L. 105–33, title V, § 5534(b), Aug. 5, 1997, 111 Stat. 629.)","seq_in_title":1607,"parent_identifier":"/us/usc/t42/ch7/schIV/ptD","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7","level":"chapter","num":"CHAPTER 7—","heading":"SOCIAL SECURITY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"GRANTS TO STATES FOR AID AND SERVICES TO NEEDY FAMILIES WITH CHILDREN AND FOR CHILD-WELFARE SERVICES","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7/schIV/ptD","level":"part","num":"Part D—","heading":"Child Support and Establishment of Paternity","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ida6c5a4ee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663\"><num value=\"663\">§ 663.</num><heading> Use of Federal Parent Locator Service in connection with enforcement or determination of child custody in cases of parental kidnaping of child</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6c5a4ef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Agreements with States for use of Federal Parent Locator Service</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall enter into an agreement with every State under which the services of the Federal Parent Locator Service established under <ref href=\"/us/usc/t42/s653\">section 653 of this title</ref> shall be made available to each State for the purpose of determining the whereabouts of any parent or child when such information is to be used to locate such parent or child for the purpose of—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6c5a4f0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/a/1\"><num value=\"1\">(1)</num><content> enforcing any State or Federal law with respect to the unlawful taking or restraint of a child; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6c5a4f1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/a/2\"><num value=\"2\">(2)</num><content> making or enforcing a child custody or visitation determination.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6c5a4f2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Requests from authorized persons for information</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">An agreement entered into under subsection (a) shall provide that the State agency described in <ref href=\"/us/usc/t42/s654\">section 654 of this title</ref> will, under procedures prescribed by the Secretary in regulations, receive and transmit to the Secretary requests from authorized persons for information as to (or useful in determining) the whereabouts of any parent or child when such information is to be used to locate such parent or child for the purpose of—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6c5a4f3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/b/1\"><num value=\"1\">(1)</num><content> enforcing any State or Federal law with respect to the unlawful taking or restraint of a child; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6c5a4f4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/b/2\"><num value=\"2\">(2)</num><content> making or enforcing a child custody or visitation determination.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6c5a4f5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Information which may be disclosed</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Information authorized to be provided by the Secretary under subsection (a), (b), (e), or (f) shall be subject to the same conditions with respect to disclosure as information authorized to be provided under <ref href=\"/us/usc/t42/s653\">section 653 of this title</ref>, and a request for information by the Secretary under this section shall be considered to be a request for information under <ref href=\"/us/usc/t42/s653\">section 653 of this title</ref> which is authorized to be provided under such section. Only information as to the most recent address and place of employment of any parent or child shall be provided under this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6c5a4f6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> “Custody or visitation determination” and “authorized person” defined</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6c5a4f7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/d/1\"><num value=\"1\">(1)</num><content> the term “custody or visitation determination” means a judgment, decree, or other order of a court providing for the custody or visitation of a child, and includes permanent and temporary orders, and initial orders and modification;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6c5a4f8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/d/2\"><num value=\"2\">(2)</num><chapeau> the term “authorized person” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6c5a4f9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/d/2/A\"><num value=\"A\">(A)</num><content> any agent or attorney of any State having an agreement under this section, who has the duty or authority under the law of such State to enforce a child custody or visitation determination;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6c5a4fa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/d/2/B\"><num value=\"B\">(B)</num><content> any court having jurisdiction to make or enforce such a child custody or visitation determination, or any agent of such court; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6c5a4fb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/d/2/C\"><num value=\"C\">(C)</num><content> any agent or attorney of the United States, or of a State having an agreement under this section, who has the duty or authority to investigate, enforce, or bring a prosecution with respect to the unlawful taking or restraint of a child.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6c5a4fc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Agreement on use of Federal Parent Locator Service with United States Central Authority under Convention on the Civil Aspects of International Child Abduction</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall enter into an agreement with the Central Authority designated by the President in accordance with <ref href=\"/us/usc/t22/s9006\">section 9006 of title 22</ref>, under which the services of the Federal Parent Locator Service established under <ref href=\"/us/usc/t42/s653\">section 653 of this title</ref> shall be made available to such Central Authority upon its request for the purpose of locating any parent or child on behalf of an applicant to such Central Authority within the meaning of <ref href=\"/us/usc/t22/s9002/1\">section 9002(1) of title 22</ref>. The Federal Parent Locator Service shall charge no fees for services requested pursuant to this subsection.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6c5a4fd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Agreement to assist in locating missing children under Federal Parent Locator Service</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall enter into an agreement with the Attorney General of the United States, under which the services of the Federal Parent Locator Service established under <ref href=\"/us/usc/t42/s653\">section 653 of this title</ref> shall be made available to the Office of Juvenile Justice and Delinquency Prevention upon its request to locate any parent or child on behalf of such Office for the purpose of—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6c5cc0e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/f/1\"><num value=\"1\">(1)</num><content> enforcing any State or Federal law with respect to the unlawful taking or restraint of a child, or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6c5cc0f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s663/f/2\"><num value=\"2\">(2)</num><content> making or enforcing a child custody or visitation determination.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">The Federal Parent Locator Service shall charge no fees for services requested pursuant to this subsection.</continuation>\n</subsection>\n<sourceCredit id=\"ida6c5cc10-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1935-08-14/ch531\">Aug. 14, 1935, ch. 531</ref>, title IV, § 463, as added <ref href=\"/us/pl/96/611/s9/b\">Pub.
