<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idabd19ad3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a"><num value="6294a">§ 6294a.</num><heading> Energy Star program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabd19ad4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">There is established within the Department of Energy and the Environmental Protection Agency a voluntary program to identify and promote energy-efficient products and buildings in order to reduce energy consumption, improve energy security, and reduce pollution through voluntary labeling of, or other forms of communication about, products and buildings that meet the highest energy conservation standards.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabd1c1e5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Division of responsibilities</heading><content><p style="-uslm-lc:I11" class="indent0">Responsibilities under the program shall be divided between the Department of Energy and the Environmental Protection Agency in accordance with the terms of applicable agreements between those agencies.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabd1c1e6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Duties</heading><chapeau style="-uslm-lc:I11" class="indent0">The Administrator and the Secretary shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idabd1c1e7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/c/1"><num value="1">(1)</num><chapeau> promote Energy Star compliant technologies as the preferred technologies in the marketplace for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idabd1c1e8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/c/1/A"><num value="A">(A)</num><content> achieving energy efficiency; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idabd1c1e9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/c/1/B"><num value="B">(B)</num><content> reducing pollution;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idabd1c1ea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/c/2"><num value="2">(2)</num><content> work to enhance public awareness of the Energy Star label, including by providing special outreach to small businesses;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idabd1c1eb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/c/3"><num value="3">(3)</num><content> preserve the integrity of the Energy Star label;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idabd1c1ec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/c/4"><num value="4">(4)</num><content> regularly update Energy Star product criteria for product categories;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idabd1c1ed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/c/5"><num value="5">(5)</num><content> solicit comments from interested parties prior to establishing or revising an Energy Star product category, specification, or criterion (or prior to effective dates for any such product category, specification, or criterion);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idabd1c1ee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/c/6"><num value="6">(6)</num><chapeau> on adoption of a new or revised product category, specification, or criterion, provide reasonable notice to interested parties of any changes (including effective dates) in product categories, specifications, or criteria, along with—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idabd1c1ef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/c/6/A"><num value="A">(A)</num><content> an explanation of the changes; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idabd1c1f0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/c/6/B"><num value="B">(B)</num><content> as appropriate, responses to comments submitted by interested parties; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idabd1c1f1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/c/7"><num value="7">(7)</num><content> provide appropriate lead time (which shall be 270 days, unless the Agency or Department specifies otherwise) prior to the applicable effective date for a new or a significant revision to a product category, specification, or criterion, taking into account the timing requirements of the manufacturing, product marketing, and distribution process for the specific product addressed.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idabd1c1f2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Deadlines</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall establish new qualifying levels—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idabd1c1f3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/d/1"><num value="1">(1)</num><content> not later than <date date="2006-01-01">January 1, 2006</date>, for clothes washers and dishwashers, effective beginning <date date="2007-01-01">January 1, 2007</date>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idabd1c1f4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6294a/d/2"><num value="2">(2)</num><content> not later than <date date="2008-01-01">January 1, 2008</date>, for clothes washers, effective beginning <date date="2009-07-01">July 1, 2009</date>.</content>
