identifier=\"/us/usc/t42/s6292/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The following consumer products, excluding those consumer products designed solely for use in recreational vehicles and other mobile equipment, are covered products:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a01-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/1\"><num value=\"1\">(1)</num><chapeau> Refrigerators, refrigerator-freezers, and freezers which can be operated by alternating current electricity, excluding—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabcf2a02-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/1/A\"><num value=\"A\">(A)</num><content> any type designed to be used without doors; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabcf2a03-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/1/B\"><num value=\"B\">(B)</num><content> any type which does not include a compressor and condenser unit as an integral part of the cabinet assembly.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a04-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/2\"><num value=\"2\">(2)</num><content> Room air conditioners.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a05-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/3\"><num value=\"3\">(3)</num><content> Central air conditioners and central air conditioning heat pumps.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a06-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/4\"><num value=\"4\">(4)</num><content> Water heaters.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a07-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/5\"><num value=\"5\">(5)</num><content> Furnaces.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a08-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/6\"><num value=\"6\">(6)</num><content> Dishwashers.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a09-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/7\"><num value=\"7\">(7)</num><content> Clothes washers.</content>\n</paragraph>\n<paragraph identifier=\"/us/usc/t42/s6292/a/10\"><num value=\"10\">(10)</num><content> Kitchen ranges and ovens.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a0d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/11\"><num value=\"11\">(11)</num><content> Pool heaters.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a0e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/12\"><num value=\"12\">(12)</num><content> Television sets.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a0f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/13\"><num value=\"13\">(13)</num><content> Fluorescent lamp ballasts.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a10-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/14\"><num value=\"14\">(14)</num><content> General service fluorescent lamps, general service incandescent lamps, and incandescent reflector lamps.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a15-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/19\"><num value=\"19\">(19)</num><content> Metal halide lamp fixtures.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a16-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/a/20\"><num value=\"20\">(20)</num><content> Any other type of consumer product which the Secretary classifies as a covered product under subsection (b).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabcf2a17-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Special classification of consumer product</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idabcf2a18-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/b/1\"><num value=\"1\">(1)</num><chapeau> The Secretary may classify a type of consumer product as a covered product if he determines that—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a19-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/b/1/A\"><num value=\"A\">(A)</num><content> classifying products of such type as covered products is necessary or appropriate to carry out the purposes of this chapter, and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a1a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/b/1/B\"><num value=\"B\">(B)</num><content> average annual per-household energy use by products of such type is likely to exceed 100 kilowatt-hours (or its Btu equivalent) per year.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idabcf2a1b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/b/2\"><num value=\"2\">(2)</num><chapeau> For purposes of this subsection:</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a1c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/b/2/A\"><num value=\"A\">(A)</num><content> The term “average annual per-household energy use with respect to a type of product” means the estimated aggregate annual energy use (in kilowatt-hours or the Btu equivalent) of consumer products of such type which are used by households in the United States, divided by the number of such households which use products of such type.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a1d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/b/2/B\"><num value=\"B\">(B)</num><content> The Btu equivalent of one kilowatt-hour is 3,412 British thermal units.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabcf2a1e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6292/b/2/C\"><num value=\"C\">(C)</num><content> The term “household” shall be defined and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><content> information (which may be disseminated through catalogs, trade publications, labels, or other mechanisms) that will allow window buyers to assess the energy consumption and potential cost savings of alternative window products.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"3\">“(3)</num><content> Such rating program shall be developed by the National Fenestration Rating Council according to commonly accepted procedures for the development of national testing procedures and labeling programs.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Monitoring</inline>.—</heading><content>The Secretary shall monitor and evaluate the efforts of the National Fenestration Rating Council and, not later than one year after the date of the enactment of this Act [<date date=\"1992-10-24\">Oct. 24, 1992</date>], make a determination as to whether the program developed by the Council is consistent with the objectives of subsection (a).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Alternative System</inline>.