L. 114–74, title IV, § 401(b), Nov. 2, 2015, 129 Stat. 589.)","seq_in_title":4727,"parent_identifier":"/us/usc/t42/ch77","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch77","level":"chapter","num":"CHAPTER 77—","heading":"ENERGY CONSERVATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8e0339f6-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202\"><num value=\"6202\">§ 6202.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">As used in this chapter:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e0339f7-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/1\"><num value=\"1\">(1)</num><content> The term “Secretary” means the Secretary of Energy.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e0339f8-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/2\"><num value=\"2\">(2)</num><content> The term “person” includes (A) any individual, (B) any corporation, company, association, firm, partnership, society, trust, joint venture, or joint stock company, and (C) the government and any agency of the United States or any State or political subdivision thereof.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e0339f9-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/3\"><num value=\"3\">(3)</num><content> The term “petroleum product” means crude oil, residual fuel oil, or any refined petroleum product (including any natural liquid and any natural gas liquid product).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e0339fa-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/4\"><num value=\"4\">(4)</num><content> The term “State” means a State, the District of Columbia, Puerto Rico, the Trust Territory of the Pacific Islands, or any territory or possession of the United States.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e0339fb-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/5\"><num value=\"5\">(5)</num><content> The term “United States” when used in the geographical sense means all of the States and the Outer Continental Shelf.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e0339fc-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/6\"><num value=\"6\">(6)</num><content> The term “Outer Continental Shelf” has the same meaning as such term has under <ref href=\"/us/usc/t43/s1331\">section 1331 of title 43</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e0339fd-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/7\"><num value=\"7\">(7)</num><content> The term “international energy program” means the Agreement on an International Energy Program, signed by the United States on <date date=\"1974-11-18\">November 18, 1974</date>, including (A) the annex entitled “Emergency Reserves”, (B) any amendment to such Agreement which includes another nation as a party to such Agreement, and (C) any technical or clerical amendment to such Agreement.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e0339fe-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/8\"><num value=\"8\">(8)</num><chapeau> The term “severe energy supply interruption” means a national energy supply shortage which the President determines—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8e0339ff-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/8/A\"><num value=\"A\">(A)</num><content> is, or is likely to be, of significant scope and duration, and of an emergency nature;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8e033a00-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/8/B\"><num value=\"B\">(B)</num><content> may cause major adverse impact on national safety or the national economy; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8e033a01-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/8/C\"><num value=\"C\">(C)</num><content> results, or is likely to result, from (i) an interruption in the supply of imported petroleum products, (ii) an interruption in the supply of domestic petroleum products, or (iii) sabotage, an act of terrorism, or an act of God.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e033a02-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/9\"><num value=\"9\">(9)</num><chapeau> The term “antitrust laws” includes—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8e033a03-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/9/A\"><num value=\"A\">(A)</num><content> the Act entitled “An Act to protect trade and commerce against unlawful restraints and monopolies”, approved <date date=\"1890-07-02\">July 2, 1890</date> (<ref href=\"/us/usc/t15/s1\">15 U.S.C. 1</ref>, et seq.);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8e033a04-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/9/B\"><num value=\"B\">(B)</num><content> the Act entitled “An Act to supplement existing laws against unlawful restraints and monopolies, and for other purposes”, approved <date date=\"1914-10-15\">October 15, 1914</date> (<ref href=\"/us/usc/t15/s12\">15 U.S.C. 12</ref>, et seq.);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8e033a05-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/9/C\"><num value=\"C\">(C)</num><content> the Federal Trade Commission Act (<ref href=\"/us/usc/t15/s41\">15 U.S.C. 41</ref>, et seq.);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8e033a06-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/9/D\"><num value=\"D\">(D)</num><content> sections 73 and 74 of the Act entitled “An Act to reduce taxation, to provide revenue for the Government, and for other purpose”, approved <date date=\"1894-08-27\">August 27, 1894</date> (<ref href=\"/us/usc/t15/s8\">15 U.S.C. 8</ref> and 9); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8e033a07-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/9/E\"><num value=\"E\">(E)</num><content> the Act of <date date=\"1936-06-19\">June 19, 1936</date>, chapter 592 (<ref href=\"/us/usc/t15/s13\">15 U.S.C. 13</ref>, 13a, 13b, and 21A).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e033a08-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/10\"><num value=\"10\">(10)</num><chapeau> The term “Federal land” means all lands owned or controlled by the United States, including the Outer Continental Shelf, and any land in which the United States has reserved mineral interests, except lands—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8e033a09-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/10/A\"><num value=\"A\">(A)</num><content> held in trust for Indians or Alaska Natives,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8e033a0a-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/10/B\"><num value=\"B\">(B)</num><content> owned by Indians or Alaska Natives with Federal restrictions on the title,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8e03611b-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/10/C\"><num value=\"C\">(C)</num><content> within any area of the National Park System, the National Wildlife Refuge System, the National Wilderness Preservation System, the National System of Trails, or the Wild and Scenic Rivers System, or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8e03611c-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s6202/10/D\"><num value=\"D\">(D)</num><content> within military reservations.</content>\n</subparagraph>\n</paragraph>\n<sourceCredit id=\"id8e03611d-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/94/163/s3\">Pub.
