<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idf1f24d61-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673"><num value="673">§ 673.</num><heading> Adoption and guardianship assistance program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf1f24d62-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a"><num value="a" class="bold">(a)</num><heading class="bold"> Agreements with adoptive parents of children with special needs; State payments; qualifying children; amount of payments; changes in circumstances; placement period prior to adoption; nonrecurring adoption expenses</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idf1f24d63-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f24d64-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/1/A"><num value="A">(A)</num><content> Each State having a plan approved under this part shall enter into adoption assistance agreements (as defined in <ref href="/us/usc/t42/s675/3">section 675(3) of this title</ref>) with the adoptive parents of children with special needs.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f24d65-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/1/B"><num value="B">(B)</num><chapeau> Under any adoption assistance agreement entered into by a State with parents who adopt a child with special needs, the State—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idf1f24d66-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/1/B/i"><num value="i">(i)</num><content> shall make payments of nonrecurring adoption expenses incurred by or on behalf of such parents in connection with the adoption of such child, directly through the State agency or through another public or nonprofit private agency, in amounts determined under paragraph (3), and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idf1f24d67-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/1/B/ii"><num value="ii">(ii)</num><content> in any case where the child meets the requirements of paragraph (2), may make adoption assistance payments to such parents, directly through the State agency or through another public or nonprofit private agency, in amounts so determined.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idf1f24d68-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f24d69-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A"><num value="A">(A)</num><chapeau> For purposes of paragraph (1)(B)(ii), a child meets the requirements of this paragraph if—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idf1f24d6a-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/i"><num value="i">(i)</num><chapeau> in the case of a child who is not an applicable child for the fiscal year (as defined in subsection (e)), the child—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="idf1f24d6b-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/i/I"><num value="I">(I)</num><item style="-uslm-lc:I13" class="indent2" id="idf1f24d6c-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/i/I/aa"><num value="aa">(aa)</num><subitem style="-uslm-lc:I13" class="indent2" id="idf1f24d6d-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/i/I/aa/AA"><num value="AA">(AA)</num><content> was removed from the home of a relative specified in <ref href="/us/usc/t42/s606/a">section 606(a) of this title</ref> (as in effect on <date date="1996-07-16">July 16, 1996</date>) and placed in foster care in accordance with a voluntary placement agreement with respect to which Federal payments are provided under <ref href="/us/usc/t42/s674">section 674 of this title</ref> (or <ref href="/us/usc/t42/s603">section 603 of this title</ref>, as such section was in effect on <date date="1996-07-16">July 16, 1996</date>), or in accordance with a judicial determination to the effect that continuation in the home would be contrary to the welfare of the child; and</content>
</subitem>
<subitem style="-uslm-lc:I13" class="indent2" id="idf1f24d6e-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/i/I/aa/BB"><num value="BB">(BB)</num><content> met the requirements of <ref href="/us/usc/t42/s672/a/3">section 672(a)(3) of this title</ref> with respect to the home referred to in subitem (AA) of this item;</content>
</subitem>
</item>
<item style="-uslm-lc:I13" class="indent2" id="idf1f24d6f-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/i/I/bb"><num value="bb">(bb)</num><content> meets all of the requirements of subchapter XVI with respect to eligibility for supplemental security income benefits; or</content>
</item>
<item style="-uslm-lc:I13" class="indent2" id="idf1f24d70-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/i/I/cc"><num value="cc">(cc)</num><content> is a child whose costs in a foster family home or child-care institution are covered by the foster care maintenance payments being made with respect to the minor parent of the child as provided in <ref href="/us/usc/t42/s675/4/B">section 675(4)(B) of this title</ref>; and</content>
</item>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="idf1f24d71-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/i/II"><num value="II">(II)</num><content> has been determined by the State, pursuant to subsection (c)(1) of this section, to be a child with special needs; or</content>
</subclause>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idf1f24d72-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/ii"><num value="ii">(ii)</num><chapeau> in the case of a child who is an applicable child for the fiscal year (as so defined), the child—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="idf1f24d73-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/ii/I"><num value="I">(I)</num><item style="-uslm-lc:I13" class="indent2" id="idf1f24d74-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/ii/I/aa"><num value="aa">(aa)</num><chapeau> at the time of initiation of adoption proceedings was in the care of a public or licensed private child placement agency or Indian tribal organization pursuant to—</chapeau><subitem style="-uslm-lc:I14" class="indent3" id="idf1f24d75-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/ii/I/aa/AA"><num value="AA">(AA)</num><content> an involuntary removal of the child from the home in accordance with a judicial determination to the effect that continuation in the home would be contrary to the welfare of the child; or</content>
</subitem>
<subitem style="-uslm-lc:I14" class="indent3" id="idf1f24d76-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/ii/I/aa/BB"><num value="BB">(BB)</num><content> a voluntary placement agreement or voluntary relinquishment;</content>
</subitem>
</item>
