In deciding whether to uphold an adverse action or any portion of such an action, the Board shall conduct a thorough review of the issues and take into account all relevant evidence. The Board shall make a final determination with respect to an appeal filed under paragraph (1) not less than 60 days after the date the appeal is filed.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6aa7c57-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s610/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Judicial review of adverse decision</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6aa7c58-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s610/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Within 90 days after the date of a final decision by the Board under this section with respect to an adverse action taken against a State, the State may obtain judicial review of the final decision (and the findings incorporated into the final decision) by filing an action in—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6aa7c59-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s610/c/1/A\"><num value=\"A\">(A)</num><content> the district court of the United States for the judicial district in which the principal or headquarters office of the State agency is located; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6aa7c5a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s610/c/1/B\"><num value=\"B\">(B)</num><content> the United States District Court for the District of Columbia.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6aa7c5b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s610/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Procedural rules</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The district court in which an action is filed under paragraph (1) shall review the final decision of the Board on the record established in the administrative proceeding, in accordance with the standards of review prescribed by subparagraphs (A) through (E) of <ref href=\"/us/usc/t5/s706/2\">section 706(2) of title 5</ref>.
