemented and maintained such policies and practices.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a9b8e7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/a/16/B"><num value="B" class="bold">(B)</num><heading class="bold"> Reduction of applicable penalty</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may reduce the amount of the reduction required under subparagraph (A) based on the degree of noncompliance of the State.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6a9b8ec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/c"><num value="c" class="bold">(c)</num><heading class="bold"> Corrective compliance plan</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a9b8ed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a9b8ee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/c/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Notification of violation</heading><content><p style="-uslm-lc:I13" class="indent2">Before imposing a penalty against a State under subsection (a) with respect to a violation of this part, the Secretary shall notify the State of the violation and allow the State the opportunity to enter into a corrective compliance plan in accordance with this subsection which outlines how the State will correct or discontinue, as appropriate, the violation and how the State will insure continuing compliance with this part.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a9dfff-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/c/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> 60-day period to propose a corrective compliance plan</heading><content><p style="-uslm-lc:I13" class="indent2">During the 60-day period that begins on the date the State receives a notice provided under subparagraph (A) with respect to a violation, the State may submit to the Federal Government a corrective compliance plan to correct or discontinue, as appropriate, the violation.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a9e000-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/c/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Consultation about modifications</heading><content><p style="-uslm-lc:I13" class="indent2">During the 60-day period that begins with the date the Secretary receives a corrective compliance plan submitted by a State in accordance with subparagraph (B), the Secretary may consult with the State on modifications to the plan.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6a9e001-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/c/1/D"><num value="D" class="bold">(D)</num><heading class="bold"> Acceptance of plan</heading><content><p style="-uslm-lc:I13" class="indent2">A corrective compliance plan submitted by a State in accordance with subparagraph (B) is deemed to be accepted by the Secretary if the Secretary does not accept or reject the plan during 60-day period that begins on the date the plan is submitted.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a9e002-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Effect of correcting or discontinuing violation</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may not impose any penalty under subsection (a) with respect to any violation covered by a State corrective compliance plan accepted by the Secretary if the State corrects or discontinues, as appropriate, the violation pursuant to the plan.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a9e003-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Effect of failing to correct or discontinue violation</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall assess some or all of a penalty imposed on a State under subsection (a) with respect to a violation if the State does not, in a timely manner, correct or discontinue, as appropriate, the violation pursuant to a State corrective compliance plan accepted by the Secretary.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6a9e007-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s609/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Carryforward of unrecovered penalties</heading><content><p style="-uslm-lc:I12" class="indent1">To the extent that paragraph (1) of this subsection prevents the Secretary from recovering during a fiscal year the full amount of penalties imposed on a State under subsection (a) of this section for a prior fiscal year, the Secretary shall apply any remaining amount of such penalties to the grant payable to the State under <ref href="/us/usc/t42/s603/a/1">section 603(a)(1) of this title</ref> for the immediately succeeding fiscal year.</p>