<item style="-uslm-lc:I13" class="indent2" id="idf1f24d77-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/ii/I/bb"><num value="bb">(bb)</num><content> meets all medical or disability requirements of subchapter XVI with respect to eligibility for supplemental security income benefits; or</content>
</item>
<item style="-uslm-lc:I13" class="indent2" id="idf1f24d78-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/ii/I/cc"><num value="cc">(cc)</num><chapeau> was residing in a foster family home or child care institution with the child’s minor parent, and the child’s minor parent was in such foster family home or child care institution pursuant to—</chapeau><subitem style="-uslm-lc:I14" class="indent3" id="idf1f24d79-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/ii/I/cc/AA"><num value="AA">(AA)</num><content> an involuntary removal of the child from the home in accordance with a judicial determination to the effect that continuation in the home would be contrary to the welfare of the child; or</content>
</subitem>
<subitem style="-uslm-lc:I14" class="indent3" id="idf1f2748a-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/ii/I/cc/BB"><num value="BB">(BB)</num><content> a voluntary placement agreement or voluntary relinquishment; and</content>
</subitem>
</item>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="idf1f2748b-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/A/ii/II"><num value="II">(II)</num><content> has been determined by the State, pursuant to subsection (c)(2), to be a child with special needs.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f2748c-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/B"><num value="B">(B)</num><content> <ref href="/us/usc/t42/s672/a/4">Section 672(a)(4) of this title</ref> shall apply for purposes of subparagraph (A) of this paragraph, in any case in which the child is an alien described in such section.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f2748d-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/C"><num value="C">(C)</num><chapeau> A child shall be treated as meeting the requirements of this paragraph for the purpose of paragraph (1)(B)(ii) if—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idf1f2748e-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/C/i"><num value="i">(i)</num><chapeau> in the case of a child who is not an applicable child for the fiscal year (as defined in subsection (e)), the child—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="idf1f2748f-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/C/i/I"><num value="I">(I)</num><content> meets the requirements of subparagraph (A)(i)(II);</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="idf1f27490-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/C/i/II"><num value="II">(II)</num><content> was determined eligible for adoption assistance payments under this part with respect to a prior adoption;</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="idf1f27491-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/C/i/III"><num value="III">(III)</num><chapeau> is available for adoption because—</chapeau><item style="-uslm-lc:I14" class="indent3" id="idf1f27492-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/C/i/III/aa"><num value="aa">(aa)</num><content> the prior adoption has been dissolved, and the parental rights of the adoptive parents have been terminated; or</content>
</item>
<item style="-uslm-lc:I14" class="indent3" id="idf1f27493-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/C/i/III/bb"><num value="bb">(bb)</num><content> the child’s adoptive parents have died; and</content>
</item>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="idf1f27494-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/C/i/IV"><num value="IV">(IV)</num><chapeau> fails to meet the requirements of subparagraph (A)(i) but would meet such requirements if—</chapeau><item style="-uslm-lc:I14" class="indent3" id="idf1f27495-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/C/i/IV/aa"><num value="aa">(aa)</num><content> the child were treated as if the child were in the same financial and other circumstances the child was in the last time the child was determined eligible for adoption assistance payments under this part; and</content>
</item>
<item style="-uslm-lc:I14" class="indent3" id="idf1f27496-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/C/i/IV/bb"><num value="bb">(bb)</num><content> the prior adoption were treated as never having occurred; or</content>
</item>
</subclause>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idf1f27497-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/C/ii"><num value="ii">(ii)</num><content> in the case of a child who is an applicable child for the fiscal year (as so defined), the child meets the requirements of subparagraph (A)(ii)(II), is determined eligible for adoption assistance payments under this part with respect to a prior adoption (or who would have been determined eligible for such payments had the Adoption and Safe Families Act of 1997 been in effect at the time that such determination would have been made), and is available for adoption because the prior adoption has been dissolved and the parental rights of the adoptive parents have been terminated or because the child’s adoptive parents have died.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f27498-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/2/D"><num value="D">(D)</num><content> In determining the eligibility for adoption assistance payments of a child in a legal guardianship arrangement described in <ref href="/us/usc/t42/s671/a/28">section 671(a)(28) of this title</ref>, the placement of the child with the relative guardian involved and any kinship guardianship assistance payments made on behalf of the child shall be considered never to have been made.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idf1f27499-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/3"><num value="3">(3)</num><content> The amount of the payments to be made in any case under clauses (i) and (ii) of paragraph (1)(B) shall be determined through agreement between the adoptive parents and the State or local agency administering the program under this section, which shall take into consideration the circumstances of the adopting parents and the needs of the child being adopted, and may be readjusted periodically, with the concurrence of the adopting parents (which may be specified in the adoption assistance agreement), depending upon changes in such circumstances. However, in no case may the amount of the adoption assistance payment made under clause (ii) of paragraph (1)(B) exceed the foster care maintenance payment which would have been paid during the period if the child with respect to whom the adoption assistance payment is made had been in a foster family home.