L. 105–388, § 5(a)(6), Nov. 13, 1998, 112 Stat. 3478.)","seq_in_title":4790,"parent_identifier":"/us/usc/t42/ch77/schIII/ptA","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch77","level":"chapter","num":"CHAPTER 77—","heading":"ENERGY CONSERVATION","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch77/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"IMPROVING ENERGY EFFICIENCY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch77/schIII/ptA","level":"part","num":"Part A—","heading":"Energy Conservation Program for Consumer Products Other Than Automobiles","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idabd98acf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306\"><num value=\"6306\">§ 6306.</num><heading> Administrative procedure and judicial review</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabd98ad0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Procedure for prescription of rules</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idabd98ad1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/a/1\"><num value=\"1\">(1)</num><content> In addition to the requirements of <ref href=\"/us/usc/t5/s553\">section 553 of title 5</ref>, rules prescribed under section 6293, 6294, 6295, 6297, or 6298 of this title shall afford interested persons an opportunity to present written and oral data, views, and arguments with respect to any proposed rule.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idabd98ad2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/a/2\"><num value=\"2\">(2)</num><chapeau> In the case of a rule prescribed under <ref href=\"/us/usc/t42/s6295\">section 6295 of this title</ref>, the Secretary shall, by means of conferences or other informal procedures, afford any interested person an opportunity to question—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabd98ad3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/a/2/A\"><num value=\"A\">(A)</num><content> other interested persons who have made oral presentations; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabd98ad4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/a/2/B\"><num value=\"B\">(B)</num><content> employees of the United States who have made written or oral presentations with respect to disputed issues of material fact.</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">Such opportunity shall be afforded to the extent the Secretary determines that questioning pursuant to such procedures is likely to result in a more timely and effective resolution of such issues.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idabd98ad5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/a/3\"><num value=\"3\">(3)</num><content> A transcript shall be kept of any oral presentations made under this subsection.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabd98ad6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Petition by persons adversely affected by rules; effect on other laws</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idabd98ad7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/b/1\"><num value=\"1\">(1)</num><content> Any person who will be adversely affected by a rule prescribed under section 6293, 6294, or 6295 of this title may, at any time within 60 days after the date on which such rule is prescribed, file a petition with the United States court of appeals for the circuit in which such person resides or has his principal place of business, for judicial review of such rule. A copy of the petition shall be transmitted by the clerk of the court to the agency which prescribed the rule. Such agency shall file in the court the written submissions to, and transcript of, the proceedings on which the rule was based, as provided in <ref href=\"/us/usc/t28/s2112\">section 2112 of title 28</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idabd98ad8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/b/2\"><num value=\"2\">(2)</num><content> Upon the filing of the petition referred to in paragraph (1), the court shall have jurisdiction to review the rule in accordance with chapter 7 of title 5 and to grant appropriate relief as provided in such chapter. No rule under section 6293, 6294, or 6295 of this title may be affirmed unless supported by substantial evidence.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idabd9b1e9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/b/3\"><num value=\"3\">(3)</num><content> The judgment of the court affirming or setting aside, in whole or in part, any such rule shall be final, subject to review by the Supreme Court of the United States upon certiorari or certification as provided in <ref href=\"/us/usc/t28/s1254\">section 1254 of title 28</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idabd9b1ea-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/b/4\"><num value=\"4\">(4)</num><content> The remedies provided for in this subsection shall be in addition to, and not in substitution for, any other remedies provided by law.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idabd9b1eb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/b/5\"><num value=\"5\">(5)</num><chapeau> The procedures applicable under this part shall not—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabd9b1ec-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/b/5/A\"><num value=\"A\">(A)</num><content> be considered to be modified or affected by any other provision of law unless such other provision specifically amends this part (or provisions of law cited herein); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabd9b1ed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/b/5/B\"><num value=\"B\">(B)</num><content> be considered to be superseded by any other provision of law unless such other provision does so in specific terms by referring to this part and declaring that such provision supersedes, in whole or in part, the procedures of this part.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabd9b1ee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Jurisdiction</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Jurisdiction is vested in the Federal district courts of the United States over actions brought by—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabd9b1ef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/c/1\"><num value=\"1\">(1)</num><content> any adversely affected person to determine whether a State or local government is complying with the requirements of this part; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabd9b1f0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6306/c/2\"><num value=\"2\">(2)</num><content> any person who files a petition under <ref href=\"/us/usc/t42/s6295/n\">section 6295(n) of this title</ref> which is denied by the Secretary.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idabd9b1f1-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/94/163/tIII/s336\">Pub. (a) read as follows: “Rules under sections 6293, 6294, 6295(a), 6297(b), or 6298 of this title shall be prescribed in accordance with <ref href=\"/us/usc/t5/s553\">section 553 of title 5</ref>, except that—</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">“(1) interested persons shall be afforded an opportunity to present written and oral data, views, and arguments with respect to any proposed rule, and</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">“(2) in the case of a rule under <ref href=\"/us/usc/t42/s6295/a\">section 6295(a) of this title</ref>, the Secretary shall, by means of conferences or other informal procedures, afford any interested person an opportunity to question—</p>\n<p style=\"-uslm-lc:I23\" class=\"indent2\">“(A) other interested persons who have made oral presentations under paragraph (1), and</p>\n<p style=\"-uslm-lc:I23\" class=\"indent2\">“(B) employees of the United States who have made written or oral presentations,</p>\n<p style=\"-uslm-lc:I31\" class=\"indent1 firstIndent0\">with respect to disputed issues of material fact. Such opportunity shall be afforded to the extent the Secretary determines that questioning pursuant to such procedures is likely to result in a more timely and effective resolution of such issues.</p>\n<p style=\"-uslm-lc:I33\" class=\"indent0 firstIndent0\">A transcript shall be kept of any oral presentations made under this subsection.”</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">Subsec. (b). <ref href=\"/us/pl/100/12\">Pub. L. 100–12</ref> amended subsec. (b) generally. Prior to amendment, subsec. (b) read as follows:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">“(1) Any person who will be adversely affected by a rule prescribed under section 6293, 6294, or 6295 of this title when it is effective may, at any time prior to the sixtieth day after the date such rule is prescribed, file a petition with the United States court of appeals for the circuit wherein such person resides or has his principal place of business, for a judicial review thereof. A copy of the petition shall be forthwith transmitted by the clerk of the court to the agency which prescribed the rule. Such agency thereupon shall file in the court the written submissions to, and transcript of, the proceedings on which the rule was based as provided in <ref href=\"/us/usc/t28/s2112\">section 2112 of title 28</ref>.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">“(2) Upon the filing of the petition referred to in paragraph (1), the court shall have jurisdiction to review the rule in accordance with chapter 7 of title 5 and to grant appropriate relief as provided in such chapter. (a). <ref href=\"/us/pl/95/619\">Pub. (a)(1), (2), and (3)) to the same extent that such subsecs. apply to rules under <ref href=\"/us/usc/t15/s57a/a/1/B\">section 57a(a)(1)(B) of title 15</ref>, was struck out to reflect the probable intent of Congress in view of the amendment by <ref href=\"/us/pl/95/619/s425/g/1\">Pub. L. 95–619, § 425(g)(1)</ref>, which struck out designation “(1)” after subsection (a) designation, and in view of the amendment by <ref href=\"/us/pl/95/619/s422\">Pub.
