value=\"669a\">§ 669a.</num><heading> Nonliability for financial institutions providing financial records to State child support enforcement agencies in child support cases</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6c9eaf6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding any other provision of Federal or State law, a financial institution shall not be liable under any Federal or State law to any person for disclosing any financial record of an individual to a State child support enforcement agency attempting to establish, modify, or enforce a child support obligation of such individual, or for disclosing any such record to the Federal Parent Locator Service pursuant to <ref href=\"/us/usc/t42/s666/a/17/A\">section 666(a)(17)(A) of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6c9eaf7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Prohibition of disclosure of financial record obtained by State child support enforcement agency</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">A State child support enforcement agency which obtains a financial record of an individual from a financial institution pursuant to subsection (a) may disclose such financial record only for the purpose of, and to the extent necessary in, establishing, modifying, or enforcing a child support obligation of such individual.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6ca1208-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Civil damages for unauthorized disclosure</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6ca1209-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Disclosure by State officer or employee</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If any person knowingly, or by reason of negligence, discloses a financial record of an individual in violation of subsection (b), such individual may bring a civil action for damages against such person in a district court of the United States.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6ca120a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> No liability for good faith but erroneous interpretation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">No liability shall arise under this subsection with respect to any disclosure which results from a good faith, but erroneous, interpretation of subsection (b).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6ca120b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Damages</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In any action brought under paragraph (1), upon a finding of liability on the part of the defendant, the defendant shall be liable to the plaintiff in an amount equal to the sum of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6ca120c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/c/3/A\"><num value=\"A\">(A)</num><chapeau> the greater of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6ca120d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/c/3/A/i\"><num value=\"i\">(i)</num><content> $1,000 for each act of unauthorized disclosure of a financial record with respect to which such defendant is found liable; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6ca120e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/c/3/A/ii\"><num value=\"ii\">(ii)</num><chapeau> the sum of—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida6ca120f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/c/3/A/ii/I\"><num value=\"I\">(I)</num><content> the actual damages sustained by the plaintiff as a result of such unauthorized disclosure; plus</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida6ca1210-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/c/3/A/ii/II\"><num value=\"II\">(II)</num><content> in the case of a willful disclosure or a disclosure which is the result of gross negligence, punitive damages; plus</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6ca1211-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/c/3/B\"><num value=\"B\">(B)</num><content> the costs (including attorney’s fees) of the action.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6ca1212-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section—</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6ca1213-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Financial institution</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “financial institution” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6ca1214-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/d/1/A\"><num value=\"A\">(A)</num><content> a depository institution, as defined in <ref href=\"/us/usc/t12/s1813/c\">section 1813(c) of title 12</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6ca1215-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/d/1/B\"><num value=\"B\">(B)</num><content> an institution-affiliated party, as defined in <ref href=\"/us/usc/t12/s1813/u\">section 1813(u) of title 12</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6ca1216-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/d/1/C\"><num value=\"C\">(C)</num><content> any Federal credit union or State credit union, as defined in <ref href=\"/us/usc/t12/s1752\">section 1752 of title 12</ref>, including an institution-affiliated party of such a credit union, as defined in <ref href=\"/us/usc/t12/s1786/r\">section 1786(r) of title 12</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6ca1217-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/d/1/D\"><num value=\"D\">(D)</num><content> any benefit association, insurance company, safe deposit company, money-market mutual fund, or similar entity authorized to do business in the State.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6ca1218-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669a/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Financial record</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “financial record” has the meaning given such term in <ref href=\"/us/usc/t12/s3401\">section 3401 of title 12</ref>.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit