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idf1f2749a-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/4"><num value="4">(4)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f2749b-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/4/A"><num value="A">(A)</num><chapeau> Notwithstanding any other provision of this section, a payment may not be made pursuant to this section to parents or relative guardians with respect to a child—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idf1f2749c-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/4/A/i"><num value="i">(i)</num><chapeau> who has attained—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="idf1f2749d-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/4/A/i/I"><num value="I">(I)</num><content> 18 years of age, or such greater age as the State may elect under <ref href="/us/usc/t42/s675/8/B/iii">section 675(8)(B)(iii) of this title</ref>; or</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="idf1f2749e-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/4/A/i/II"><num value="II">(II)</num><content> 21 years of age, if the State determines that the child has a mental or physical handicap which warrants the continuation of assistance;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idf1f2749f-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/4/A/ii"><num value="ii">(ii)</num><content> who has not attained 18 years of age, if the State determines that the parents or relative guardians, as the case may be, are no longer legally responsible for the support of the child; or</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idf1f29bb0-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/4/A/iii"><num value="iii">(iii)</num><content> if the State determines that the child is no longer receiving any support from the parents or relative guardians, as the case may be.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f29bb1-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/4/B"><num value="B">(B)</num><content> Parents or relative guardians who have been receiving adoption assistance payments or kinship guardianship assistance payments under this section shall keep the State or local agency administering the program under this section informed of circumstances which would, pursuant to this subsection, make them ineligible for the payments, or eligible for the payments in a different amount.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idf1f29bb2-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/5"><num value="5">(5)</num><content> For purposes of this part, individuals with whom a child (who has been determined by the State, pursuant to subsection (c), to be a child with special needs) is placed for adoption in accordance with applicable State and local law shall be eligible for such payments, during the period of the placement, on the same terms and subject to the same conditions as if such individuals had adopted such child.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idf1f29bb3-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/6"><num value="6">(6)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f29bb4-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/6/A"><num value="A">(A)</num><content> For purposes of paragraph (1)(B)(i), the term “nonrecurring adoption expenses” means reasonable and necessary adoption fees, court costs, attorney fees, and other expenses which are directly related to the legal adoption of a child with special needs and which are not incurred in violation of State or Federal law.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f29bb5-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/6/B"><num value="B">(B)</num><content> A State’s payment of nonrecurring adoption expenses under an adoption assistance agreement shall be treated as an expenditure made for the proper and efficient administration of the State plan for purposes of <ref href="/us/usc/t42/s674/a/3/E">section 674(a)(3)(E) of this title</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idf1f29bb6-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/7"><num value="7">(7)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f29bb7-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/7/A"><num value="A">(A)</num><chapeau> Notwithstanding any other provision of this subsection, no payment may be made to parents with respect to any applicable child for a fiscal year that—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idf1f29bb8-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/7/A/i"><num value="i">(i)</num><content> would be considered a child with special needs under subsection (c)(2);</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idf1f29bb9-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/7/A/ii"><num value="ii">(ii)</num><content> is not a citizen or resident of the United States; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idf1f29bba-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/7/A/iii"><num value="iii">(iii)</num><content> was adopted outside of the United States or was brought into the United States for the purpose of being adopted.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f29bbb-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/7/B"><num value="B">(B)</num><content> Subparagraph (A) shall not be construed as prohibiting payments under this part for an applicable child described in subparagraph (A) that is placed in foster care subsequent to the failure, as determined by the State, of the initial adoption of the child by the parents described in subparagraph (A).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idf1f29bbc-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/8"><num value="8">(8)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f29bbd-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/8/A"><num value="A">(A)</num><content> A State shall calculate the savings (if any) resulting from the application of paragraph (2)(A)(ii) to all applicable children for a fiscal year, using a methodology specified by the Secretary or an alternate methodology proposed by the State and approved by the Secretary.