L. 104–193, title III, § 391, Aug. 22, 1996, 110 Stat. 2258.)","seq_in_title":1615,"parent_identifier":"/us/usc/t42/ch7/schIV/ptD","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7","level":"chapter","num":"CHAPTER 7—","heading":"SOCIAL SECURITY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"GRANTS TO STATES FOR AID AND SERVICES TO NEEDY FAMILIES WITH CHILDREN AND FOR CHILD-WELFARE SERVICES","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7/schIV/ptD","level":"part","num":"Part D—","heading":"Child Support and Establishment of Paternity","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ida6ca121d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b\"><num value=\"669b\">§ 669b.</num><heading> Grants to States for access and visitation programs</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6ca121e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Administration for Children and Families shall make grants under this section to enable States to establish and administer programs to support and facilitate noncustodial parents’ access to and visitation of their children, by means of activities including mediation (both voluntary and mandatory), counseling, education, development of parenting plans, visitation enforcement (including monitoring, supervision and neutral drop-off and pickup), and development of guidelines for visitation and alternative custody arrangements.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6ca121f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Amount of grant</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The amount of the grant to be made to a State under this section for a fiscal year shall be an amount equal to the lesser of—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6ca1220-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/b/1\"><num value=\"1\">(1)</num><content> 90 percent of State expenditures during the fiscal year for activities described in subsection (a); or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6ca1221-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/b/2\"><num value=\"2\">(2)</num><content> the allotment of the State under subsection (c) for the fiscal year.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6ca1222-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Allotments to States</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6ca1223-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The allotment of a State for a fiscal year is the amount that bears the same ratio to $10,000,000 for grants under this section for the fiscal year as the number of children in the State living with only 1 biological parent bears to the total number of such children in all States.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6ca3934-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Minimum allotment</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Administration for Children and Families shall adjust allotments to States under paragraph (1) as necessary to ensure that no State is allotted less than—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6ca3935-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/c/2/A\"><num value=\"A\">(A)</num><content> $50,000 for fiscal year 1997 or 1998; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6ca3936-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/c/2/B\"><num value=\"B\">(B)</num><content> $100,000 for any succeeding fiscal year.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6ca3937-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> No supplantation of State expenditures for similar activities</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">A State to which a grant is made under this section may not use the grant to supplant expenditures by the State for activities specified in subsection (a), but shall use the grant to supplement such expenditures at a level at least equal to the level of such expenditures for fiscal year 1995.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6ca3938-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> State administration</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Each State to which a grant is made under this section—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6ca3939-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/e/1\"><num value=\"1\">(1)</num><content> may administer State programs funded with the grant, directly or through grants to or contracts with courts, local public agencies, or nonprofit private entities;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6ca393a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s669b/e/2\"><num value=\"2\">(2)</num><content> shall not be required to operate such programs on a statewide basis;