—</heading><paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"1\">(1)</num><content> If the Secretary makes a determination under subsection (b) that a voluntary national window rating program consistent with the objectives of subsection (a) has not been developed, the Secretary shall, after consultation with the National Institute of Standards and Technology, develop, not later than two years after such determination, test procedures under section 323 of the Energy Policy and Conservation Act (<ref href=\"/us/usc/t42/s6293\">42 U.S.C. 6293</ref>) for windows and window systems.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"2\">“(2)</num><content> Not later than one year after the Secretary develops test procedures under paragraph (1), the Federal Trade Commission (hereafter in this section referred to as the ‘Commission’) shall prescribe labeling rules under section 324 of such Act (<ref href=\"/us/usc/t42/s6294\">42 U.S.C. 6294</ref>) for those windows and window systems for which the Secretary has prescribed test procedures under paragraph (1) except that, with respect to any type of window or window system (or class thereof), the Secretary may determine that such labeling is not technologically feasible or economically justified or is not likely to assist consumers in making purchasing decisions.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"3\">“(3)</num><content> For purposes of sections 323, 324, and 327 of such Act [<ref href=\"/us/usc/t42/s6293\">42 U.S.C. 6293</ref>, 6294, 6297], each product for which the Secretary has established test procedures or labeling rules pursuant to this subsection shall be considered a new covered product under section 322 of such Act (<ref href=\"/us/usc/t42/s6292\">42 U.S.C. 6292</ref>) to the extent necessary to carry out this subsection.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"4\">“(4)</num><content> For purposes of section 327(a) of such Act, the term ‘this part’ includes this subsection to the extent necessary to carry out this subsection.”</content>\n</paragraph>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idabcf7845-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Energy Efficiency Information for Commercial Office Equipment</heading><p><ref href=\"/us/pl/102/486/tI/s125\">Pub. L. 102–486, title I, § 125</ref>, <date date=\"1992-10-24\">Oct. 24, 1992</date>, <ref href=\"/us/stat/106/2833\">106 Stat. 2833</ref>, provided that:<quotedContent origin=\"/us/pl/102/486/tI/s125\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"1\">(1)</num><content> The Secretary shall, after consulting with the Computer and Business Equipment Manufacturers Association and other interested organizations, provide financial and technical assistance to support a voluntary national testing and information program for those types of commercial office equipment that are widely used and for which there is a potential for significant energy savings as a result of such program.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"2\">“(2)</num><chapeau> Such program shall—</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><content> consistent with the objectives of paragraph (1), determine the commercial office equipment to be covered under such program;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><content> include specifications for testing procedures that will enable purchasers of such commercial office equipment to make more informed decisions about the energy efficiency and costs of alternative products; L. 102–486, title I, § 127</ref>, <date date=\"1992-10-24\">Oct. 24, 1992</date>, <ref href=\"/us/stat/106/2835\">106 Stat. 2835</ref>, provided that:<quotedContent origin=\"/us/pl/102/486/tI/s127\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>Not later than 18 months after the date of the enactment of this Act [<date date=\"1992-10-24\">Oct. 24, 1992</date>], the Secretary shall, in consultation with the Administrator of the Environmental Protection Agency, utilities, and appliance manufacturers, prepare and submit to the Congress, a report on the potential for the development and commercialization of appliances which are substantially more efficient than required by Federal or State law.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Identification of High-Efficiency Appliances</inline>.—</heading><chapeau>The report submitted under subsection (a) shall identify candidate high-efficiency appliances which meet the following criteria:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> The potential exists for substantial improvement in the appliance’s energy efficiency, beyond the minimum established in Federal and State law.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> There is the potential for significant energy savings at the national or regional level.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> Such appliances are likely to be cost-effective for consumers.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> Electric, water, or gas utilities are prepared to support and promote the commercialization of such appliances.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> Manufacturers are unlikely to undertake development and commercialization of such appliances on their own, or development and production would be substantially accelerated by support to manufacturers.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Recommendations and Proposals</inline>.—</heading><chapeau>The report submitted under subsection (a) shall also—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> describe the general actions the Secretary or the Administrator of the Environmental Protection Agency could take to coordinate and assist utilities and appliance manufacturers in developing and commercializing highly efficient appliances;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> describe specific proposals for Department of Energy or Environmental Protection Agency assistance to utilities and appliance manufacturers to promote the development and commercialization of highly efficient appliances;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> identify methods by which Federal purchase of highly efficient appliances could assist in the development and commercialization of such appliances; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> identify the funding levels needed to develop and implement a Federal program to assist in the development and commercialization of highly efficient appliances.”</content>\n</paragraph>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idabcfc668-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Evaluation of Utility Early Replacement Programs for Appliances</heading><p><ref href=\"/us/pl/102/486/tI/s128\">Pub.