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f29bbe-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/8/B"><num value="B">(B)</num><chapeau> A State shall annually report to the Secretary—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idf1f29bbf-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/8/B/i"><num value="i">(i)</num><content> the methodology used to make the calculation described in subparagraph (A), without regard to whether any savings are found;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idf1f29bc0-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/8/B/ii"><num value="ii">(ii)</num><content> the amount of any savings referred to in subparagraph (A); and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idf1f29bc1-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/8/B/iii"><num value="iii">(iii)</num><content> how any such savings are spent, accounting for and reporting the spending separately from any other spending reported to the Secretary under part B or this part.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f29bc2-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/8/C"><num value="C">(C)</num><content> The Secretary shall make all information reported pursuant to subparagraph (B) available on the website of the Department of Health and Human Services in a location easily accessible to the public.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idf1f29bc3-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/8/D"><num value="D">(D)</num><clause style="-uslm-lc:I11" class="indent0" id="idf1f29bc4-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/8/D/i"><num value="i">(i)</num><content> A State shall spend an amount equal to the amount of the savings (if any) in State expenditures under this part resulting from the application of paragraph (2)(A)(ii) to all applicable children for a fiscal year, to provide to children of families any service that may be provided under part B or this part. A State shall spend not less than 30 percent of any such savings on post-adoption services, post-guardianship services, and services to support and sustain positive permanent outcomes for children who otherwise might enter into foster care under the responsibility of the State, with at least ⅔ of the spending by the State to comply with such 30 percent requirement being spent on post-adoption and post-guardianship services.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="idf1f2c2d5-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/a/8/D/ii"><num value="ii">(ii)</num><content> Any State spending required under clause (i) shall be used to supplement, and not supplant, any Federal or non-Federal funds used to provide any service under part B or this part.</content>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf1f2c2d6-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/b"><num value="b" class="bold">(b)</num><heading class="bold"> Aid for dependent children; assistance for minor children in needy families</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idf1f2c2d7-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/b/1"><num value="1">(1)</num><content> For purposes of subchapter XIX, any child who is described in paragraph (3) is deemed to be a dependent child as defined in <ref href="/us/usc/t42/s606">section 606 of this title</ref> (as in effect as of <date date="1996-07-16">July 16, 1996</date>) and deemed to be a recipient of aid to families with dependent children under part A of this subchapter (as so in effect) in the State where such child resides.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idf1f2c2d8-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/b/2"><num value="2">(2)</num><content> For purposes of division A <ref class="footnoteRef" idref="fn002574">1</ref><note type="footnote" id="fn002574"><num>1</num> See References in Text note below.</note> of subchapter XX, any child who is described in paragraph (3) is deemed to be a minor child in a needy family under a State program funded under part A of this subchapter and deemed to be a recipient of assistance under such part.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idf1f2c2d9-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/b/3"><num value="3">(3)</num><chapeau> A child described in this paragraph is any child—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idf1f2c2da-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/b/3/A"><num value="A">(A)</num><clause style="-uslm-lc:I12" class="indent1" id="idf1f2c2db-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/b/3/A/i"><num value="i">(i)</num><content> who is a child described in subsection (a)(2), and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idf1f2c2dc-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/b/3/A/ii"><num value="ii">(ii)</num><content> with respect to whom an adoption assistance agreement is in effect under this section (whether or not adoption assistance payments are provided under the agreement or are being made under this section), including any such child who has been placed for adoption in accordance with applicable State and local law (whether or not an interlocutory or other judicial decree of adoption has been issued),</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idf1f2c2dd-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/b/3/B"><num value="B">(B)</num><content> with respect to whom foster care maintenance payments are being made under <ref href="/us/usc/t42/s672">section 672 of this title</ref>, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idf1f2c2de-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/b/3/C"><num value="C">(C)</num><content> with respect to whom kinship guardianship assistance payments are being made pursuant to subsection (d).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idf1f2c2df-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/b/4"><num value="4">(4)</num><content> For purposes of paragraphs (1) and (2), a child whose costs in a foster family home or child-care institution are covered by the foster care maintenance payments being made with respect to the child’s minor parent, as provided in <ref href="/us/usc/t42/s675/4/B">section 675(4)(B) of this title</ref>, shall be considered a child with respect to whom foster care maintenance payments are being made under <ref href="/us/usc/t42/s672">section 672 of this title</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf1f2c2e0-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/c"><num value="c" class="bold">(c)</num><heading class="bold"> Children with special needs</heading><chapeau>For purposes of this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf1f2c2e1-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/c/1"><num value="1">(1)</num><chapeau> in the case of