<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id89aa1881-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615"><num value="615">§ 615.</num><heading> Waivers</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id89aa1882-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/a"><num value="a" class="bold">(a)</num><heading class="bold"> Continuation of waivers</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id89aa1883-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Waivers in effect on <date date="1996-08-22">August 22, 1996</date></heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id89aa1884-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/a/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B), if any waiver granted to a State under <ref href="/us/usc/t42/s1315">section 1315 of this title</ref> or otherwise which relates to the provision of assistance under a State plan under this part (as in effect on <date date="1996-09-30">September 30, 1996</date>) is in effect as of <date date="1996-08-22">August 22, 1996</date>, the amendments made by the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (other than by section 103(c) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996) shall not apply with respect to the State before the expiration (determined without regard to any extensions) of the waiver to the extent such amendments are inconsistent with the waiver.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id89aa1885-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/a/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Financing limitation</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding any other provision of law, beginning with fiscal year 1996, a State operating under a waiver described in subparagraph (A) shall be entitled to payment under <ref href="/us/usc/t42/s603">section 603 of this title</ref> for the fiscal year, in lieu of any other payment provided for in the waiver.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id89aa1886-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Waivers granted subsequently</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id89aa1887-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/a/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B), if any waiver granted to a State under <ref href="/us/usc/t42/s1315">section 1315 of this title</ref> or otherwise which relates to the provision of assistance under a State plan under this part (as in effect on <date date="1996-09-30">September 30, 1996</date>) is submitted to the Secretary before <date date="1996-08-22">August 22, 1996</date>, and approved by the Secretary on or before <date date="1997-07-01">July 1, 1997</date>, and the State demonstrates to the satisfaction of the Secretary that the waiver will not result in Federal expenditures under subchapter IV of this chapter (as in effect without regard to the amendments made by the Personal Responsibility and Work Opportunity Reconciliation Act of 1996) that are greater than would occur in the absence of the waiver, the amendments made by the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (other than by section 103(c) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996) shall not apply with respect to the State before the expiration (determined without regard to any extensions) of the waiver to the extent the amendments made by the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 are inconsistent with the waiver.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id89aa1888-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/a/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> No effect on new work requirements</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding subparagraph (A), a waiver granted under <ref href="/us/usc/t42/s1315">section 1315 of this title</ref> or otherwise which relates to the provision of assistance under a State program funded under this part (as in effect on <date date="1996-09-30">September 30, 1996</date>) shall not affect the applicability of <ref href="/us/usc/t42/s607">section 607 of this title</ref> to the State.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id89aa1889-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/b"><num value="b" class="bold">(b)</num><heading class="bold"> State option to terminate waiver</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id89aa188a-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">A State may terminate a waiver described in subsection (a) before the expiration of the waiver.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id89aa188b-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I12" class="indent1">A State which terminates a waiver under paragraph (1) shall submit a report to the Secretary summarizing the waiver and any available information concerning the result or effect of the waiver.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id89aa188c-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Hold harmless provision</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id89aa188d-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding any other provision of law, a State that, not later than the date described in subparagraph (B) of this paragraph, submits a written request to terminate a waiver described in subsection (a) shall be held harmless for accrued cost neutrality liabilities incurred under the waiver.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id89aa3f9e-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Date described</heading><content><p style="-uslm-lc:I13" class="indent2">The date described in this subparagraph is 90 days following the adjournment of the first regular session of the State legislature that begins after <date date="1996-08-22">August 22, 1996</date>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id89aa3f9f-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/c"><num value="c" class="bold">(c)</num><heading class="bold"> Secretarial encouragement of current waivers</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall encourage any State operating a waiver described in subsection (a) to continue the waiver and to evaluate, using random sampling and other characteristics of accepted scientific evaluations, the result or effect of the waiver.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id89aa3fa0-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s615/d"><num value="d" class="bold">(d)</num><heading class="bold"> Continuation of individual waivers</heading><content><p style="-uslm-lc:I11" class="indent0">A State may elect to continue 1 or more individual waivers described in subsection (a).</p>
