<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idabcce093-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6283"><num value="6283">§ 6283.</num><heading> Summer fill and fuel budgeting programs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabcce094-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6283/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabcce095-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6283/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Budget contract</heading><content><p style="-uslm-lc:I12" class="indent1">The term “budget contract” means a contract between a retailer and a consumer under which the heating expenses of the consumer are spread evenly over a period of months.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabcce096-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6283/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Fixed-price contract</heading><content><p style="-uslm-lc:I12" class="indent1">The term “fixed-price contract” means a contract between a retailer and a consumer under which the retailer charges the consumer a set price for propane, kerosene, or heating oil without regard to market price fluctuations.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idabcce097-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6283/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Price cap contract</heading><content><p style="-uslm-lc:I12" class="indent1">The term “price cap contract” means a contract between a retailer and a consumer under which the retailer charges the consumer the market price for propane, kerosene, or heating oil, but the cost of the propane, kerosene, or heating oil may exceed a maximum amount stated in the contract.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabcd07a8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6283/b"><num value="b" class="bold">(b)</num><heading class="bold"> Assistance</heading><chapeau style="-uslm-lc:I11" class="indent0">At the request of the chief executive officer of a State, the Secretary shall provide information, technical assistance, and funding—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idabcd07a9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6283/b/1"><num value="1">(1)</num><content> to develop education and outreach programs to encourage consumers to fill their storage facilities for propane, kerosene, and heating oil during the summer months; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idabcd07aa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6283/b/2"><num value="2">(2)</num><content> to promote the use of budget contracts, price cap contracts, fixed-price contracts, and other advantageous financial arrangements,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">to avoid severe seasonal price increases for and supply shortages of those products.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabcd07ab-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6283/c"><num value="c" class="bold">(c)</num><heading class="bold"> Preference</heading><content><p style="-uslm-lc:I11" class="indent0">In implementing this section, the Secretary shall give preference to States that contribute public funds or leverage private funds to develop State summer fill and fuel budgeting programs.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabcd07ac-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6283/d"><num value="d" class="bold">(d)</num><heading class="bold"> Authorization of appropriations</heading><chapeau style="-uslm-lc:I11" class="indent0">There are authorized to be appropriated to carry out this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idabcd07ad-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6283/d/1"><num value="1">(1)</num><content> $25,000,000 for fiscal year 2001; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idabcd07ae-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6283/d/2"><num value="2">(2)</num><content> such sums as are necessary for each fiscal year thereafter.</content>