a child who is not an applicable child for a fiscal year, the child shall not be considered a child with special needs unless—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf1f2c2e2-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/c/1/A"><num value="A">(A)</num><content> the State has determined that the child cannot or should not be returned to the home of his parents; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf1f2c2e3-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/c/1/B"><num value="B">(B)</num><content> the State had first determined (A) that there exists with respect to the child a specific factor or condition (such as his ethnic background, age, or membership in a minority or sibling group, or the presence of factors such as medical conditions or physical, mental, or emotional handicaps) because of which it is reasonable to conclude that such child cannot be placed with adoptive parents without providing adoption assistance under this section or medical assistance under subchapter XIX, and (B) that, except where it would be against the best interests of the child because of such factors as the existence of significant emotional ties with prospective adoptive parents while in the care of such parents as a foster child, a reasonable, but unsuccessful, effort has been made to place the child with appropriate adoptive parents without providing adoption assistance under this section or medical assistance under subchapter XIX; or</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf1f2c2e4-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/c/2"><num value="2">(2)</num><chapeau> in the case of a child who is an applicable child for a fiscal year, the child shall not be considered a child with special needs unless—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf1f2c2e5-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/c/2/A"><num value="A">(A)</num><content> the State has determined, pursuant to a criterion or criteria established by the State, that the child cannot or should not be returned to the home of his parents;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf1f2c2e6-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/c/2/B"><num value="B">(B)</num><clause style="-uslm-lc:I13" class="indent2" id="idf1f2c2e7-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/c/2/B/i"><num value="i">(i)</num><content> the State has determined that there exists with respect to the child a specific factor or condition (such as ethnic background, age, or membership in a minority or sibling group, or the presence of factors such as medical conditions or physical, mental, or emotional handicaps) because of which it is reasonable to conclude that the child cannot be placed with adoptive parents without providing adoption assistance under this section and medical assistance under subchapter XIX; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idf1f2e9f8-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/c/2/B/ii"><num value="ii">(ii)</num><content> the child meets all medical or disability requirements of subchapter XVI with respect to eligibility for supplemental security income benefits; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf1f2e9f9-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/c/2/C"><num value="C">(C)</num><content> the State has determined that, except where it would be against the best interests of the child because of such factors as the existence of significant emotional ties with prospective adoptive parents while in the care of the parents as a foster child, a reasonable, but unsuccessful, effort has been made to place the child with appropriate adoptive parents without providing adoption assistance under this section or medical assistance under subchapter XIX.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf1f2e9fa-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d"><num value="d" class="bold">(d)</num><heading class="bold"> Kinship guardianship assistance payments for children</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf1f2e9fb-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Kinship guardianship assistance agreement</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf1f2e9fc-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>In order to receive payments under <ref href="/us/usc/t42/s674/a/5">section 674(a)(5) of this title</ref>, a State shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf1f2e9fd-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/1/A/i"><num value="i">(i)</num><content> negotiate and enter into a written, binding kinship guardianship assistance agreement with the prospective relative guardian of a child who meets the requirements of this paragraph; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf1f2e9fe-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/1/A/ii"><num value="ii">(ii)</num><content> provide the prospective relative guardian with a copy of the agreement.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf1f2e9ff-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Minimum requirements</heading><chapeau>The agreement shall specify, at a minimum—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf1f2ea00-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/1/B/i"><num value="i">(i)</num><content> the amount of, and manner in which, each kinship guardianship assistance payment will be provided under the agreement, and the manner in which the payment may be adjusted periodically, in consultation with the relative guardian, based on the circumstances of the relative guardian and the needs of the child;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf1f2ea01-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/1/B/ii"><num value="ii">(ii)</num><content> the additional services and assistance that the child and relative guardian will be eligible for under the agreement;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf1f2ea02-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/1/B/iii"><num value="iii">(iii)</num><content> the procedure by which the relative guardian may apply for additional services as needed; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf1f2ea03-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/1/B/iv"><num value="iv">(iv)</num><content> subject to subparagraph (D), that the State will pay the total cost of nonrecurring expenses associated with obtaining legal guardianship of the child, to the extent the total cost does not exceed $2,000.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf1f2ea04-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Interstate applicability</heading><content><p style="-uslm-lc:I13" class="indent2">The agreement shall provide that the agreement shall remain in effect without regard to the State residency of the relative guardian.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf1f2ea05-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/1/D"><num value="D" class="bold">(D)</num><heading class="bold"> No effect on Federal reimbursement</heading><content><p style="-uslm-lc:I13" class="indent2">Nothing in subparagraph (B)(iv) shall be construed as affecting the ability of the State to obtain reimbursement from the Federal Government for costs described in that subparagraph.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf1f2ea06-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Limitations on amount of kinship guardianship assistance payment</heading><content><p style="-uslm-lc:I12" class="indent1">A kinship guardianship assistance payment on behalf of a child shall not exceed the foster care maintenance payment which would have been paid on behalf of the child if the child had remained in a foster family home.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf1f2ea07-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Child’s eligibility for a kinship guardianship assistance payment</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf1f2ea08-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>A child is eligible for a kinship guardianship assistance payment under this subsection if the State agency determines the following:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf1f2ea09-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/3/A/i"><num value="i">(i)</num><chapeau> The child has been—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idf1f2ea0a-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/3/A/i/I"><num value="I">(I)</num><content> removed from his or her home pursuant to a voluntary placement agreement or as a result of a judicial determination to the effect that continuation in the home would be contrary to the welfare of the child; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf1f2ea0b-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/3/A/i/II"><num value="II">(II)</num><content> eligible for foster care maintenance payments under <ref href="/us/usc/t42/s672">section 672 of this title</ref> while residing for at least 6 consecutive months in the home of the prospective relative guardian.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf1f2ea0c-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/3/A/ii"><num value="ii">(ii)</num><content> Being returned home or adopted are not appropriate permanency options for the child.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf1f2ea0d-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/3/A/iii"><num value="iii">(iii)</num><content> The child demonstrates a strong attachment to the prospective relative guardian and the relative guardian has a strong commitment to caring permanently for the child.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf1f3111e-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/3/A/iv"><num value="iv">(iv)</num><content> With respect to a child who has attained 14 years of age, the child has been consulted regarding the kinship guardianship arrangement.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf1f3111f-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Treatment of siblings</heading><chapeau>With respect to a child described in subparagraph (A) whose sibling or siblings are not so described—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf1f31120-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/3/B/i"><num value="i">(i)</num><content> the child and any sibling of the child may be placed in the same kinship guardianship arrangement, in accordance with <ref href="/us/usc/t42/s671/a/31">section 671(a)(31) of this title</ref>, if the State agency and the relative agree on the appropriateness of the arrangement for the siblings; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf1f31121-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/3/B/ii"><num value="ii">(ii)</num><content> kinship guardianship assistance payments may be paid on behalf of each sibling so placed.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf1f31122-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/d/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Eligibility not affected by replacement of guardian with a successor guardian</heading><content><p style="-uslm-lc:I13" class="indent2">In the event of the death or incapacity of the relative guardian, the eligibility of a child for a kinship guardianship assistance payment under this subsection shall not be affected by reason of the replacement of the relative guardian with a successor legal guardian named in the kinship guardianship assistance agreement referred to in paragraph (1) (including in any amendment to the agreement), notwithstanding subparagraph (A) of this paragraph and <ref href="/us/usc/t42/s671/a/28">section 671(a)(28) of this title</ref>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf1f31123-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/e"><num value="e" class="bold">(e)</num><heading class="bold"> Applicable child defined</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf1f31124-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> On the basis of age</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf1f31125-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/e/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Subject to paragraphs (2) and (3), in this section, the term “applicable child” means a child for whom an adoption assistance agreement is entered into under this section during any fiscal year described in subparagraph (B) if the child attained the applicable age for that fiscal year before the end of that fiscal year.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf1f31128-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Exception for duration in care</heading><chapeau>Notwithstanding paragraph (1) of this subsection, beginning with fiscal year 2010, such term shall include a child of any age on the date on which an adoption assistance agreement is entered into on behalf of the child under this section if the child—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf1f31129-b9bf-11e7-a128-991954bb5faa" identifier="/us/usc/t42/s673/e/2/A"><num value="A">(A)</num><content> has been in foster care under the responsibility of the State for at least 60 consecutive months; and</content>
